      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The only problem with a pre paid debit card is that most have minimum load amounts which can be as high as £50.

You therefore need to make sure they are not able to take more.

Any way-I seem to recall that the OFT has issued guidance on taking debit card payments that leave customer with no funds for essential living expenses such as food heating lghting etc.

The days when these lenders could take card payments willy nilly after being advised of problems,hardship and offering alternative payment methods,are numbered.

Anyone in this position and being ignored by these payday loan co's should report them to the regulators and takr them to the cleaners.

In 2011,there should be no need to be reporting a bank card stolen simply to halt third parties taking payments.

As far as I am concerned-the banks are equally liable if they fail to act on a customer instruction to stop money being taken from accounts.

Why people dont hold them to account I dont know.

Can you give an account of how you have been trying to sort this ?

How have you been talking to them?

Have you rxplained things ?

Have you had anything from them in writing ?

Re Quick Quid i did a live chat and we agreed to a Pre-Default Payment Plan over 4 months and will freeze interest-still refuses to give me there bank details.. I emailed Payday Express and Payday UK but didn't get any replies so decided to ring them. Payday Express refused to freeze the interest but did offer to reduce the interest each month. Payday Uk adviced me i need to default 1st then someone will ring me on Wednesday or Thursday. Was planning on paying off Lending Stream but may default and use the money to pay of Payday Express.

 

Still waiting on Payday Express to confirm there arrangement via email or letter-but at least they have emailed me there bank details. Quick Quid are still refusing to give out there bank details.

QQ - I understand we won't get there bank details for love nor money ! so what I done is set up a *secondary account purely for my debt payments that need to be made, and only given QQ the bank details (sort code and account no) for direct debit setup, I log on to online banking daily so I can see if their not going to play ball and will then cancel it - it has saved me giving them the full card details

 

The woman chucked a right fit yesterday morning about it but I said it is either that way or I'll pay by postal order - so caved in and accepted - I also put what gets agreed in writing

 

*PS - I found the Halifax just brilliant for this type of account!

I have decided to pay Lending Stream in full-£232.00..They offered me a repayment plan but they refused to freeze the interest but wanted me to defer for another month-so they wanted £301.00 over 5 or 6 months. So agreed to pay the loan in full by 16/09..Gonna be tight but hoping i can pay them in full..

Have also received there bank details and confirmation of what was agreed via emai..

So will default with Payday Uk tomorrow and wait for there phone call.

Keep everything by surface mail by recorded delivery keeping a copy.

ASK FOR A COPY OF THEIR COMPLAINTS PROCEDURE

I have just rang Santander for them to check for any pending debit card payment-just incase Payday Uk decide to attempt to get there money. Bearing in mind i reported my debit card lost last week and still waiting on my new card to arrive. He adviced me because its a loan i am repaying, that type of company my still be able to get there payment tomorrow as its a recurring debit card payment. Is that correct????.

Worried now as i wont have enough money left to pay my mortgage,bills and other Payday loans..

Gonna have a very sleepless night tonight...

Just got of the phone from Payday Express as they sent me email and texts saying i have defaulted. Rang Collections and explained an agreement was agreed with Jo on 26 August. I finally have an email confirming what was agreed.

Had a call from Payday UK advising me that the payment has failed this morning. she advised me still unable to set up a repayment plan as they have to try to collection the payment again at 2030-told he not to bother because that will also fail also.

They cannot leave it to default as the loan is a short term loan (Section 87 of the CCA Act) and they cannot add fees at will. They are being very very devious here and need a good hard slap.

Already paid £180 towards Payday Express at Barclays this morning. When i spoke to collections he also said that if i was to pay £320 before 14/09/11 that would clear the balance or continue to pay monthly to reduce the interest-again i have a email to confirm both options. Obviously i want to get rid of them ASAP so may ring my mortgage provider as mortgage not due til 09/09/11 and see if i can pay a reduced amount in September-i've never had to ask before as mortgage always paid on time-can't ask my family or friends for money as they don't know what a mess i'm in.

Do NOT sacrifice your mortgage, the mortgage has a far higher priority than the payday loan. The payday loan is a non secured loan and the mortgage is a secured loan.

 

Rethink, have you paid the original loan amount back yet - remember whatever they say on the phone is wrong, you only ever need to repay the original loan and one months interest on an unsecured payday loan.

 

The MORTGAGE cannot be sacrificed for the sake of the peace you might get... you will be double stung further down the line and could loose your house and ANY chance of ever owning a property again.

THANKS Sillygirl1-i know your right..Will ask my sister or brother for help instead or i have an arranged overdraft so can use that-gonna be cheaper than dealing with Payday Express any longer.

Now i will wait for Payday UK to ring.

UPDATE..I agreed to pay Lending Stream off and they have given me till 16/09/11 to pay the full amount-with no interest added on. After speaking to my sister last night she agreed to lend me £320.00 to pay off Payday Express-at least my sister not charging me any interest:-D...They have given me till 14/09/11..

Finally defaulted on Payday UK last night so just received a call from there collections and have agreed to pay £50.00 by Tuesday then remaining balance over 3 months.

Re Quick Quid i have already set up a repayment plan.

Been such a fool borrowing the money from the Payday Lenders but now i just have to stick to the payment arrangements and hopefully will be debt free by the New Yr..

HiCan I just ask - how does this original loan amount + one months interest work. i am due to pay the oustanding balance to payday express, I defaulted on £500 payment - and its now £630 being a month late.What should I be paying to settle it off?Thanks

My debt with Payday Express is also £500. I rang them before i defaulted and agreed a repayment plan over 5 months but reducing the interest each month-refused to freeze the interest or paying of full balance before 14/09/11. Wanting to end this relationship with Payday Express i decided to ask my sister.

UPDATE..I have now paid off Payday Express- just received email to confirm ZERO balance..:-)

SO 1 down 3 to go..

Also paid Lending Stream this morning via faster payment so will ring them on Wednesday to make sure they have received all my payments.

So i'm nearly there clearing my debts-just Payday UK and Quick Quid to pay-will stick to repayment plan to be clear both loans by the end of the yr..:-)
