      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

So you've still got the funds for your phone?

Don't even consider paying paypal back.

Get a crime reference number from the police and email/write to Paypal telling them you are a victim of fraud.

Make sure you keep all correspondence.

 

You'll get no satisfaction from them they're useless.

 

Just reiterate them same facts to them over and eventually they will threaten you with court action,

it won't ever get to court BUT if it did you would win (providing you have the paper trail,

as they will only have sent you the same email over and over requesting you to restore your balance)

 

Eventually they will pass it to a debt collection agency and when that happens you can come back for more advice - guys on here are experts.

Totally agree with Bombay, deal only in writing, stay off the phone! I told you they're not interested in amything you have to say and are totally useless. Family and friends? Ffs aren't they kind to have made that suggestion.

Don't restore that balance! Let them bear the burden of the fraud, why should you be out of pocket?

I had a long running dispute with eBay, not on the same scale as you and they were utter fuds.

 

They were bombarding me with the same emails over and over.

 

Despite me carefully wording responses, they would reply with another generic email. Theyre like robots!

 

Eventually I got a letter from a DCA, (something solutions)I never responded.

 

Another one arrived..

 

After about 4, I printed off all the correspondence and posted it to the DCA, told them to p..s off

and IF they filed for court action to remember and send the court all my emails so they could get a laugh.

 

Never heard from them again.

 

I've had a few calls which I suspect might be from them.

 

I just say 'I'm sorry there is a fault,

 

I'm sorry there is a fault til they hang up

Well done, proud of you! They want you to think there is no other way to communicate other than phone, that suits them! Just repeat same message over and over to them, the penny will drop- eventually x

Your bank and Paypal are two separate institutions

- once you have cancelled any payment authority that should be it.

 

Paypal doesn't 'talk' to your bank.

They won't contact your bank,

if they try and take any funds,

the payment system will inform them that there is no DD and refer them to you.

 

They might write to you telling you your payment method has failed and you have to restore your balance by other means.

 

Ignore it.

 

You're bank is there to serve you not that shower of B's

Cancel your card and get a new one, don't use it for eBay or Paypal - they can't access your account if they don't have the card details!

eBay and Paypal might be unethical and useless but they're not the secret service magicians. How will they access your account without a DD mandate or your card details?

It's been my pleasure... You were wise to get that money out of the Paypal account! Quick thinking on your part. eBay would never have refunded you. .. stick to your guns and you'll be ok x

No.. as long as you have cancelled any payment authority in respect of Paypal, which you have done, and you said the bank have assured you that PP cant access your account. So i would say you're ok x

You're entitled to your opinion. Paypal victims? Laughable.! They are far more able to absorb a loss than the OP, and the OP's domestic arrangements and his sale of the phone have no bearing on these posts and is no business of yours or mine

Its of no consequence whether their ability to absorb a loss has legal bearing,

I have given the OP the advice he needs to deal with paypal.

You haven't given any advice, you're here fighting paypal's corner which you don't need to do.

 

Paypals customer service is appalling, I'm just glad the OP was able to keep his cash.

 

If you're so concerned with poor paypal and the injustice

you think the OP is levying against them,

 

why don't you get a description of the thief and contact the police?

 

You can put a halt to the pseudo criminal injuries shenanigans..

Only deal with these people in writing too. Don't discuss anything over the phone x

If they ring you again tell them to put it in writing!

Remember you need a paper trail! DCA are not your friends, they are in the business of making money, out of you if possible x

Alex they're scaremongering you, they're doing so you will ring them and they will start asking you to restore your balance. What they've done is convert the money you owe then into Euros so you'll think "omg my debt is getting worse I better sort it"

 

Do as Brig has suggested BUT only in writing x
