    • Thank-you @BankFodder, your statement is a correct understanding of my position and I agree, it is actually really what I was looking for in starting this thread, as I too believed that the maximum I could claim for is that which I sold it for, even though this was substantially below market value at the time. And so, this sold value is what I shall be claiming for + the other expenses. @dx100uk I get your point, but this is just not what I want to expose myself to. Unfortunately I was one of the unlucky ones to have my details stolen in the Peoples Energy hack, and in 2020 I discovered that those details had been used to take out car insurance, and that the insured was then involved in a collision and my details were dragged through the mud. Despite Aviva cancelling the claim and treating as though it never were, even though I have the letters from them to say that they have removed this claim from the insurance database, I still get refused insurance and credit products to this day until I send across the letter from Aviva which explains that I was a victim of fraud. So you'll forgive me for not jumping up and uploading my data to a server utility for which I have no control over its retention policy, or where the server is located globally, its legal jurisdiction, or its security protocols.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

These letters are really quite funny, eg we MAY use the court or a debt collector may visit.

 

Personally I would send the letter 10 days into this 14 day offer of the discount adding that you will give the 21 days to respond dushing closer to SB all the time.

 

they are full of shiznit.

 

so your first letter, i may amend that a little bit and send that off. give them 21 days to respond, shall i post my draft on here or fire it straight off? i'm aware that they read this forum from other posts you guys have made.

 

i will throw the book at them when this is done, they had another debt of mine and when I told them it was SB they came up with a phantom payment, i asked them for proof of it - that was 2 years ago and haven't heard from them about that since. but they are chasing this? unbelievable!

have you seen this before DX? do they generally go to court straight afterwards? i'm thinking that as I have six weeks to string out may as well make contact now as i don't want to risk anything else appearing on my credit file!

hi all

 

just to update you, I have drafted an amended version of brig's letter and intend to send this at the end of next week. I have given them 21 days to respond and say that unless they can confirm it is me they are chasing they should close the account.

 

i have also told them i am sending copies of the letter and all the other pieces of toilet roll they have sent me to the FOS and OFT, can I do this by email?

i've decided that since I've been on this forum for so long dealing with these scummy DCA's, I now need an avatar. :lol:

 

in other news, the letter has gone off to Lowlifes, I have given them 21 days to respond and we will see what they have to say in due course.

that's fair enough but surely if they are taking the letter seriously they should be ceasing any communication until the account has been resolved?

 

alternatively having read a few threads they tend to contact people by email when they don't have an address for them so maybe they are trying to follow up at my old address/via other contact details.

 

i don't want them to start court action against me at an old address is it possible this will happen without my knowledge??

i've just got home and no letter responding to my complaint. shall I write to them again about ignoring my request or wait out the 21 days I gave them?

Overleaf they detail their "complaints procedure" which involves acknowledging the complaint within 5 working days of receipt, reviewing the complaint and sending a response/update within 4 weeks, and a final resolution within 8 weeks.

 

now a few things have irked me about this letter.

 

1. The collections action has NOT stopped, seeing as they emailed one of my old email addresses yesterday (27th). Their letter was dated the 22nd, meaning they are still performing collection activity. Not good.

 

2. I have told them "the debt is not mine", but they still persist sending letters telling me "YOU OWE XXX". The whole reason for the complaint was that the debt was not proven to be mine, correct? What happened to "innocent until proven guilty"?

 

3. Finally I don't appreciate the fact they are trying to get my telephone number. I know full well they will start harassing me if I can't even trust them to stop emailing.

 

What next?

 

Shall I write to them and say letter only and take up the points I've outlined above? Or just wait for them to reply? I want to give them more food for thought, every time they contact me they enrage me more :-x
