Hi guys, been floating around this forum for a while now, and have to say it is interesting reading.

 

Been getting hassled recently by 1st credit about an old barclaycard cc that was defaulted in dec 2006 and have not acknowledged it since...They are claiming just over £7k and I am still in no position to be able to repay this :[

 

Have received many letters from 1st credit, most notably one offering me a 50% reduction which led me to believe they have little to go on. But now I have received what looks like a pretty standard "Legal Proceedings Being Considered" letter.

 

I am considering sending them a cca or prove it letter, what do you think?

Have you received any notice of assignment from 1st creditor are they acting as collection agents/administrators for b/shark only ?

 

Have you sent a CCA request for a copy of the agreement ?

Thanks for the replies.

 

I have sent them no cca request, I have sent them nothing.

 

I dont remember receiving a noa from 1st credit but I could well have done, and on the letter it says "Account purchased date: xx/01/2007" so it looks like they bought the debt.

 

It looks like the CPUTR letter is acknowledging the debt if a legally enforcable signed cca is produced, do I really want to do that?

Hi

 

If they are offering a discount there's a clue there.....no one offers a discount if they can get the whole lot. Probably made up of unlawful charges and/or PPI.

 

Also the wording of the letter.... "Being Considered"...probably full of might, maybe, could etc.

 

Have you got your statements?

No I dont have any statements, there was no ppi on the account, but there is probably a good few charges on there. I seem to remember them charging for missing a payment, and then for late payment :/

Be careful. In one years time it will be Statute Barred. You do not want to risk acknowledging it if you can avoid it.

 

If they start getting a bit more serious, then you can reclaim all the charges etc..., but if they've done nothing since 2007 until now, they're not that keen are they.

Hi

 

Yes, appears to to SB some time in 2012.

 

Bear in mind that if they do issue, a SAR will take up to 40 days to get information back and then to prepare a reclaim.

 

You might want to wait and see what their next missive is.

 

Can you post up the letter you mentioned minus all personal information?

Convert it to a PDF file and load it up...should be ok then
