    • The neighbour's house is built right on the boundary so the side of their house is effectively the 'wall' in our garden separating the two properties. It's a three storey house and so the mortar poses a potential danger to us. Because of the danger, we have put up an interior fence in our garden to ensure we don't risk mortar dropping on us. That reduces the garden by 25% which is not only an inconvenience, but it's the part of the garden where we had lined up contractors to install a patio and gazebo which we will use for our wedding reception in less than 2 months. We have spoken to the neighbour's caretaker who is on the case, has spoken with a roofer and possibly a scaffolding company, but there are several issues. They don't seem to understand the urgency. As long as there is a risk of falling mortar, we can't carry out any work in the garden, and unless they hurry up, we're looking at cancelling our wedding as it's not viable to book a venue because we can't use our own garden! Also, they want to put the scaffolding up in our garden which would be ok with us if it was a matter of a few days and they hurried up, but there is a tree (most likely protected by the conservation area), so most likely they can only reach part of the roof with the scaffolding if they put it up in our garden. We suggested a roofer with a cherry picker but they seem to want to use a company they've used before. Any and all comments, suggestions, advice is more than welcome.  PS. does it make any difference that the neighbour is a business (ltd) and not a private dwelling?

    • Apologies all for the late reply and info, i have been away with the Army. They have paid I accepted the offer on the 5th of May, and they paid on the 17th of May.
    • Hello everyone,   Just thought id post an update.   I've today now finally received a claim form from PRA Group. Bit annoying as the last payment to them would have August 2018 so was nearly over the line. I believe my only grounds for defence is that they haven't managed to produce a copy of the DN notice, however from some online research I managed to find some case law that stated they can use their systems screenshot to show proof of it being sent.   I know I have to respond back to their claim form and will do so online on moneyclaim, is now the time to pick up the phone to them and negotiate a deal?   Any advice as always is much appreciated it.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Great have found that, am just starting to find my way around this website/forum.

Would I put on this Harrassment Letter, problems with my health, have got my anxiety back, had panic attacks and only 3 hours sleep a night!

 

 

no just send the letter don't give anything away and DO NOT SIGN IT

Hi Redz,

 

I can sympathise as OH has also had one of those yellow cards from Allied demanding £9500 on 21st Feb for a loan taken out in 2004. This loan was for £10k plus about £2k PPI of which OH has repaid £6500.

 

We sent them an Account in Dispute letter on 2nd March as we have an ongoing claim for mis-sold PPI and have heard nothing since.

 

I thought that 'no news was good news' so to speak, but now am worried after reading your post about charging orders and repossession threats:eek:

 

I would definitely send the harrassment letter and CCA letter if you haven't already done so.

I started to get very worried after reading about AIC relating threads.

Would someone please give me an advice on how I go about this?

 

Like other people on this thread, I am going through a bit of hassle with Allied International. I had a student account about at least 7 years ago, maxed out my overdraft. After I got a job starting with small wages, I was paying back to Lloyds when I could (but I could not catch up with Lloyds' payment due on my credit card loans sometimes, so my debts have never been cleared, and as I recall, they built up so fast)

 

Now I have been living overseas for 4 years and felt I could start paying back maybe in portions monthly if they could come up with some kind of agreement, so I called Lloyds and they gave me a number for Allied International Credit(AIC) saying it was not their matter any more and has been passed on to them.

 

So I made an call to AIC requiring my situation and the guy said if I pay £3,000 in full by 25th March 09, they would knock off the rest, and then he gave me a SWIFT and IBAN number so that I can send money internationally.

 

I thought this agreement sounds fine only if he will send me a form of receipt clearly stating that all my debt is cleared, after him confirming the amount has arrived. He said he could not send a document internationally and the only way I could check the status of my debt was to give him a call again after sending money.

 

Can I just trust him and send money oversea as I will have a recepit of this transaction from a bank where I send money from anyway? Or is there any thing I can do before sending money so that I won't get the same duplicate debt again in the future?

 

Also should I send the CCA letter to them anyway?

 

Really would like to be debt-free so appreciate your advice.

Hi HoneyBee, Like others on this thread, I have had horrendous dealings with AIC. Personally I wouldn't trust anything they say over phone. These guys seem only interested in their commission for money they get out of you.

 

I'm fairly new here and no expert, but would definitely send the CCA before you do anything - that will tell you if you have an enforceable agreement. I'd also stop talking to them on the phone, that's how they try and intimidate you. They started off pleasant with me, offering so called discounts and stuff, but it soon turned nasty.

 

Since I sent them a CCA, I haven't heard from them in months.

Since my last post I have sent a CCA request and a telephone harrassment letter, but on the day I sent a letter they phoned me to ask when I would be paying £1,500 and then they could set up a monthly agreement.

 

Since then I have talked to Consumer Credit Counselling Service, who are a charity and offer their services free, I was on the phone to them for an hour! (it's a freephone number), and they were very helpful, told me not to pay them the £1,500, that the law is on my side and that before it goes to a charging order, it will go to court and a judge will make a decision on what I can afford to pay. I have a telephone appointment with them at 5pm tomorrow.

I am dreading tomorrow though as Allied are expecting a payment, will just have to not answer the phone I guess! (That's if they phone!)

Yes - don't speak to Allied Int on the phone! You've already asked them not to ring you and you are not obliged to talk to them on the phone. CCCS have advised you not to pay, so try not to worry about them, they can't do anything.

Great thanks for that, I feel reassured now!

Although they have tried to phone me, but didn't leave a message... I just know it was them!

 

The only thing I am slightly worried about is that when I spoke to Loyds TSB about this debt, they said if Allied sent it back to them they would then SELL it to another debt collectors, which would be worse for me.

 

Yes - don't speak to Allied Int on the phone! You've already asked them not to ring you and you are not obliged to talk to them on the phone. CCCS have advised you not to pay, so try not to worry about them, they can't do anything.

Hopefully someone a little bit more knowledgeable than me will be along to comment on this....but I don't think the debt getting passed on changes anything if they cannot comply with your CCA request.

 

My debt got passed to Allied, and then onto RMA....who have now gone quiet. It was Allied who I sent the CCA request to and they never responded. I think, from reading a few others posts on here, debts are quite often passed from debt collector to debt collector to see who has the most success in getting money from you. So I would say, stick to your guns, only deal in writing and ignore these threats.....if they can't produce a CCA then its only going to get worse for them, not you.

Hi!

 

Today I have heard from Allied International saying they have taken on the debt from American Express. They sai they want full payment by 4pm today or they can put a charge on my house of declare me bankrupt. I have appointed a ebt management company to deal with my debts an they have today written to them. They have called 4 times so far toay with threatening calls asking me how I am going to make full payment by the end of the day.

 

I note from these threads about them that people are writing to them requesting CCA's. Can someone tell what this is, what it does and what I need to do to stop them threatening me while I'm at work.

play them at own game don't talk to them on phone or give incorrect details when doing sec check, i know its hard but i had all this from them and i was at my wits end, send cca request and harrasment letter, that should get rid of them , it did work for me.

offer to pay using your amex card i would love to see they face when the card gets declined , don't worry somebody will give you more advice. find the cca letters on here

We are having a lot of problems with these clowns too.

 

They keep phoning insisting that I am somebody called Dennis Owens and that I owe some money. I have told them several times that I am not this person, I've never even heard of him and that was not the surname of the people we bought the house from 5 years ago.

This guy insists on calling me Dennis and that he is just going to keep on calling until I tell him exactly who I am. I have told him I have no intention of giving out my personal information.

Hi Guys

Above is fine Dav3yBoy, but it is 12 + 2 days. Then it is 30 days AFTER the 12+2 days (I think) Make sure all receipts are duly dated and signed. You can check on screen, delivery receipts at the postoffice. Take a screenprint and paste into word document and name and file with the rest of your letters - when needed for court or whatever, print out the proof. Also, Make sure all this info is backed up regularly - don't loose vital information and proof on your PC and print a hardcopy of every item relating to each case and keep in a folder for presentation.
