    • I know dx, a lot of it was my partner and how she felt about it. I also appear to be addicted to my credit file being clean. I still worry for my partner she has too much on as it is, but I am ensuring I manage both of ours so She can forget about. i guess in terms of time I bet masses are defaulting with this economy as it is right now and high interest rates might be the only thing going for me right now.     • Please see below for an extract from the letter more about my case. You have been convicted of two matters of failing to give driver details linked to two speeding offences and been disqualified in your absence. You confirmed that you did not receive the court documentation and the first you knew about the cases was on 3/6/24. As you can make a statutory declaration it is possible that we will be able to persuade the police to accept pleas to either or both of the speeding offences as they were committed within a very short space of time and withdraw the two fail to give driver details offences as normally if you plead to one or other of the speeding or fail to give driver details the prosecution will withdraw the other related offence. If successful you would not face a totting ban. In respect of the speeding offences, it could be argued they were committed on one occasion due to the proximity of the time and location and we may be able to persuade the prosecution to drop one of the speeding offences. You are technically guilty of all the offences because you accept it was you driving when the speeding offences were committed and that you did not update your change of address with the leasing company when it was your responsibility. If the prosecution will not withdraw the two failures to give driver details offences, you will face a totting ban but will be able to put forward an exceptional hardship argument. This  may or may not go ahead at the court hearing date, so we need to prepare for all eventualities. As a safeguard we have lodged the appeal and applied to suspend your ban pending appeal due to the time limit for being able to automatically appeal without getting leave of the Judge. The court have dealt with the matter very quickly and have actually listed your matter for an application to suspend the disqualification pending appeal on the above-mentioned date. We could actually use this date to make the statutory declaration in court having explained the situation to the magistrates and then see if the prosecution will agree to accept pleas to one or both of the speeding offences as a way of resolving the matter without the need for you to put forward an exceptional hardship argument. It is possible the case would need to be adjourned so that we can make those representations, or the court may want to go ahead and hear the exceptional hardship argument. The outcome of your case is always at the discretion of the Court.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

Any advice or similar experiences please!

 

When I was made redundant I was able to claim my PPI as a carer.

 

I did not have to sign on.

 

AXA paid off the outstanding balance in a lump sum and advised me I would not be able to claim again for twelve months.

 

I used the card since and have kept up payments to date including PPI.

 

I have now been diagnosed with cancer & they are refusing to meet claim as I never returned to work in between claims?? (apart from 10 days temp)

 

I was never told of any such condition & feel this is out of order as they have been taking PPI payments from me!

i would suggest you look at reclaiming the ppi as a whole

 

you'll get more back than what they will ever payout anyway

 

if you have all your statements

fill out the attached spreadsheet

 

 

if not sar them.

Thanks for advice. Not sure if I could claim PPI back as already made a claim? Madness is why should Ii have to be in receipt of benefits in order to prove anything. What if I did not receive benefits due to other income.

I was made redundant and did not need to sign on as I am a carer, so they chose to pay out on my PPIunder carer criteria, now I amactually unable to return to work due to cancer I do not see why ihad to sign off then sign on again to qualify??? I am waiting on decision in writing...then they will hear from me!! lol:madgrin:

Hi

 

You can claim back mis-sold PPI even if a claim has been paid out under the policy. You just deduct what you have received from the total amount you are due.

Surely the OP is better off if AXA pay off the debt rather than getting a PPI refund on the payments as the refund on the payments probably will not cover the debt?

1 AXA are refusing the claim and appear not to be paying out

 

2 Until the OP prepares some figures its impossible to say

Hi,

Just got letter from AXA advising that they are refusing my claim due to following exclusion:

 

Once you have received an amount equivelant to 12 monthly paymens for any one unemployment claim, you must return to work for at least

* Three consecutive months before you can claim again for unemployment.

* One month before you are able to claim under section F Accident and Sickness Cover

You have already received a maximum claim and have not returned to work We are therefor unable to consider this claim any further on this occassion.

 

I find this really bazzar. I sent them proof that I was my husbands carer and I was not signing on for that reason. My PPI was paid out under carer leave NOT unemployment. I see this claim as different circumstances.They took the PPI from me, did not advise me I could not claim again for any reason. Only told me I could not claim again for 12 months. So I guess in a way it was not fit for purpose (as in mis sold) Why would I pay PPI if I have to be working to claim on it - or am I being too logical? Just trying to compose a letter, any tips would be much appreciated.

I have no intention of getting stressed about it. Having cancer is a bigger deal!! I could just stop paying them anything, the worst they can do is put a default on my credit file, our home is up for sale, negative equity, only in hubbys name, no assets, no bailifs in Scotland, debt is only £900, cost them more to try to take action!!

Well, Capital one have finally replied & are sticking to their guns. Refuse to honour claim now I am no longer a care but am now sick -Also stating that as I have previously been paid out more than I have paid in premiums they will not refund payments made sinceI became a carer??? My point is I was told I could not claim again for twelve months, there was nomention of having to return to work. Being a carer is a taxable benefit, so there's a wee annomoly her I think?

Och well, I'll just keep harassing them for the hell of it :razz:

I was told could not claim again for another 12 months, which has well passed!

All they have sent me now is a copy of my Credit agreement No T&Cs for PPI. I read that they have admitted to not sending these to customers a few years ago, befor I opened account...but as we know history has a habit of repeating itself!!!

Just wondering how to challenge them on this basis. i.e You did not send me T&Cs so in effect mis sold??

Any tips folks?
