Yes, if you fail an ESA medical you can appeal the decision. Provided you continue to send sicknotes, you will be paid at the assessment rate until the appeal is decided.

that wasent my question let me try again: a person goes to the medical but fails can the person put in a fresh claim for ESA ? or will you be forced down the medical route if you do ?

Well, you can do that, I suppose, though I'm not sure why you'd want to. But yes, if you fail the medical you can put in a fresh claim for ESA. However, you won't actually receive any money until you've passed a medical. There are exceptions - if you claim for a new incapacity, or if your existing condition has worsened.

 

These rules apply for 6 months from the date you failed the original medical.
