They want you to withdraw because their SD would be set aside on the grounds of the triable issue raised in your statement, i.e. Director's Guarantee or Personal Guarentee, requires to be decided upon at trial.

hi there can anyone help I am in this situation now with two merchants only differance is i sold my company with the debt and assets not relizing that i had signed this type of PG the new owner has noway to pay and they dont seem to want to be able to do a relistic pay plan. Can anyone help is this worth a fight?

On the edge, how did you get on with this? We are in the same boat now (I have just posted a new thread entitled 'Builders Merchants Personal Guarantee Problem'. We had our SD set aside. They then started a claim through the county court which we are defending based on denying personal liability for the debt. I wonder if anyone has got to the point of actually challenging this in court yet... It would be good to hear what happened in your case please. Thank you.
