      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Everyone,

 

I am about to have a go at claiming back ppi on my Egg card that I have had since Jan 2000, which I applied for on the internet.

 

As this is an internet account, I never really bother checking & only recently realised that I was paying PPI. I therefore cancelled the PPI in July this year.

 

I would never of asked for PPi & have never taken up the offer on any other cards I have......I don't even remember seeing the option when I applied for this on line!

 

I think I have the general idea of the process involved & will be sending off my SAR today.

 

My worry is that because Barclay-card have taken over Egg cards, do i send sar to Barclay-card or to Egg main headquarters/office in Derby?

 

 

Also, a lot of the SAR templates I have seen here are from many years ago, has anything changed since, I that I should know about?

 

Are Egg playing ball regarding claiming back ppi charges?

 

Any advice, words of wisdom & success stories are more than welcome.

 

This is the first time I have ever done something like this & find it all a little bit daunting!

Welcome to the site.

In answer to your questions;

 

1.It is Egg who as original creditor are responsible for refunding your PPI.

 

2.You can tweak any existing SAR to cover your request

 

3.The contact details are in the Egg forum.

 

It is likely they will say that there is no liability pre 6 years due to the Limitation Act,but you will find more about this by reading other threads in the Egg forums.

Hi Guys,

 

I sent a SAR to Egg regarding ppi I had on my CC card since January 2000, cancelled in July 2011.

 

They have sent me loads of print outs of my account details & from what I can make out, printout/transcripts from any activity on my account!

 

At the beginning of the printout, it lists my application & against insurance indicator, it states N.

It then says Y= payment protection insurance cover & N= no cover.

 

Later in the printout it says that Insurance cancellation I (individual insurance) was cancelled in July 2011.

 

So, from what I can make out, I had the PPI for over 10 years but they didn't realise I had it until I cancelled!!

 

How do I work out how much insurance was deducted every month as they never sent any statements & now the Barclaycard website, only lets you go back so far to look at your statements?

 

As every month, the ppi total deducted would have been different.

 

Can anyone help or shed some light?

 

Should I have got statements as well or have I missed something?

You should have received statements/transaction history (at least going back 6 years)

 

Although you said you haven't received statements, is there a transaction history in the papers?

HI,

 

Just checked the printouts again & they have given me a cost breakdown on only the last 12 months!!

 

On one of the breakdowns it lists "Delinquency amounts" which looks like the PPI.

 

Has anyone heard of PPI being labelled as Delinquency amount?

 

Also how am I going to work out how much I may be owed if I can't see the other months/years etc

 

Any advise would be great!!

I've never heard of it called that myself. PPI has nothing to do with delinquency....delinquency would normally refer to charges or something like that.

 

I think you ought to send hem the failed SAR letter if the statements/transaction history is missing. There is a template in the CAG library

Do you think its good news that according to the beginning of the printout, they stated I never took out the insurance, when it was always deducted from the beginning?

 

Then they confirmed that it was later cancelled!!

It could help...yes

 

There are usually a few reasons that apply to most ppi claims.

 

Egg may try and say you ticked a box on-line or you agreed to it in a phone call or some other lame excuse.

 

Cross the bridges when you come to them.

 

In readiness for your claim, pop along to the fos website and download their consumer questionnaire ready for completion. While you are there have a look at some of the case study PDFs to get an idea of what redress you could be offered.

Hi Guys,

 

Futher info recieved & more advise needed.

 

To recap:

 

Had Egg CC since 2000 & cancelled PPI last July

 

After sending SAR to Egg, I recieved loads of transcripts & data print outs but no statements.

The printouts mentioned on the first page that no insurance was taken out but futher down, they acknowledge me cancelling the PPI.

 

I sent a futher letter explaining they hadn't complied to the SAR request by not sending statements etc.

They replied asking me to send another payment to cover cost for 2nd SAR.

 

I phoned Barclaycard & moaned my head off & eventually went through to their customer complaints officer.

 

He was very helpfull & explained that they would indeed forward any statements they find.

He also said that the best way forward was to let them handle the PPi claim as they have their own department going through the rubbish from Egg!

 

He said this would be fast tracked & has since sent me another letter & an Ombudsman form to complete & return.

 

But to change matters slightly, I have recieved another page displaying screenshots from my original application.

The screenshots look like they show sections from the office side of the application & not from the customer side, if that makes sense!!

 

Sections that Egg fill in themselves, with action boxes marked "authorise" "summary data" & "product holdings" etc.

These sections are at the bottom of the screenshot & are sectioned off by a line/bar across the page (hope i am making sense)

 

One section list the credit limit & preferred limit & payment protection.

The box next to Payment protection has typed "Accident,Sickness,Unemployment and life"

 

This neither a yes or no box or drop down menu, this has been filled in.

 

As I already know i never asked for any protection, Im not sure waht this screenshot actually proves or says.

 

Also from what I can remember, my application was started online but completed over the phone.

These screenshots look like they are from the office computer as they show parts that you wouldn't see online!

 

 

Can someone please offer any advise on both parts of this (sorry its long) request.

I have FINALLY attached the screenshots as PDF files.

This was the last document posted to me from Barclays re my claim.

 

This still doesn't seem to prove anything to me as this looks like screenshots from the OFFICE side of the application!!

This was sent with a covering letter more or less saying" more info as requested"

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi Dx,

 

They originally sent only transcipts & printouts but no statements, so no showing monthly or yearly totals etc.

 

I went back to them & said they failed to comply to the sar.

They then sent these screenshots??

 

The original printouts detailed all movements with the account but no staements etc!

 

The printout did state on the first page that against my application, insurance taken was NO.

 

I havn't been back in touch since & they sent a seperate letter saying that they will be in touch.

Thanks to the help I received from you guys I made my Egg SAR request and today received a wad of documents, including all contact between myself and Egg and all statements.

It was interesting that i took out the Egg Card in 2002 but started paying PPI in July 2004. Looking over the contact records I can only see an entry in Feb 2004 and then Mar 2005. Therefore I can only conclude that it was added to my account without my knowledge.

 

I am now confident that my PPI claim will be successful. I would definitely advise getting the SAR since another claim that I made was rejected since I obviously did not state enough information. Basically I applied for a Mastercard whilst in a branch having a meeting with my account manager. He advised me that my application was more likely to be successful with PPI since I already had one card with them. I remember he tried to send the application via internal mail (was he getting commission??) but can't remember whether I posted it in the end or whether he did. In my claim response they stated that it was a postal application and hence no guidance was given.

I do rather get the impression that they reject all claims as a default and then leave it up to you to go to the FBO, hoping that you will not bother. I would have rather liked to get this one back since I opened the card 16 years ago and could never have used the insurance anyway..

 

Anyway, many thanks for all your help and for the advice on the SAR.
