  3. Hi, You are on the same timescale as me. mine was issued on the 7th and deemed served on the 9th. also they have until the 28th to respond. As i have just mentioned on my thread I have spoken to rachel hincliffe this morning on the phone at the Halifax legal dept. I just wanted to check that they had received my court papers. It turns out they have and are going to file and acknowledgement of service so now it is just waiting. The notice of Issue is your copy and a form to use if you have to file a judgement against them. Good luck with your claim. I will keep an eye on your thread to see what happens.
  4. Hi Lucy, Firstly I would ring Rachel hinchliffe NOT Jamie McGill as he seems to be a little bit slow! All I said on the phone was had they received my court papers yet and asked them if they realised that the court had not taken into account the christmas day and boxing day holiday. The halifax have until the 28th to respond to court which is fine, all I was querying was if they had now received them and the timescale to include the holidays. I explained to Rachel Hinchliffe that I would file for a judgement if I had not heard anything by 28th. I think probably the best thing to do is ring Rachel and speak to her. Either way they still have until the 30th so there is still time for them to pay or defend. Have you asked your local court if they have received anything from them yet?   5. Hello, Just a quick update. Rang Rachel Hinchliffe this morning to find out whether they had received my court papers. She has just rung back to say they have received them and they will be filing an Acknowledgement of service and that one of her colleagues will be sending a letter to me shortly. So they will either pay up or leave it for the extra 28 days and then defend. Is this correct? At least I now know they have my court papers though. Waiting, waiting, waiting........

  7. Hi all, Was looking through my court form yesterday and realised that the 14 days that the court have allowed the Halifax is 14 WORKING days and these include Xmas day and boxing day. They have not included these as holiday dates. I decided to ring Halifax legal department and spoke to Jamie Mcgill?. He sounded really stressed and told me they had not received my court forms yet but to ring him back on Friday and he would check then. The thing is I wanted to remind him that they only have until the 28th to reply to the court and these included Xmas etc.. and he said that they have so many claims going through at the moment that they are snowed under.!!! I did remind him that if the court had nothing back by 28th then I could claim a judgement against them but after reading lots of threads this seems to drag the process out longer. So I will keep gently nudging the legal department to avoid the judgement route.
  8. Had my form back from the court. They have deemed the order served on 9th December and the Halifax have until the 28th to respond. Just a waiting game now I suppose to see what they do next. Will keep you informed.
  9. Just been to my local court and handed in my N1 forms and £120.00. Very helpful at the court. Checked all my forms and told me the procedure. The lady who helped me said they have had a lot of these just recently. She was very interested in it. She even wished me luck!! Anyway all I can do now is wait....
  10. Thankyou hagenuk. I have just printed out three copies of my spreadsheet. Will now sit down and fill out N1 forms!
  11. Can anybody please advise on the N1 Claim form. I have copied the particulars of claim from the template library but I do not know what to put in the "brief details of claim". Also when taking my claim form to the court I know I need three copies and three copies of my spreadsheet but do I need to copy all of my statements aswell? I really need to get this done today as I am taking it to court tomorrow. Any help much appreciated. Thanks Vicki:)
  12. Hi All, Just been to my local court and collected the N1 claim pack. Just a couple of questions, Please can somebody tell me what I write in "Brief details of claim" and do I need to send in copies of my statements aswell as copies of my spreadsheet? I have copied the particulars of claim from the template changing what i need to. Any help would be much appreciated as I really want to get this bit correct!! Thanks Vicki:)
  13. Sorry in advance for being an idiot!!!:grin: but when I change the daily rate of interest in my spreadsheet it does not alter the TOTAL amount of interest. aaahhhh!!! have not used my brain like this for a long time!!!
  14. Ok. Have just gone back to spreadsheets and changed my daily rate of interest to 0.55 (2489.00x0.00022). My spreadsheet is as follows: Claim date: 30 Nov 2006 Interest rate: 8% Total claim: 3179.94 Daily rate of interest: 0.55 This makes the interest total £690.94. Does this seem correct??? Think I have brain meltdown!!!:grin: :grin:
  15. Thanks mawrey! Just been trying again to work my way through it. I have entered all my charges. The total of JUST my charges is £2489.00 so do I multiply that by 0.00022 to find my daily rate of interest??? If so do i then enter that into the spreadsheet. I am using one out of the template library. Have just filled it in using 0.22 in the daily rate of interest. Any help would be much appreciated. I am at the court claim stage so am feeling slightly nervous and want to get this right!!! I am having a real dizzy airhead day today!!!!:grin:
  16. Please can somebody help me and give me some advice on how to use these spreadsheets. I am trying to make a spreadsheet calculating the 8% interest ready for filing my N1. Have been sat at my PC for ages trying to work it out. I am using the Simple version on Google with the statutory interest. Where do I put the 0.00022 and how do I calculate this. Really confused!!! Please anyone???
  17. Received a letter from the bank on Satursay stating that I did not want to accept the £450 gesture of goodwill, and it also goes onto say that they will not refund the bank charges. I understand from other threads that I have read that this is quite a standard letter. What I would like to know is can I now file my N1 as although they have until the weekend to pay they have responded so should I take that as there final response and just file now. I am sure I have read this on other threads but cannot seem to find it. Apologies, and thanks in advance for any help.
  18. Sent off my LBA yesterday including a paragraph accepting their offer in partial payment. Sent back the acceptance form with a big black cross through it. I sent it special delivery so I know they will receive it today by 1pm. So now I am waiting......14 days time we file our N1. Quite exciting!!!!
  19. Hello, Received today an offer of £450. Have got my LBA all ready to send and now i will need to sort out my acceptance in partial payment letter aswell. Will be sending them both on Monday along with the acceptance form NOT SIGNED!!! Also in the post today was yet another load of statements! This is the third lot we have now received. Anyway will keep you informed as to my progress. Cheers everyone. I now feel like I am on the way!! Vic.
  20. Hi All, I am getting ready to send my LBA on Saturday! Received what seems to be the standard letter from them saying "Blah blah will pass on to customer relations manager. Sorry you are not happy. 4 weeks..." There 14 days are up on Saturday so sticking with my timetable. With regards to our overdraft that mysteriously grew! then we have decided to leave it but have kept all correspondance. I have marked all my dates on my calendar so I will be needing to fill out my N1 form around the first week in December.
  21. Had a letter from the halifax today. I got excited thinking it was a reply to my prelim letter. Sadly not, it was a letter saying "Dear Mr and Mrs southey, Overdraft application. Yours sincerely, Peter Jackson Managing director" Still have no idea why they have increased our overdraft as this was not requested? In the letter it says nothing only Overdraft application. Really confused!
  22. :confused: Postman just been. I have 26 envelopes containing statements!!. Received my statements last week. Do they have a clue what they are doing? Anyway at least I have duplicates now I suppose!!!
  23. Hi All, Just a quick query. Did a phone banking check on account this morning and we seem to have a large amount of money in the account? Been into our local branch this morning and asked them what this was. They have told me they have increased our overdraft to £1500. We have not asked them to do this so not sure what is going on. Can they do this? I thought you had to agree the overdraft?
  24. Hi, I just rang the 0845 203040 number and told them when i sent SAR and who signed for it and then Ian, the guy I spoke to, told me he would send them out first thing. Hope you get yours soon.
