I can prove that I had to buy a new washing machine, I have my pay slips showing the emergency tax code and a letter from the tax office after I had spoken with them to get it corrected and of course I can get a copy of my vet bill. And all of this was in the first 2-3 months of 2024.  I panicked. Stupid I know and as you say, I have learned the hard way and I am not in any way denying anything that I have done wrong, but it just feels a bit unfair.  It is what it is I guess and if I have to have it on me forever then so be it. I am just so worried about the bank situation 😕

    • Hi @LilMissM   I guess you could call me our resident CIFAS Specialist - Personally have been through all of what you have and now have come out the other side when my marker fell off in May 2023. For a start Monzo may close your account but as I had a Marker for App Fraud (Vodafone ended up making a whole hoohah of the account I had with them) - I was with them and still am from Oct 2017 till today. And not once did they close my account. I actually spoke to a couple of current account providers at the time that I had accounts with - Nationwide and Barclays - Told them what was going on and provided all the evidence to them. They advised they may do so but it was highly unlikely now that they understood why it happened and what I was doing to fight it.    Anyway - On to your marker. MCB is My Community Bank?  I can say to you that on experience that On Monday you can be on top of the world then on Tuesday you whole life changes in a flash of an eye. Suddenly you cant pay your bills, Work isnt feasible and you are left with no other choice but to scrape by.  If this has happened to you, then join the club.  - Why is this important? Well Financial institutions get one whiff of potential fraud and you are guilty without a chance to respond. You found out the hard way   If it sounds like I'm waffling, I'm not - Its important to your issue. They have deemed you guilty by the fact that no payments have been made and potentially entered into a loan agreement knowing looking not to pay (Although thats how it may appear, there will always be factors against that)    First off - Questions - What Category of Marker do you have? If unsure, check my signature for a Credit File Guide which will tell you all you need to know about what Categories apply.  - When did you raise the complaint? They will have 8 weeks to respond. More on this in a mo.  - Do you have Correspondence / Audit Trails of communications showing that you were in severe financial strain due to an event AFTER you took the loan?   My next suggestions, Send this complaint to the CEOs office - CEOEMAIL.COM Let them make the decision as per the Complaint Procedure. Then if they refuse to remove the marker. take it to the FOS who can force the company to remove it if found in favour.  Some companies do need a slap or 2 once in a while to bring them down a peg. You could be looking at this right now.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all. I am starting a claim against Brclaycard for PPI on my credit card.

I have attached an agreement form from 2001 which I signed. It looks like PPI was mandatory as there is no option on this form is this a good cause for a claim?

 

I have full statements now back to 2004 but nothing from 01-04. how can I account for this on the spreadsheet for claims?

Hi all,

 

Been making some progress today. Managed to look at some spreadsheets and input my data. Can someone have a look to see if it is correct?

 

For pre 2004 As I mentioned I dont have any data so I have averaged my monthly PPI and added it all together to get apprximatly 600GBP for 01-04. In the spreadsheet I added this as the original PPI payment as it will be summed up for that date.

 

I would like to figure out the redress for `01-`04. Can someone advise which sheet I should use for that?

The only form I have is the one attached - the form shows that in signing it I agree to ppi but it does not look like there is any tick box (pre filled or not) at all.

I will do the spreadsheet.

Sent in my claim form which totaled almost 2.5K. (included ppi payments, charges for late payment when the account would have been in credit and also a claim for card insurance(lost or stolen) which I never new was on the account and essentially useless).

 

The letter was received by the bank 1 week ago and this morning

 

I received a letter from the card insurance company (not ppi - but the theft etc part) saying

 

thank you for the recent correspondences - due to changes in terms and my circumstances the insurance policy is no longer valid and has therefore been cancelled.......

 

anyone have any thought if this means the bank think my claim is legitimate? seems odd that I have received this letter now...

Spoke with BC yesterday. they have had my claim forms in for 20days but no response.

Aparently they have sent a response but it is "lost in the post". Also they said they had "ordered" the application form and expected it soon. I asked why this was not included in the original SAR - response: you did not specifically ask for anything... hmmm (my sar said ALL DATA relevant to me). I have already filed one SAR non-compliance with them so sent a second off today.

 

Interestingly enough on the phone the person also said "we probably have paper copies of your account pre-2004 but they did not think it was necessaty for you" also added to my 2nd SAR non-compliance.

 

Meanwhile 4 weeks on my claim has passed... we will wait and see what happens now!!! frustrating as every letter costs me 10Pound to send!!!

you don't HAVE to use recorded

 

free 1st class proof of posting in good enough

 

you only have to show the letter was sent, no delivered if it goes to the FOS etc etc

Thanks all,

I have finally got the complete accounts (back to 2002) from barclaycard. I have sent the FOS questionaire to Barclaycard and waiting a response.

 

Whilst waiting I have created the atchaed sheet as best I can from the sheet can someone have a review and let me know what they think? it seems something odd is happening around the time I cancelled the PPI in 2007.

Not sure it seemed odd that the ppi running total went to 0 - but then looking at it again I guess it is ok...

 

Not sure why but I was expeciting it to be a little higher from my original "guestimates" - Happy if this is it though! be nice to get my resposne from barclays - they have been pretty good and responsive so far so we will see.

then it throws the whole thing out.

Thanks dx, appreciate it.

Not sure why the numbers are so different I beleive both sheets are accurate (I only missed perhaps 3 statements in the running sheet and I have estimated the balances so it alligns with the next statement.)

 

Well I guess I will see what B-card come back with anyhow....the initial sheet i sent to them looks like it was undervalued (compared to the latest calcs) so I perhaps need to send an updated one before they make their decision.

Hi all,

 

Just an update and request for suggestions.

 

Barclaycard have now responded today to my claim request (almost exactly 8weeks after receiving my complaint).

they say in the letter:

 

Please provide more information about the company sick pay scheme when I was sold the policy. Confirm Employer, level of cover and length of cover.

 

I do not know the exact details of my cover it is from 2001 and a comapny I left in 2004 (although I have since rejoined). I do not beleive the company have the details of the policy although I am checking it now. Is it sufficient to name the company and state it provided private "BUPA" health insurance and was able to cover my personal expense for up to 12 months?

Furthermore:negating the fact that I had adequate cover for 12 months the fact you are nowasking what cover I had indicates to me that at the time of asking you did notfulfill your responsibilities of the ABI code of practice namely: “shall ensureas far as possible that the policy proposed is suitable to the needs of theprospective policy holder”

 

You failedto:

 

· Ask about anyexisting medical conditions

 

· Ask if Ialready had any form of payment protection

 

· Ask if I hadadequate protection due to possible sickness (clearly I did)

 

In additionto the above I have also recently received additional Barclaycard statementswhich mean I have reviewed and adjusted the value of my expected claim.

 

I haveincluded the spreadsheets but in summary:

 

PPI charges @regular interest rate of 27.95% as averaged on my balances = 6564

 

Insurancecharges with corrected interest of 26.52%=810

 

Totalexpected claim to be:

 

I will expect any offer you send to be accompanied bysuitable evidence and calculations that you have made.

letter sent and I even follwoed with a call quoting the letter word for word so that they could start the process.

 

the guy on the phone even apologized for taking 8weeks to ask for more information and said it should have been quicker.

 

not sure what they are thinking if the claim boils down to health care only.... but we will see.

Well the good news: Barclaycard have credited my account with circa 1700GBP :)

and this ties up with my initial estimation of redress which can be seen in post 15. however not the smae as the newer calculation which was circa 6K.

 

Can someone have a look as I am expecting a letter of which I will need to accept or challange.

also they have credited my credit card so I am now in significantly +ve balance. should this not have been credited to my bank?

 

in addition I have also sent in the same request to NatWest do you think they will follow the same understanding? the credit cards are from the same period (about 6months difference) and the reason for reclaim is the same (i had cover from my work). only N/W is considerbally larger claim (circa 14K).

Hi All, I now have the letter from Barclays and they have the following to say:

 

Your Claim has been upheld.

Thank you for providing the additional information we requested.

We have now finished investigating your claim and we agree that we mis-sold you PPI. We are sorry this policy was mis-sold and we will provide a full refund of 1744.41.

 

What this means to you.

We will refund all the insurance premiums you have paid together with interest paid on the premiums tod date.

 

We have included an additional 8% interest on top of your refund as statutory compensation. We will include an extra 45 days of simple interes to give us time ot make the payment to you.

Refund of premiums made: 692.68

Refund of interest charged: 552.68

8% simple interest: 623.81

Income tax deduction: 124.76

 

Totla refund: 1744.41.

 

Can someone help me to suggest if I should accept or appeal. I am struggling to balance this with the spreadsheets I should use.
