    • Sending you a big hug. I’m sorry your going through this. The letters they send sound aweful, and the waiting game for them to stop. But these guys seem so knowledgable and these letters should stop. Hang in there, and keep in touch. Don’t feel alone 
    • In my time I've never seen a payout/commission from a PPC to a landlord/MA. Normally the installation of all the cameras/payment of warden patrols etc is free but PPCs keep 100% of the ticket revenue. Not saying it doesn't happen mind. I've done some more digging on this: Remember, what your lease doesn't say is just as important as what it does say. If your lease doesn't mention a parking scheme/employment of a PPC/Paying PCNs etc you're under no legal obligation to play along to the PPC's or the MA's "Terms and conditions". I highly doubt your lease had a variation in place to bring in this permit system. Your lease will likely have a "quiet enjoyment" clause for your demised space and the common areas and having to fight a PPC/MA just to park would breach that. Your lease has supremacy of contract, but I do agree it's worth keeping cool and not parking there (and hence getting PCNs) for a couple months just so that the PPC doesn't get blinded by greed and go nuclear on you if you have 4 or 5 PCNs outstanding. At your next AGM, bring it up that the parking controls need to be removed and mention the legal reasons why. One reason is that under S37(5b) Landlord and Tenant Act 1987,  more than 75% of leaseholders and/or the landlord would have needed to agree, and less than 10% opposed, for the variation to take place. I highly doubt a ballot even happened before the PPC was bought in so OPS even being there is unlawful, breaching the terms of your lease. In this legal sense,  the communal vote of the "directors" of the freehold company would have counted for ONE vote of however many flats there are (leases/tenants) + 1 (landlord). It's going to be interesting to see where this goes.  
    • @Whyisitthisthank you very much for asking. I am still feeling anxious, especially when someone rings the doorbell, or when I receive a letter I feel a it paranoid. I stopped going to the shops unless I really have to. I shop online now. When I see security I feel paralised. 
    • My expectation was their WS would include the best paperwork, like at least true copies of originals, but these just look wrong somehow, perhaps the font and size of font... Not sending me the DN in CCA request but producing it for evidence I would argue could be a tactic used by them... - Page 11 with ticks - there is no reference to IP addresses - Home addresses are correct for dates in documents   Just looking up example Defendant WS's while awaiting your thoughts on this

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all I issued a SAR to LLoydsTSB they replied asking for account numbers and returned my £10 cheque .

So I sent a letter to my branch bank after calling them via telephone asking them for the account numbers which they said they would supply

I received a letter today saying I have no PPI on the account information sent to them ??? What account info? They say the matter is closed ?? What nonsense, anyone else had this?

 

Are they allowed to keep information from me because I don't have the account numbers? I need to get up in the loft ??

 

I am going to write them one more letter then it's off to the Information Commissioners Office me thinks?

 

Anyone had similar??

 

Any advice from you lovely peeps??

They should not need account numbers.

 

If your SAR was for everything they hold on you then they should be able to find data from your name and address.

 

Re-submit the SAR and the payment and tell them that they are required to respond positively and failure to do so will result in a complaint to he ICO and they you will also seek compliance through the courts.

Why not pop in to your local LTSB and ask for a printout of your accounts history. You may need some ID although any account number should suffice, I did, showed FIVE LOANS with PPI on printout. Four won so far, one to go. However, that is just the start of the battle. I was directed to Black Horse and all over the show, still awaiting info on two loans from SAR. Email your concerns to the CEO Mr Osario it may help.

 

I was requested to SAR Lloyds Insurance Services for info regarding PPI payments and then recieved limited info on three accounts. My SAR from LTSB showed loans with no PPI details however it did show that the loans were refinnanced into each other in a note below the figures. Best of luck.

There is a failed SAR template in the CAG library which you could adapt.

 

Technically this is not a failed SAR but the letter can be used as a layout and includes some of the things you want to mention....you will need to amend it to reflect the points you want to make though.

All data, including data held on a microfiche must be provided within a reasonable timescale, a maximum of 40 days.

In light of all the recent publicity regards the reclaiming of bank charges, some Banks appear to now only be providing a breakdown of charges in response to all and any Data requests. For the avoidance of doubt I do actually require all information held by yourselves.

It seems a lot of banks are also wrongly interpreting the Data Protection Act (DPA) 1998 as a requirement to only disclose six years worth of personal data, and this is also wholly wrong. The DPA clearly states that all information held must be disclosed and it has no correlation to the Limitation act 1980 at all. If you no longer hold data beyond 6 years however, I would like a signed declaration from your data controller and a copy of all documents pertaining to its proper disposal.

Whilst not exhaustive and for the avoidance of doubt I shall list what I require:

* Full copies of all contracts that exist between myself and your organisation; including copies of any documents you hold in support of same.

* Copies of all statements relating to the above accounts.

* Copies of all correspondence, including all letters, faxes, emails and memos sent and received between ourselves, and any other third party in relation to any of the above accounts.

* Copies of any telephone recordings and/or transcripts of these recordings as well as any logs or journals that relate to them.

* Copies of all documents which include any of my personal information including copies of any contracts or invoices, emails or computer records containing my personal information, or any records which pertain to this information.

* Full details and copies of any documents upon which you relied when you have provided my personal or financial information to any individual, organisation or third party.

* Full copies or transcripts of any computer logs or database records kept in relation to myself or in relation to my financial or personal information.

*Details of all systems you currently have in place to ensure my personal or financial information is kept securely, including details of those officers who currently have control of same, and at the time it was held or provided to a third party.

* Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, reason for deletion, certificates or references confirming details of destruction. Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data.

I enclose the statutory maximum fee of £10. So your initial SAR was sent to the PPI department. While they should have sent it on to the relevant section, maybe they did not do so.

 

I always suggest SAR requests are sent be recorded delivery to the Registered Office....that way they have no excuse. When you send it again (as described in a previous post) send it to the Registered Office.

 

The last letter you have posted above seems to suggests that they have interpreted your request for information as a complaint for PPI mis-selling, which of course it wasn't.

 

I would write back to them pointing out their error and tell them that they cannot make a decision on a complaint that has not yet been lodged. Accordingly the time limit for referring to fos, should it become necessary, has not started yet.

 

Ask them to put in writing on what basis they assume that a request for information is a mis-selling complaint.

 

In respect of old data, as has been said, the banks try to hide behind this six year business but we know they do hold data going back further. When threatened with court action to force compliance, data mysteriously becomes available. The exception to this is where an account has been closed for more than six years and in these cases the data may well have been destroyed.

Hi

 

My only proof of PPI was on printout from bank... if you can get that it is a start. They have coughed on four of five so far. With the evidenve of PPI on their printout it is dificult for them to ignore. You have nothing to lose popping into a branch for this vital piece of evidence. The manager in my local branch did appear a little flustered when he handed mine over as it also contained dates of start / finnish and pointed to refinnanced agreements with dates.
