      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello, for a week or so, if I click on the blue icon "Go to first new post", I have no longer been redirected to the actual new post but to the beginning of the thread.

 

This is quite annoying, for example there's an ongoing thread called "Universal Job Match", it's few pages long.

 

Can the webmaster give a look at this issue? Maybe a botched upgrade? It takes me ages now to check this forum. Thanks

Update: it doesn't work the first time, if then I click the return button and click on the blue icon, it correctly goes to the new post. Weird! Yes webby please give a look.

I just want to say that the problem still exists. Is it just me? Anybody else got the same issue?

 

I'm seriously thinking of quitting CAG. It takes me three hours to check this site now.

Hello there. I've let the site team know that you still have problems.

 

I don't really understand what you're saying about it taking 3 hours, could you expand please? How do you go about using the forum?

Some threads are very long. If I have to view all threads from the start it literally takes a few hours for me to read the forum. It used to work well. There must be a problem at your end.

I'm not really the one you want advising you on technical matters and I have referred this to our Webmaster again. :)

 

Are you able to navigate to the end of a thread? I use function + the right arrow, but it used to be something else on my last PC, ctrl + end I think? Then you can scroll up to the most recent post.

I dont think you can specifically say this as we have not had any other complaints about this !

 

So you mean the problem is at my end? And it did work up until a few weeks ago, why doesn't it work now? Nothing has changed at my end and I have checked it from different locations.

Can you make the webmaster aware of this please. The software you're running is called VBulletin. It is possible you have a customised version.

 

I have looked on Google for this string "vbulletin go first new post doesn't work":

And I got a lot of results. Clicking on some of them it looks like the problem is not browser related. Technically speaking the problem is "it loses the #anchor."

I am not saying that at all - what I said was - you simply cant say that it is definitely CAG's fault. There have been no other complaints about this issue and I am sure other members would be very quick to point out if there were.

Would you be kind to forward this to the webmaster? I've checked with other forums that have similar software (Vbullettin). There's a missing bit in the url of the "Go to first new post".

 

For example:

It should be instead:

That missing bit after the hash # causes the problem.

Just a little follow up to this thread. The issue is still there when using a PC running either Windows or Linux (tested on all major browser.

 

However when I access the site from my Android mobile, the site behaves correctly, that is "Go to first new post" behaves as it should.

 

Anybody with the same issue? I can't believe it's only me.
