      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi I have decided to reclaim charges from my old more than credit card, I had a card and got into trouble with it reguarding repayments, the account got took over with various debt collection agencys, Last year I paid a considerable sum to a debt collection agency and they are still hounding me for the rest of the balance, but it keeps going up as they keep adding their charges, now I feel that what I have paid is more than enough for what I owe, now I have sent Lloyds TSB a data protection act so I can see what charges I have incured so that I dont have to pay any more charges. does anyone think I have a case?

Yes, you definately have a case - especially if the amount that the debt collection agency is chasing you for is made up of these unlawful charges.

 

When you send the preliminary letter off to Lloyds, write to the debt collectors telling them in no uncertain terms to Foxtrot Oscar, as the account is under dispute. They have no legal right then to continue their pursual of the money until the dispute is resolved. They also will not be able to add any details of this to your credit report.

 

Has the bank put a default on your credit file? If so, you may be able to get it removed if you can prove that the reason it is there is because of the unlawful charges against you. You can check your credit report for free at Experian Credit Expert, check credit rating, credit reports & file alerts - with Experian CreditExpert.co.uk- 30 day trial.

And yes they have put a defult on my credit file, which I will also claim for!

It is probably for the best. If you write to them and they still keep contacting you, you can sue them for harassment.

Hi everybody, I have not heard anything from lloyds, should I contact them to find out why they havnt sent me my list of charges?

Also I am having problems from a debt collection agency called 'Allied International Credit' They phoned me up and said that they dont care that I'm in dispute with Lloyds because I owe them (allied int) the money as lloyds have passed the debt onto them, they said that they could reduce the debt slightly, but i kept saying to them that i was in dispute and all she kept saying was that she wanted the name of a solicitor or she would pursue the debt, and she also said that they will phone me up everyday aswell! I then told her that as I didnt want the company to ring me up anymore, they would be breaking the law and I will see them prosicuted for hassling me, to which she laughed and said what law would she be breaking! so I got their address and will write to them about the harrasment, but what law do I quote in this letter?

http://www.consumeractiongroup.co.uk/forum/bank-templates-library/37006-harassment-telephone-response-letter.html this is the letter you send for telephone harassment, just hang up whenerver they call do not be drawn into a slanging match or conversation down the phone it will only stress you out even more.

 

As regards Lloyds not sending you your list of charges i am assuming you sent your request on the 5th October? If so they have 40 days to comply, so quite a bit of time yet i am afraid although you could in the meantime try and chase them and ask them for them asap as it is urgent, although chances are they will reply with "everybody's request is urgent" So sit tight, get that letter off to the DCA and Write a letter to Lloyds also along the same lines asking them to tell their DCA that the account is in dispute.... any questions just ask! :)

Hi olliebear, I sent off the dpa letter on the 29th september and I do realise that they have 40 days but i havnt received anything from them at all and appart from the fact I sent the letter recorded delivery, I wouldnt know if it was received!!

If you sent it recorded delivery you can check on royal mail when they received it, the tracking number is on the receipt, although to be honest it doesnt matter if it was sent rec or normal post, a judge will deem a letter served two days after posting, so count your 40 days from 31st. Calendar days not working,

Right I phoned up llyods and they said that they havnt received my letter to which i said that i sent it recorded delivery and was signed for on the 2nd october and that i have a copy of who signed for it, so he said that he was going to chase it up and let me know tomorrow!

Ok I got a phone call from Lloyds and they said the because my account has been passed over to allied int credit, that the post room manager has passed my data protection act letter to them! so I told the guy on the phone what my letter was about, and he said sorry and could i send in another letter and £10 and he would personally make sure I would get my statements sent through, strange really, he is a really polite and nice guy! lol
