      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sorry for the late reply, I haven't been feeling to good, sore throat,temperature and a bit sucky feeling.

Yes I'm off on Saturday I can't wait will be up very early so hoping I'm feeling better by then.

 

I waited in all day for some council rep to come round on Tuesday between 9 and 12 and they never turned up!! So I left a voicemail and email to say they never came and got a phone call back asking if I can stay in again the next day!! Well they came just looked around and asked if things were ok here and left! I think they were coming to check we were living here and not somewhere else, who knows for such a pointless visit.

 

Apart from that not a lot has happened, we had a nice easter meal out and I'm so looking forward to going to Germany I can't wait to have a nice big hot bath see friends and have a drink in the pub!!

we just needed lots of candles

 

Just a warning about the candles they can end up on your lungs if you don't have good ventilation. I noticed when I blew my nose the tissue was black. A few weeks later I was finding it very painful to breathe in and out. I had a lung infection because of the candle smoke. Please be careful.

Hi everyone I'm back and it's not been easy, living in a nice warm house for days then coming back to this place is depressing. I'm really not sure what I do from here now I've been so looking forward to my trip and not had contact with the council I'm just feeling a bit lost right now...

Glad you have had a few nice days.

 

I'd give it until Monday and then call the Councillor again, and say that while you are soooo grateful for him for his initial help your son is really having a bad time, backed up by your visits to the doctor, and is there anything else he can do to help.

 

As soon as the weather improves you can stay out a bit longer in the evenings. Maybe take picnic suppers to the beach if it's not too far, and then come home when your son needs to go to bed. That has got to be better than sitting in and being depressed.

I'm really not feeling great I'm really wishing I was settled somewhere. I can't wait for work tomorrow and also to ring people at the council I'm do fed up with them as they are me I suppose.

Hi, sorry for not updating for a long time!

The reason for that is because nothing has really happened, we are still here :/

Isis get a fright today when the landlord turned up saying that my emergency accomidation was cancelled but soon cleared it up, good thing I was in otherwise I dread to think what might have happened, gave me a real fright and slapped me back into reality.

Good thing the weather has been nice, we have been out of the house most days sometimes not coming back until 7.30 8 pm.

The weird neighbours downstairs have been moved which is great news.

I was a bit down to be celebrating my sons birthday there but were out most of the time which makes life easier.

Glad the weather has been good enough for you to get out and away from the flat a lot of the time. Also glad to hear the horrible neighbours have moved on.

 

Did the local councillor who helped you get re-elected? (I think you had elections down there?) If so, call him to congratulate him and to remind him that you still need his help to put pressure on the housing people. If there is a new councillor phone and introduce yourself and ask them to take up your case.

 

You've coped so well with all of this. You just need to keep reminding the housing people that you do need a permanent home.
