    • Hi all,  I really need to start my own thread on this Claim with Overdales/Lowell for a Cap One debt. but have already got to this stage .. My initial question for the moment - until replies come in - is that I figure my main stance is that a purchased debt cannot be claimed, debts can only be claimed by the original issuer of the debt .. but mediation is about coming to an agreement. would I be acting in bad faith if I enter into mediation yet not seeking to come to a financial agreement? Also, I need to reject the scheduled time slot and ask for another as I'm not going to be free during those hours. The wording of the email gives the impression that I am given this one slot and if I reject it, then I am rejecting mediation - there is no mention of rescheduling, only of freeing up the slot for others .. although, I would have thought it would say so, if there were no possibility to reschedule.. Can I ask for another date without issue? I am happy to post up my defence and start a proper thread? I had a lot on at the time and had to do things right away due to the time limits, so didn't feel I had time to come here and go back and forth for info, put my defence together from reading through relevant threads, late at night. CCA request appears to have been fulfilled (I'm still to check the accuracy of the documents). The other thing, asking solicitors about the particulars of the claim, hasn't .. although I forgot to ask for proof of postage and didn't send recorded post either (whereas the CCA I did), so not sure if I can pursue that easily ..?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi i would like some help with the situation i am having with the know how investigations team

 

il explain

 

i have a laptop and support agreement with pc world/currys and recently i had an accident where i fell down the stairs

 

i contacted pc world where they said to bring it into store and they will see what can be done so i left it in there capable hands

 

on the 5th oct 12 i got a letter back saying this.

 

"we have carried out an inspection and in the opinion of our engineer the damage seen is inconsistant with the reported explanation

and/or the damage exceeds what we would expect given the circumstances.

as a result of our findings repairs are not covered by your agreement and we are returning your product to you unrepaired.

 

i wrote back with a full detailed explanation of the accident

 

on the 19th october i decided to ring the customer services and ask if there was any news on the reply to my letter

and the guy on the phone said yes that they are sending you out a letter and it has been refused again,

 

i said can you tell me why and he gave me a brief insight of what the letter said

which was that there was over £2000 of repairs already on the laptop and that there were marks on the bottom of the laptop near the fan

which looks like a tool or implement has been scratched across it so therefore no repair will be done also they said i need to check the T&C,s

 

i was really gobsmacked by this as the laptop only cost £400 and was a refurbishment and as far as the scratches go i can see them but i dont know how there got there ?

presumably by the fall

 

i just wanted a bit of help on how to reply to this i am going to be asking for an engineers report and a list of the £2000 repairs???

 

ive had the laptop 3 yrs but ive been with pc world for 6 yrs

PC world promises are not worth the paper they are written on. For your next purchase, have a good shop around because when it comes to price and service PC world, currys and dixons are rubbish. I personally think online retailers like amazon outdo them for service, value etc everytime.

no accidents at all, my previous laptop just died so they sent me a letter explaining that they couldnt repair it and sent some vouchers for another one that was 3yrs ago

ive not contacted anyone else yet im just awaiting the 2nd letter then i can move on from there.

paul still wont be allowed to deal im afraid

 

if its already been refused then its garry perriments team, which afaik appears to be insiders only and they wont let other people deal

ceo might be a good idea after all as much as gary hates to admit it hes an employee and can probably be leaned on

 

if theres no other accidental damage claims then i would point that out, they rely alot on previous history with these decisions

thats what i thought i just got another letter through today and it reads

 

with reference to your letter regarding your recent claim for damage to the ablove product, this claim has been referred to us due to the excessive nature of the damage.

we have consulted with a member of our technical team and in their opinion the damage sustained to the product is too excessive and therefore is not consistant with the mishap you have described.

in particular the main damage to the laptop is the damage to the fan grill and bottom grill. both have been broken through, but the damage to the fan grill looks like something sharp has been dragged over it to cause the damage.

our records also show that you have had over n++2000 of previous claims with the majority being for damage.

please refer to the terms and conditions on your agreement, under the section headed what is not included where it states the cost of repairing or replacing a product which fails because anyone neglects abuses or misuses the product.

due to the above we have decided to uphold our decision and reject your claim

we are sorry for the disappointment that this will no doubt cause, but trust this now clarifies the reason for our decision

hi guys i sent a long email to the address that paul showed me and i got a call from a rep so i explained everything to him and it looks like they were looking at my previous laptop repairs where the keys kept falling off and usb ports where faulty and everytime it was sent back it was worse in fact one time the laptop was sent back to me in a cardboard box!! no padding at all even the poor delivery guy was gobsmacked and i also received someone elses laptop ! so they had a bit of chasing round trying to find my laptop.

so after the phonecall he said he would send it back for a revise descision and today i got a call telling me they sent it to an independant company so i hope to hear some news soon

as predicted i got a call from hm investigations which he was really helpful,

 

i explained everything to him and also asked where they had got the number £2000 worth of claims from

 

he looked and they have based their decision on my previous laptop but when he looked majority was faulty parts,

 

i waited after our chat and got a letter through today saying refused again

 

i got a call from customer services asking how i got on

 

i explained and he said that the previous laptop claim has been put across as damages

 

i got all my paper work from the old laptop and the 3 damages where a left arrow key had come off, the 2nd one was a ps2 port had come out of the L/T ,

and a usb port was damaged well it was bent so had to be repaired

 

the other 5 repairs where written down as faulty display, dvd faulty, hdd, usb not connecting,

they made my previos claim look like it was all damage,

even the customer service guy said it needs to be overturned as its not all your fault

 

i mean if something on your laptop either stops working or is faulty they say you call them and they will fix it and thats all i did,

 

not to mention the numerous times the laptop came back worse

 

i will not be happy till this is properly resolved,

the customer service guy has emailed them again

but he did say after its been turned down 2nd time he cant help no more

but to wait to see what they say to the email,

 

after that it will be either the head manager of the claims dept then trading standards.

hi guys

just wanted to say happy new year xxx plus

 

I got my case overturned with help from paul from pc world/currys ,

 

first thing is you must explain everything when telling them your side of the accident.

 

although, I have been warned that any future claims will not be looked at

 

this is because of my first ever laptop being so crap and breaking down every 5 minuets

 

when it broke I called them up and under the repair agreement contract they collected it

and assessed whether it was accident or damage they would repair it either way

but if they think deliberate damage this will get marked down as damage

then if you do need to make a claim in the future t

hey will look at the past history and base it on that.

 

this is what has happened to me

 

it wasn't my recent laptop that caused the problem

it was the amount they had paid out on the first laptop for repairs that caused the problem

 

it hasn't helped this claim at all,

 

be very careful with your laptop because what you see as an accident they the claims/repair people may not see as an accident.

 

even though I got a new laptop I am grateful but feel very anxious about if it breaks down from now on.
