      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Spoke to Robert today.........they are settling in FULL!!! He posted letter today so i just need to wait for it in the post. I won't quite believe i've won till i see it in black and white. As soon as i receive letter I will post on thread!!!!

I have received settlement letter today!!!!!!! Yipee!!!! I don't want to accept their terms however I just don't have the energy to fight anymore so I'm gonna accept them even though it grates on every principle i believe in. If I had n't lost my brother weeks ago it would have been a different story.

 

I would note that warrentuff (CONGRATULATIONS) had there claim settled by Robert Saunders more swiftly than i did probably due to persistance (more than I could manage) so my advice to everyone is keep at them and you'll get there.

 

At last something good has happened!!!!!!!!!!!!!!!

I can't wait for my £3752.64 to hit my account OMG £3752.64 this will pay towards a really nice headstone for my brother.

Hey! Ho! After emailing my settlement acceptance last week, Robert confirmed payment should follow within 48 hours. Six days later still no sign of money. He told my the accounts dept are dealing with it and he can try to contact them but they are soooooooooooooo BUSY!!!

 

My court date is FRIDAY am, yes this FRIDAY, 3 days from now. I told him i will not confirm to court that this has been settled until i receive my money, this seems to make no difference.

 

Do I need to post letter to court so they receive it before friday?

What if I do this and I don't receive my money?

If I don't post letter and receive settlement will i be in trouble from the court?

Hi clairec

 

I would prepare the letter and sign it. If you receive it anytime before Friday, you can ring court (get name of court clerk) and advise that you are faxing a letter through, then phone 30 mins later to confirm they've received. It's then in the court admin domain and you have fullfilled your duty to inform them.

 

If you don't have access to a fax, pop it down in person. Does you post normally get delivered first thing? Same goes for it you receive cheque on Friday morning though I would be inclined to go down in person - the court staff are normally all very friendly and helpful.

Thx Welshcakes! Only other MAJOR problem is that I am not at home and i am no where near my court for the hearing due to my brothers death I'm with my parents. I really can't travel back for Friday.

 

Does anyone know if Barclay/Woolwich can back out of there offer if I haven't been paid by Friday? Should I just send letter to the court and hope they don't withdraw settlement? What would happen if they did?

Absolutely do not send the letter the court saying it has settled. The banks cannot be trusted, if you ask the court to vacate the hearing it would not surprise me if Woolwich renege on the deal.

 

Phone the court tomorrow (make a note of who you are speaking to) tell them that Woolwich have made a full offer but you have not received the cash so presently cannot ask the court to vacate the hearing. Explain your position regarding brother and being unable to attend. They should understand. Then advise the court that you will be in contact in the next few days.

 

This way if Woolwich do not pay, the court should be sympathetic to you not turning up and adjourn the hearing or maybe even issue judgement in your favour. It is likely however that Woolwich will pay.

 

The banks just play games with you - they do not care; but we do.

Thanks GuidoT, I thought that this might be the case, barclays know of my situation, I informed them that the delay in resolving this was causing me undue stress. I will contact the court tomorrow morning and also phone the head of Barclays Lit team.

The thing that really p***** me off is my brother took his own life partly due to the stress of institutions like barclays bombarding people with offers of loans and extending overdrafts etc and then when that persons situation changes through no fault of their own these institutions show no sympathy and continue to add charge after charge after charge....it makes me so MAD!!!! My brother had even taken out payment protection but as in most cases it didn't cover him when he needed it. People BEWARE you pay a premium for this but always read the small print!

I was in the process of helping my brother reclaim his bank charges, perhaps if the banks showed a little more empathy in certain situations their customers would not be driven to dispair.

I really wish I had the energy to take Barclays to court on Friday for my brothers sake but like my brother I have run out of steam.

Banks really don't care!!!!!!!!!!!!!!!!!!!!!!

Sorry for the rant, i'm just so angry................

Dont give up now, if for no other reason than justice for you and your brother, see the thing through, dont let them grind you down, think of it as an act of revenge if you must, there is nothing like getting your own back.
