      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

I was waiting about 2 weeks from sending the SAR to receiving my statements last Tuesday. Its a weird feeling seeing all the charges on the statements - I was getting happier every time I found one, which makes a change to my inital response when they were taking the money off me!

I hand delivered my SAR and one week later I thought sod it I'm not waiting so I e-mailed customer service and complained that I hadnt even had an acknowlegement. I got a reply from lady who said she'd sort it for me. Three days later my statements were here!! I think its luck of the draw who you speak to. Some people are more helpful than others.:rolleyes:

Ok, Just rang the halifax to chase up statements. Spoke to a nice chap called Ian, and he says that i should of received them by now. I told him when they received the letter and the name of the person who signed for it and he has told me that he will send them out first class today! He did ask me if it was for statements or charges. I told him it was for statements. Is this correct? I also told him that in the original request made on the 17th I enclosed a £10 postal order.

 

Suppose I just have to wait again now! Or knowing my luck the postman will turn up in a minute with the statements!!!

Just received statements this morning. 2 large envelopes full!!! I have 135 pages to trawl through now but its worth it!

 

Looks like Ian did his job properly.

 

Off to highlight all "charges as notified". Then I will put it all on spreadsheet and get prelim letter ready to send off. Cant wait!

Ok I have gone through all my statements and highlighted charges. It adds up to just under £2000! Have done my spreadsheet and printed prelim letter and a copy of spreadsheet. Just off to the post office to send it recorded delivery!

Hi, I just rang the 0845 203040 number and told them when i sent SAR and who signed for it and then Ian, the guy I spoke to, told me he would send them out first thing. Hope you get yours soon.:)

Hi All,

Just a quick query. Did a phone banking check on account this morning and we seem to have a large amount of money in the account? Been into our local branch this morning and asked them what this was. They have told me they have increased our overdraft to £1500. We have not asked them to do this so not sure what is going on. Can they do this? I thought you had to agree the overdraft?

Had a letter from the halifax today. I got excited thinking it was a reply to my prelim letter. Sadly not, it was a letter saying "Dear Mr and Mrs southey, Overdraft application. Yours sincerely, Peter Jackson Managing director" Still have no idea why they have increased our overdraft as this was not requested? In the letter it says nothing only Overdraft application. Really confused!

I think you need to need to write to the bank ASAP. If you and your other half are certain that you didn't make the application for the overdraft to need to point out that they may have made a mistake.

 

In the meantime, keep the letter. Should you ever go to Court then it's a perfect example of professional incompetence.

Hi All,

I am getting ready to send my LBA on Saturday! Received what seems to be the standard letter from them saying "Blah blah will pass on to customer relations manager. Sorry you are not happy. 4 weeks..." There 14 days are up on Saturday so sticking with my timetable. With regards to our overdraft that mysteriously grew! :eek: then we have decided to leave it but have kept all correspondance. I have marked all my dates on my calendar so I will be needing to fill out my N1 form around the first week in December.:)

Hello,

Received today an offer of £450. Have got my LBA all ready to send and now i will need to sort out my acceptance in partial payment letter aswell. Will be sending them both on Monday along with the acceptance form NOT SIGNED!!! Also in the post today was yet another load of statements! This is the third lot we have now received. Anyway will keep you informed as to my progress.

Sent off my LBA yesterday including a paragraph accepting their offer in partial payment. Sent back the acceptance form with a big black cross through it. I sent it special delivery so I know they will receive it today by 1pm. So now I am waiting......14 days time we file our N1. Quite exciting!!!!

Received a letter from the bank on Satursay stating that I did not want to accept the £450 gesture of goodwill, and it also goes onto say that they will not refund the bank charges. I understand from other threads that I have read that this is quite a standard letter. What I would like to know is can I now file my N1 as although they have until the weekend to pay they have responded so should I take that as there final response and just file now. I am sure I have read this on other threads but cannot seem to find it. Apologies, and thanks in advance for any help.
