You dont have to send an SAR to HFO. But one to Welcome would be helpful.

 

You could phone Welcome and ask them when the last payment was made, and to to who and when the account was sold. They will usually give the basics over the phone - but an SAR will also help as it confirms what Welcome actually do have.

 

In the SAR to welcome make sure you ask for copies of all telephone Call Logs relating to your accounts.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Morning all,

 

the debt does show on my credit file but there is no name as to the dca or creditor

,the original amount was £4983,

so i do not know where hfo have got the figure of £7714.85 from,

the account was opened on the 18/03/04,

it was last updated on the 16/07/08,

and was closed on the 01/05/06,

the default date is recorded as may 2006,

i find this totally inaccurate,and misleading.

I have attached a copy of the letter i will be sending HFO in reply to their letter on the 1st of november

,i would be gratefull if anybody would take a look at it

and advise me if i have missed anything off

I have just got off the phone to welcome and they have told me that the last payment was .26/08/05 for £15,which in my reckoning make,s this statute barred,i will still send the sar request to welcome,happy days:-)

 

Good, but you need this in writing.

Excellent news. As mentioned, HFO are fully aware of the last payment date.

 

And really the onus is on them to prove otherwise. The arguments about default dates and 'contacting you' are eyewash.

will i not recieve this information with a sar request or will i have to ask for confirmation in a seperate letter

 

It may be worth asking Welcome for this in writing - mention that you have sent a SAR but as DB has said HFO DO know the last payment date , it will be on their records also - they have to prove otherwise
