Hi. I'm moving in with my partner soon. The plan is to move in two weeks before my tenancy officially ends, mostly because that's the only time I can get help moving all my stuff over and it's over a 100 miles away! I feel I should stop my income support at that point because I don't feel that I am entitled to claim it anymore and don't want to do anything wrong, but I'm worried how that effects my council tax and benefit claim which I don't want to stop until two weeks later on the last day of my tenancy? As my partner has nothing to do with my home why should my partner be responsible for that? Will they pay until the last day of tenancy or will they stop paying me as soon as my income support stops? I'm going to get in trouble with the landlord if that happens! I don't know what to do!

Thanks for your advice on the best way to approach this issue!

If it is linked to your income support claim, payments will be suspended when the income support stops. To get it after income support ends up until your tenancy agreement finishes, you will need to show to them that you still qualify for it on the grounds of total household income/capital and tell them any change of address and/or circumstances. You cannot normally get housing benefit/council tax benefit for a property that you are no longer living in.

My advice is based on my opinion, my experience and my education. I do not profess to be an expert in any given field. If requested, I will provide a link where possible to relevant legislation or guidance, so that advice provided can be confirmed and I do encourage others to follow those links for their own peace of mind. Sometimes my advice is not what people necesserily want to hear, but I will advise on facts as I know them - although it may not be what a person wants to hear it helps to know where you stand. Advice on the internet should never be a substitute for advice from your own legal professional with full knowledge of your individual case.
