      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Guys,

In respect of calls for action,it might be an idea for someone to start an e petition which we could feature in our e petitions forum with a link to relevant forums.

There is nothing stopping anyone also writing to their MPs which can be done online quite speedily.

We could also create a thread for anyone interested in that,which would enable people to see which CAG members had done this,and report back on any replies.

Hi all, As been mentioned by other posters before the only way to put these people out of business is to stop using their services.

So how do they get business ?, I have seen adverts in pay loan shops. Does anyone on this site know how they get business ? and also as a rough percentage how much business is generated from payday loan shops.

If they get a lot of business from say adverts in local papers I wonder how the papers would respond to lots of direct complaints about them.

If they get a lot of business from payday loan companies ,then maybe a protest outside some of the shops handing out litriture detailing the way they operate might persued the owner not to allow them to advertise in his shop.

I know my local CAB were both aware of how LBL operated as well as disgusted at how they were allowed to operate so maybe they would allow a carefully drawn up letter to be on show at their offices which may be seen by persons in financial crisis ( the ones who are more likely to use LBLs service) .

This site has many members so if we all put our heads together I am sure that we could defeat these type of companies.

Can it be put up as a sticky to LBL threads because until now I was not aware of these petitions and I would like it to be the first thread seen by all new CAGGS. We need a hundred thousand on it before it goes to parliament.

Can you please advise4 of any other forums I can link this to. We need signatures and lots of them.

Abolish the use of Bills of Sales in Log book lending.

This type of lending is used for people with bad credit ratings.

There are a number of companies operating on the basis of loans secured on property, for example cars. These loans are often provided for relatively small amounts of money, with very high rates of APR (often, over 100, and cases of APR’s over 200% are not uncommon).

 

All though the legislation governing the BOS is very strict companies like Logbook Loan disregard the legislation and the consumer credit act and bully their clients with any force needed to remove the cars.

 

The Office of Fair Trading can remove a company licence. This company and assets are then sold to another company with the same disregard to legislation.

It is a multi million pound industry that needs to be brought back under control.

 

.Government legislation is failing the protect the consumer against this type of lending.

Can they take the car from a private driveway ?? I took out a lbl and as they are no longer trading (well not under that name anyway) it is apprantley now owned by The Hermes Property Services, who I know are running from the same offices,with the same people, who answer for which ever of the 2 companies they feel like depending on what time of day you call. At xmas I asked for a settlement figure and was told it would be £500 now it has gone to £1800 go figure that one.. Car is only worth about £400 and needs so much doing to it as well. Dont really know what to do anymore with this lot.. they seem to have me over a barrel really, no car, no work, no money..

Please dont hide it in the e petition section because until Site told me about this I didn't know it was on site.

It needs to be right at the start of info relating to this type of lending.

 

We need a hundred thousand signatures and only 12 months to get them.

 

I will be putting the petition on as many sites like this one as I can find. So any suggestions of sites to post on welcome

Yes every signature will help and if you can get friends family to sign to.

To many people have had their lifes destroyed from this type of lending. Any ideas of other sites I can post the link would be very helpful.

OFT Approves Logbook Loans

Approved by OFT, new licence approved by OFT , nice new friendly (??) US backed licence will be in place as from 1st July 2012, same premises, same staff, same modus operandi, same toothless regulator, same outcome. OFT Useless

 

I beg to differ with your comment with regard to the OFT - they are not and have not been 'useless' - Nine Regions Ltd t/as Logbook Loans has duly gone into receivership - That was what the initial fight was all about. Granted this was not a fight about the industry as a whole, just the way in which they conducted themselves in applying the Law that governs the Bills of Sale.

 

Consumers now have evidence as provided in the final decisions from the Appeal hearings that they can include in their claim bundles (a luxury that many who have gone before did not have) - This evidence if presented in the right way is dynamite.

 

I understand that ' Logbookloans.co.uk is now under the new ownership of Hermes Property Services Limited' (quote taken from BBC news report).

 

But, we knew that Nine Regions were banned from any activity in the market and that they would have to side with or be 'taken over' by a third party in order to collect in all the monies on outstanding agreements and of course with it being such a lucrative business... it is not surprising that a third party was quick to snap up the opportunity....

 

A consumers rights are not affected, a consumer still has every right to defend against illegal practices, illegally drafted consumer agreements and Bills of Sale not duly registered etc etcl.

 

The company in continue to trade albeit under a different trading name will still be liable to prosecution...

 

I see a range of 'litigations friends' being called for in the market.....anyone for a change of career???? Looks like you could be very busy moving forward......

Do you know what Hip Hop... I haven't looked at this forum for ages as you know, and here Nicky is, still championing the cause ........we have to give a big hands...... she has remained true to this cause and soldiers on... hi i had to pay 3000 for a loan that wasnt mine because of a car i bought in good faith ,why should i pay for somebody else ,they seized the car because the police told me to give it to them and i would have my day at court bull>>>>t it was going to be auctioned if i didnt pay so i had to fork out 3000

can somebody advice me what i can do
