    • Whatever the nuances of the law, they will be lost on OPS, who like the rest of the PPcs never bother to get planning permission, ever. When they get a new contract they don't want to delay issuing PCNs by deigning to follow the law, especially as the period when they take over and the parking restrictions are new is the time when they can catch most drivers out.
    • I had some contact with this company earlier in my working life but I'm afraid there's not a lot I can suggest that you haven't already done. During your grandfather's time  British Celanese was a subsidiary of Courtaulds. Courtaulds was subsequently (after your grandfather had stopped working there) acquired by Alzo Nobel. They in turn closed down the Spondon site and sold it. I have no idea what the number is that you are trying to call. It's a Derby (Spondon) area code but the number appears not to be allocated. From my slim knowledge of the history of the company I would have expected your grandfather's pension to be in the Alzo Nobel (CPS) Pension Scheme.  But Willis Tower Watson are the Pension Scheme Administrator of that scheme and would be the people who should know if your grandfather had contributed. Is your grandfather certain he contributed? Joining pension schemes wasn't compulsory in those days. Or might he have got his contributions returned when he left them? That happened sometimes back then. Sorry not to be of more help.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

How long ago did you put in your claim?

 

Did you send a fos questionnaire and a copy of the spreadsheet?

 

Did you send it recorded so that you know they got it?

 

Bit more info would be useful.

Hi Ims,

When we had this card my husband lost his business and tried to claim on the ppi but was not covered.

 

Consequently HFC took him to court and got a charge on our house,

they added thousands in fees and we ended up having to remortgage because their solicitor was going to force the sale of our house.

 

We kept questioning why the PPI didn't cover him.

 

We sent for the statements in a SAR request in and then asked them to refund the PPI and nothing happened this was in 2007.

 

We now think that we should persue them for the PPI back as it was a lot of money with no benefit.

 

The problem is where do we start?

 

I have used the compound calculator and worked out the interest on a monthly basis which totals £20,387 but that may be wrong.

 

The PPI ran from 1994 (september) to 2006.

 

I do have the original recorded letter receipts and we sent one in May this year no response and then I sent another one yesterday asking them to refund our premiums.

OK thanks for that.

 

So, since the Judicial Review you are perfectly entitled to re-open this (I have also replied to your Barclayloan thread too).

 

Pop along to the fos web site and download the consumer questionnaire and complete it.

 

Prepare a revised scheduel of claim using the APR that they were charging you on the card. I've attached a compound interest spreadsheet you can use. Amend the personal details in the blue section and then move to the white list section underneath the coloured bits. List all of the ppi payments giving the date, a description and the amount. The sheet will do the rest.

 

Please note that the sheet is protected in certain areas to prevent alteration to formulae. If you get a protection message it means that you are trying to change data in a protected cell.

 

When complete, send a letter of reclaim, outlining the reasons for the mis-sale, together with a copy of the psreadsheet and the fos questionnaire to the lender.

 

They will have 12 weeks to give you a final decision before you can refer the matter to fos.

Oh....posts crossed...so you've already done all of this recently then?

 

If that is the case and they have failed to respond at all then I'd lodge a complaint with fos.

 

Maybe I'm confused as to the timing of events now lol

Hi

 

Yes...for the ppi claim just the ppi amount as shown on the statement. Don't forget to change the interest rate in the blue section to the APR being charged on the card. The sheet will do the rest.

 

Also don't forget that you can launch a seperate claim for any unlawful charges (if there are any)

I have had a final response from HFC bank saying they will not uphold my complaint.

 

I decided to call them and spoke to a regulatory complaints advisor.

 

I advised her that I would be looking for restitution as Restons took us to court obtained a charging order

and we had to r-emortgage our home because the PPI did not cover my husband because he was self employed.

 

I said we have letters from Restons saying that the PPI is nothing to do with them.

 

Her response was well we base our decisions on the form you send in and not on the history of the account.

Please can you send me another claim with this information in!

 

I don't understand it, they say that they do not have the credit agreement as it was open in 1994

yet they are saying we had a ppi policy leaflet and that their records show

( but they have not got a copy) that we requested the PPI on our application form

- but they cannot provide a copy because they don't have it.

 

They are only legally obliged to keep retain the information for 6 years.

This is all in the same letter.

The letter also states that it was a beneficial finance account, we have never heard of them.

 

I feel like I should now start the ball rolling on the court as the lady said I should go to FOS and I said no we will go to court.

 

Any advice would be helpful.

Can anybody tell me if it is possible to send a SAR to Restons Solicitors

- this would be to gain any information they hold on us.

 

We have paid HFC everything we owe but want the PPI back and when Restons were going for us

we had letters concerning our worries over the fact that we could not claim on the PPI.

 

Would Restons have to comply with a SAR request.

After a long battle I have received the SAR from Restons which clearly shows our concern at not being able to claim PPI.

 

The information they sent me is just a list of transactions.

 

I will now go back to HFC with the proof and hope they cough up.

 

I am concerned that the amount would make a court claim expensive.

 

Could somebody please point me in the direction of the LBA template. I want to make this the last attempt before going down the court route. Thank you

I am now compiling my POC to take this through the court system.

 

I have just found my original T&C's and have been researching the sales techniques as My husband believes he was pushed into this card with PPI when he bought a car from vauxhall.

 

Is it feesible that a car salesman would promote a credit card?

 

I can see on the original statements that there is a line that states ' The GM card ' is a trading name and style of both HFC bank limited and Vauxhall motors Ltd.

 

How much information should I put into the POC which I will attach to the N1 form,

 

should I keep them brief or throw everything I have at them?

they have put a collection charge on the balance plus summons interest and judgement interest.

 

I notice that HFC bank also added finance charges.

 

Shall I claim these charges back seperately from the PPI?

 

I can upload the PDF of the charges but not sure how to

Thank you DX your help is much appreciated.

 

I doing my Particulars of claim and think that because of the amount the court fee will be around £600.

 

We did try to claim on this insurance and we were told we were not covered, we have been asking for the money back and it took 2 years for one response.

 

I have also noticed that I am getting letters from both HFC and beneficial finance for example i send a letter to HFC and get a letter back from Beneficial,

I replied to this and got a letter back from HFC and so I am confused.

 

I have emails from Restons telling us that the insurance is nothing to do with them and to refer back to HFC who would not talk to us as it had been passed over.

 

Restons notes also state that my husband was inquiring about the PPI.

 

My question is how much of the information do I put in the POC,

I have been reading that you have to include everything or it cannot be submitted later.

 

The debt was paid off by a remortgage but because of the CCJ we had to get a high rate mortgage.

Hi Dx, the copy of this is with our solicitor who dealt with the remortgage and paying off HFC.

I have contacted her and asked her for the copy.

She said it will take 3 days and I will report back when I get it.

This is a huge claim and will almost certainly be allocated to the Fast track, where your exposure to costs could be a problem IF you were to lose.

 

Have you considered going via the Financial Ombudsman ?
