  1. Wow that's an old document good luck Davsib Nope I wouldn't trust them one bit
  2. Hi Dx, the copy of this is with our solicitor who dealt with the remortgage and paying off HFC. I have contacted her and asked her for the copy. She said it will take 3 days and I will report back when I get it. Thank you for your help
  3. Thank you DX your help is much appreciated. I doing my Particulars of claim and think that because of the amount the court fee will be around £600. We did try to claim on this insurance and we were told we were not covered, we have been asking for the money back and it took 2 years for one response. I have also noticed that I am getting letters from both HFC and beneficial finance for example i send a letter to HFC and get a letter back from Beneficial, I replied to this and got a letter back from HFC and so I am confused. I have emails from Restons telling us that the insurance is nothing to do with them and to refer back to HFC who would not talk to us as it had been passed over. Restons notes also state that my husband was inquiring about the PPI. My question is how much of the information do I put in the POC, I have been reading that you have to include everything or it cannot be submitted later. The debt was paid off by a remortgage but because of the CCJ we had to get a high rate mortgage. Thank you
  4. The value for the PPI with the spreadsheet (see attached) is £26,741.97
  5. These are the charges I have found on the final few statements
  6. When filling in my POC and establishing the PPI charges I have noticed that on Restons SAR infortmation they have put a collection charge on the balance plus summons interest and judgement interest. I notice that HFC bank also added finance charges. Shall I claim these charges back seperately from the PPI? I can upload the PDF of the charges but not sure how to Thank you
  7. I am now compiling my POC to take this through the court system. I have just found my original T&C's and have been researching the sales techniques as My husband believes he was pushed into this card with PPI when he bought a car from vauxhall. Is it feesible that a car salesman would promote a credit card? I can see on the original statements that there is a line that states ' The GM card ' is a trading name and style of both HFC bank limited and Vauxhall motors Ltd. How much information should I put into the POC which I will attach to the N1 form, should I keep them brief or throw everything I have at them? Many thanks for your help
  8. Hi Again, I am filling in the MCOL and for some reason it will not accept the Leeds address postcode, could somebody please advise. many thanks
  9. Hi Everyone, I have at last received a letter from Santander stating that they decline my request for return of PPI. I have sent three letters and this is the first response I have had. I called the compaint resolution team and asked once again for the copy of insurance and also a copy of their final decision letter as I had not received this. They just appear to ignore letters. Anyway I think that I will issue a MCOL and see what happens. I have my original application form and the original T's& C's and they upgraded the card without my say so. I also attempted to cancel the PPI on three occasions once by phone and twice by letter and they ignored it. I know that FOS has a back log, has anybody got any experience of Santander in a court situation with a Storecard? Thank you
  10. After a long battle I have received the SAR from Restons which clearly shows our concern at not being able to claim PPI. The information they sent me is just a list of transactions. I will now go back to HFC with the proof and hope they cough up. I am concerned that the amount would make a court claim expensive. Could somebody please point me in the direction of the LBA template. I want to make this the last attempt before going down the court route. Thank you
  11. Can anybody tell me if it is possible to send a SAR to Restons Solicitors - this would be to gain any information they hold on us. We have paid HFC everything we owe but want the PPI back and when Restons were going for us we had letters concerning our worries over the fact that we could not claim on the PPI. Would Restons have to comply with a SAR request. Thank you
  12. I have just received a letter in response to my demand for PPI repayment from Santander declining my request. I initially sent a SAR in March 2009 and had a response from GE Money they sent some but not all the information. They apologised but said 'due to system issues the data is not available to us. I have my original agreement and I have the hard sell leaflet that accompanied the opening of the account ie.10% off this agreement was made in 2000 and it does say that (subject to eligibility) It also says that I would receive an insurance document and I did not. Has anybody received the 'Certificate of Insurance' as it clearly states and I quote under what happens next 'Following acceptance of your application you will be sent a certificate of insurance giving full details of your cover including eligibility and exclusions. Your cover will be for one month at a time. Further down it says you have to phone for the certificate. I note also the hard sell box where Debenhams say 'We recommend you take out account cover' I notice also in the SAR response I have not been sent any terms and conditions luckily I have the originals. Can anybody let me know if they received a Certificate of Insurance from GE Money. many thanks
  13. Thank you Ims, It would be good to emphasize to others that this was turned down first time and I had a final decision. I went back to them and sent off the letter referring to the Judicial review enclosing the FOS form. It has taken from October to now and during that time I have had two letters saying we apologise for the delay there is a backlog of cases but you can go straight to FOS if you want. I will be making a donation to CAG as without their help this would not have been possible and so once again thank you.
  14. I have just received a cheque for £5500 for the PPI from Barclay's what a battle but got there in the end. Thank you to ims and everybody else that helped me on this it is much appreciated.
  15. I have had a final response from HFC bank saying they will not uphold my complaint. I decided to call them and spoke to a regulatory complaints advisor. I advised her that I would be looking for restitution as Restons took us to court obtained a charging order and we had to r-emortgage our home because the PPI did not cover my husband because he was self employed. I said we have letters from Restons saying that the PPI is nothing to do with them. Her response was well we base our decisions on the form you send in and not on the history of the account. Please can you send me another claim with this information in! I don't understand it, they say that they do not have the credit agreement as it was open in 1994 yet they are saying we had a ppi policy leaflet and that their records show ( but they have not got a copy) that we requested the PPI on our application form - but they cannot provide a copy because they don't have it. They are only legally obliged to keep retain the information for 6 years. This is all in the same letter. The letter also states that it was a beneficial finance account, we have never heard of them. I feel like I should now start the ball rolling on the court as the lady said I should go to FOS and I said no we will go to court. Any advice would be helpful. many thanks
  16. Hi, I have done used the spreadsheet and filled in the FOS questionnaire, do I mention in my covering letter that I am reopening my claim? Thank you
  17. Hi There, I was able to get my statements and agreements from GE Money although they only sent me statements going back to March 2003 even though the PPI was taken out in April 2000. I also managed to get the copy of the original agreement filled out in store and I have signed for account cover but all my employment details etc are blank. I have just done a compound interest spreadsheet for the statements I do have and it equates to just over £5000. Can I tell them I want the PPI from when the account was open even though they would not send me the statements? Thank you very much for all your assistance.
  18. Hi ims, Once again thank you for your help, is it just the PPI charge I put on the spreadsheet? LOL I think I have confused things I haven't sent them the spreadsheet yet, just letters asking for the money back politely
  19. Thank you ims that is a great help, I still have all the information and will fill in the FOS.
  20. Hi Ims, When we had this card my husband lost his business and tried to claim on the ppi but was not covered. Consequently HFC took him to court and got a charge on our house, they added thousands in fees and we ended up having to remortgage because their solicitor was going to force the sale of our house. We kept questioning why the PPI didn't cover him. We sent for the statements in a SAR request in and then asked them to refund the PPI and nothing happened this was in 2007. We now think that we should persue them for the PPI back as it was a lot of money with no benefit. The problem is where do we start? I have used the compound calculator and worked out the interest on a monthly basis which totals £20,387 but that may be wrong. The PPI ran from 1994 (september) to 2006. I do have the original recorded letter receipts and we sent one in May this year no response and then I sent another one yesterday asking them to refund our premiums.
  21. Hey everyone, I have done the spreadsheet with the interest now what do I do? I have sent them a letter demanding they pay the PPI back but I didn't get a response. Thank you
  22. I have decided to re-awaken this case now in view of the recent decisions can anybody advise me ? thank you
  23. I would involve Trading Standards. I did eventually get my money back by threatening to take them to court. I would never use this company again. Keep telephoning the scrap yard and demand your money back. Also ask where in the contact does it specify handling fee?. I am sorry I cannot be of anymore help Good luck!
  24. I have some good news ! Through my house insurance legal cover I am taking Topps to court. They have agreed that I have a case and have appointed a solicitor. The tiles are just wearing away the surface has gone in many places. The experts that came out who are tilers say it is the tiles. I think they are wall tiles! Anyway check your home insurance policy as you may have legal cover which covers disputes! I will let you know if it gets to court!
