    • Banks have different limits above which they require Probate. So it may be Probate is not needed, although as he died with no Will that could complicate things. Is all the £28k with Virgin Money? Your wife should contact all banks who hold his money with the death certificate and ask them what they need to release the funds to her. Most banks have a central "bereavement department". Check their websites. Use that department rather than general call centre or bank branch if they have one. Nearly every bank website has a section on "what to do when a customer dies" so have a search for that. Your wife may also have to provide evidence that she is his daughter. When his wife died it sounds like they had a joint bank account so that's why her money just went across to him. But as it isn't a joint account now transfer to your wife won't be quite that simple.

    • She's an only child and he as a brother and sister. He has no will and we have done a check on this to find out if he had left one and nothing has come up. He has savings of around 28k His sister and brother are well off so 28k is nothing to them and aren't interested in his money. This just leaves my wife/his daughter. Would this still need to go to probate there is no estate e.g house or business to sell and the amount left in his bank is just small? When his wife died they just closed her bank account and moved her money across to his account and we just assumed that once my wife has handed in the death certificate and shown evidence of who she is the same would apply to her? We don't know yet the council have only just written to us today with a guide of what to do next.  
    • Did your FiL leave a Will and if so who is the Executor? Strictly speaking banks could refuse to take instructions until Probate is granted but In practice I would expect the bank to take instructions to cancel the DD if the Executor presents the death certificate and a certified copy of the Will

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi

Am a bit confused with the first step. I know Abbey have charged me in the region of £550 over the past six years. In the pre-lim letter ,WHAT I REQUIRE SECTION it says 'i calculate that you have taken £XXXXX plus £XXX which you have charged me in overdraft interest...'

How do you work out the £XXX which i have been charged in overdraft interest ??

If i understand the system correctly the spreadsheet you refer to enables you to calculate interest at 8% APR and is used when you are actually filing a claim against the bank. i'm only sending a preliminary letter at this stage so still confused !! (can you help any more?)

You are correct about the 8% being at the CC summons stage.

 

The overdraft interest calculation is complex, as first you have to work out what periods you were in overdraft. If you were permanently in o/d then that simplifies things.

 

What you then need to do is divide your o/d interest rate by 365, to get a daily rate - then appy it to the individual items on the spreadsheet.

Hi, this is my first time posting. Can I claim back charges even though I was over my over draft limit when the cheques were charged. I have statements going back three years and the charges run into thousands, one month I wa charged £600 (my bank is Abbey). Would it be useful to put the dates and amounts on a spreadsheet and send it with my prelimiary letter. They will of course say i should not have written the cheques as my account was overdrawn. What do i do then?

Hi to all who can help,

I have just started to look into the charges that may have arised unfairly onto my account I have seemed to have got lost in what I am doing. From my understanding you have to send a letter requsting a copy of all of the charges on your account, but where do you find the letter/copy of letter to send?

Nick vs Abbey have had non standard reply letter 27,9,06. They say the OFT is for credit cards not current accounts ?. They want to keep this at branch levelor if I wish to continue with the illegal charges side then they will refer this to head office and then maybe no money ? Can anybody advise as to next step ??

All sounds standard to me. Escalate it to head office otherwise you'll never get your money. They always say that you won't get anything, they always then pay up. They always say that the OFT does not refer to them, ignore that, they're trying to put you off.

 

Carry on with the process, stick to your timetable. What was the letter in response to? Send the next letter with a copy of that one to the head-office address. I'll find it when I have a minute, but otherwise I'm sure it will be in the main Abbey thread.

Hi

I was wondering, do you send the initial letter of repayment to Head of Customer services? And how can you tell if you've got a black mark on the credit register? I'm only claiming for £315, but it's not exactly money I can ignore, and I want to get a mortgage soon, so it's kinda crucial.

I'm pretty certain it won't be with Abbey....;-)

I haven't got a list of all my charges/trnsactions for the last 6 years yet (have sent abbey sar letter) and they have gone over the 40 days.

 

I am going to predict the charges by saying in the last year they were this so i will times that by 4.5 (years we have had the account). How do i calculate interest on this? Do you have to add an interest amount (i would be happy with just the charges money back)

 

any ideas?

Hi can anyone help me..I am ready to write my preliminary approach for repayment letter to bank. I have a business account and noticed that in the FAQ questions it stated that there was a business form, but I cant seem to find it.HELP!!:smile:

hi i sent off my letter requesting the refund of all bank charges that i have incurred but it has been longer than 14 days and i have heard nothing at all. I know the bank received the letter as i sent it recorded delivery so a signature is required.

 

what do i do now, send another letter?

Hi Jody,

I have done some reading for you and as long as the time period (14 days) or (14 working days if feeling generous) has expired then you should send the LBA.

This info took me a few mins to search so please take it with a pinch of salt, all info came from other threads. There is probably some great ammended letters to send if you can find them.

I am just sending off my prelim letter. Did all the work with my Halifax account first & they went to the wire. They did settle when they got the court papres. ]

 

the mods keep refering all back to the FAQs & this is sound advice. Take the time to read all the info & it becomes clear. I did however need some practical advice during my first claim & they were allways helpful, as wre other users. BUT.....do as they suggest & read the FAQ's take notes & understand it all.

 

I had to wait 4 months for my microfiche statements from Abbey & I hope they dont settle before I file court papers, as the interest is a nice bonus :p

Hi did what you said and sent the second letter to Abbey and they finally replied. However they said that they cannot agree to refund the charges on the accouunt, and said sorry we have been unable to reach a final agreement, but if we remain unhappy we could refer our complaint to the finanical ombudsman service and that they genuinely believe that their decision is fair and are unable to respond to any further corresponsdance.

 

So should I now take this to the next step and threaten court proceedings?
