Can someone who claims to be unfit to work (apparently because of chronic back pain) be receiving JSA instead of any incapacity benefit? Surely Jobcentre would not sign them up as a jobseeker?

Wondering if JC had got it wrong or if the so called inability to work in questionable.

To claim JSA a person must declare that they are available for work, fit for work and actively seeking work. So no, a person who is not fit for work should not be claiming JSA.

 

Without more information, we can't really say much about any specific person's case.

Depends if the person is actually unfit to work, or just claims to be.

 

Indeed. That's what I was getting at with the last sentence of my post. Of course it's possible that a person can misrepresent themselves to the DWP.
