    • Hi, just getting ready to print and post the WS / court bundle. Does the envelope have to be addressed to anyone in particular (e.g., head of legal), or can it just be sent to the The legal department with the usual Evri address? i.e.: The legal department, Herme5 parcelnet limited t/a Evri, Capitol House, 1 Capitol Close, Leeds Morley, LS27 0WH
    • No they are really inferring, it's in black and white. My perception is correct.  ACAS and a solicitor plus my therapist, who has had sight of the language used by the head of HR, have all come to the same conclusion as I. I can't be responsible for the Courts perception of me, that's none of my business.  Hopefully this grievance will go some way to address their behaviour. Thanks once again for your opinion...

Where exactly [carpark name and town] Harlyn Bay, Cornwall For either option, does it say which appeals body they operate under. IAS   This PCN is similar to @Kahunaburger in that it was a bank holiday weekend and car park was rammed. It was a very hot day, and we were first time parkers in this car park (not knowing the Alliance ANPR Scam in play). We entered the car park looking for our friends who were 2 mins ahead of us. As the car park was in overspill mode there were 2 other fields open and after doing a circuit gave up looking and after a few more mins trying to find a space parked up on the grass at the top of the field. N.B. There were no signs anywhere near us. We had to unload the kids, dog and beach bags etc .. and most importantly water the dog as he was so hot. Then made our way across the fields to the parking machine. As it was so busy there was a big queue, so attempted to book with justpark (which took an age getting a signal). Eventually paying for 4 hours. Upon leaving we were notified by Justpark that our time was up so proceeded to make our way back to the car, and within 6min had left the car park. So it was 11min to make the booking on JustPark and 6min after our 4hr time was up.   On 5th May 2024 we got a Letter of Claim and decided to post up here .. As for next steps, we guess from others post on this forum we understand we need to write a "Snotty Letter" with a few key points.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

now i just wait impatiantly for my account details to arrive

not recieved 6 years statements yet. i logged on to my internet banking and viewed 4 years statements online charges total about £4000.00 can i list these charges on my first letter and update the second letter or if i cant would it mean i will have to start another claim for the first 2 years

please could someone tell me if i can claim overdraft excess fees as well. as these are not interest please help i am prepering my list of charges to send with my prim letter thanks :!:

Hi Cindytc

 

Yes you can claim the overdraft excess fee's. The overdraft interest fee's are tricky to work out (so most people don't bother). The only other thing you cannot claim for is your account running fee's.

 

If for example you write your prelim asking for your charges back, and after that you get charged another £100, you can add it at the moneyclaim stage. So I see no reason why you can't start with the 4 years, then add the last 2 at MCOL stage.

 

It would be easier to wait until you have them all though. I didn't bother with the SAR Data Protection Request. Just got the 4 years worth off LloydsTSB internet banking section. I think they go back longer than the others do.

only thing thats bothering me at the moment is that i dont remember when i oppend my account i know i wont need it till its time for court but i would like to be preperd do i have to write a letter to my branch if anyone knows please let me know

still not recieved list of charges as yet.

but got my prem letter printed off ready to post monday morning i used my online account for all my charges going back 4 years total for 4 years is £4105

but i can still add the frirst 2 years on my lba cant i :?:

also oppend a new bank account just in case :lol:

i got a letter from lloyds today i think its a standard letter saying that they recieved my letter and they are sorry that i feel i have cause to complain and they expect to finish theyre investigation in about two weeks bla bla bla and they sent me a leaflet on how to voice your concerns :eek: my lba will be sent next week :lol:

still not recieved my statements yet :x

Had The Banks Final Response Today It Said Thank You For Getting In Touch I Am Sorry You Unhappy Over Your Account Charges Bla Bla Bla They Call Them Extra Services Also They Mention The Ofts New Guidlines On Credit Card Default Charges They Said They Do Not Agree With The Oft And Theyre Charges Are Not Any Kind Of Default Penalty They Are Standard Fixed Prices For The Service They Provide Also They Are Talking This Matter Through With The Oft Is This A Standard Responce

And Is There Anything To Worry About
