    • @jk2054 retailer said they'd speak to dpd on Tuesday. I don't want to screw the retailer because they were doing me a favour by fixing it for free so I hope dpd will refund them so they don't lose out.   Will keep you guys posted. 
    • Well, we live on the same road so it should be the same postcode. When I spoke to dpd and asked why were my neighbours' address not on the list and she said maybe they're not of the same postcode and I checked and they definitely were. Not to mention, delivery instructions are supposed to override actual customer's address which is why they asked for instructions I thought.
    • again a quick google search states Appeal a DVLA fine - GOV.UK (www.gov.uk) i would not be appealing mind. it's only a summary charge which they rarely do court on and pass out the powerless DCA's whom are not bailiffs they have 6mts. see where they go. as you've sorn'd it will probably be nulled. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well, have written my letter asking for my transactions and charges. Will be sending it tomorrow, or should I take it to the bank on monday? The thought of court scares me plus my husband knows nothing of this. He honestly thinks we have never had any charges, fool.Will let you all know how it goes.

Dont be scared, It all may look a bit scarey, but its not, As for your husband not knowing about the charges, I was in the same boat, I made a joke about it, & he was great when I told him, If you want to chat any time, Please feel free to PM(private message) me, & if anyone else is in the same boat, pm me, My claims are all finished now, so Im going to help other where I can. Hi Hayleytin,

I also hand delivered my prelim letter to Halifax, the casher went off to fetch the manager at which point my legs shook :shock: (but in my head I was thinking, well I'm doing nothing wrong, only asking for what is mine) don't let them make you feel uncomfortable, their no better than you. The more you read on this site the better you will feel about each step.

There's a lot of us in the same boat, so don't think your the only one

Was on another site today, chatting to a friend. She got advice from this site and got her statements and added up her charges. However, she then sent a LBA straight away and got her charges back within 2 weeks. Is it worth doing this once I have my statements or should I do it properly as it says here? WOuld be gratefull for some advice.

I received my acknowledgement letter from the Halifax on day 40. They then sent the statements 2 days later.

 

Be prepared for 6 years worth of statements to come along, each document in a separate envelope. The Halifax are so lame they'll try anything to prolong the experience. Your postie won't mind, he'll just wonder when he's going to come to the last of them. I got 36 individual envelopes.

 

I'm now in the process of compiling my second letter, requesting enough money from the bank to afford to take my family to Florida next year.

 

Hope it all works.

 

Buy the hubby a gift when you get your money. Then if he hasn't noticed the tree and a half in statements you can claim you've been saving all these years.

It would be nicer if it were sorted by Xmas, true. I'm hoping the same. Just remember though that if the bank take longer then you can apply more interest in your claim. Also, if they fail to even give you the information you can report them to the information officer for a breach of the data protection act.

thats what they rely on, intimidation please don't be scared , it does not matter how large an organisation they are, they have taken your money unlawfully. If you want some thought to help keep you focused try this. I read an article in the local paper this week about a 20 year old student who had an account with the HSBC. These bankers withdrew his overdraft facility after taking the whole of his terms student loan of £1200 he was so distressed about how he was going to survive through the term that he hanged himself. go get your money back

Well, only a week after sending in my SAR, i decided to start bugginh halifax for my statements. I dont see why some peopl can get theirs in 4 days and others 40 days. To and froing e-mails with a helpfull girl called Louise, she has no assured me my statements are on the way. fingers crossed.

Help, got my staements today, all add up to £3654. How awful am I at paying direct debits!!!!! I cant do my spreadsheet!!!! I cant figure it out and my printer is cr**. Can i just write the list out and send it?

Right what you can do, is this

you can do them by hand(make sure you have plenty of pens)

or this might help, do you have a friend who has a printer? you could type your details, charges etc & save on floppy disk & ask your friend to print it off for you.

If you had lived near me I would have sorted this out, for you.

Mine all came (on day 40) with an eleastic band around them in one big brown envelope (handwritten address)...

To make a claim in court is easy.

 

You have two choices.

 

Money Claim Online - http://www.moneyclaim.gov.uk

 

or

 

Visit a County Court - http://www.hmcourts-service.gov.uk/HMCSCourtFinder/

 

 

 

Money Claim Online (MCOL) is, as the name suggests, an on-line version of the County Court. It is based in Northampton. To use the MCOL service, you need to register and be satisfy the conditions for claiming (they are all listed on the site). Everything can be done from the comfort of your own PC. You can even pay with your magic plastic, but be warned that Visa Electron appears to be unacceptable, I'm not sure what the score is with Solo cards.

 

County Court claims involve form N1. This can be collected either from the Court or downloaded via this site. You fill in your N1, attach any relevant documents and hand in with the correct fee.

 

 

 

Whichever system you choose, don't panic, there is plenty of help available from the 65000+ users registered with CAG.
