      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My account with minicredit was passed to Fredericksons also. I have already paid minicredit over £200 and have told Fredericksons I am not paying minicredit another penny they say I still owe £510. I have recieved yet another letter this week from Fredericksons saying that I have to pay this and have 7 days to contact them. I dont know whether to tell them to contact minicredit and tell them to take me to court on their behalf and let me take my chance there. I am not paying nearly £800 for a £80 loan.

 

Roxy I see you have posted a lot of info about your issues with mini credit,but have not started your own thread.

It may be a good idea -I can sort this if you want.

please advise me what can i do about mini credit they have just rung me saying they are taking me to court and applying for an attachment of earnings they will also be letting my bosses know can they legally do this i am so worried any advise greatly appreciated

it is a complete breach of their debt collecting guidelines to inform other people of your debt, including your employers, and anyway they CANNOT get an immediate attachment of earnings without you having the chance to defend in court, and you would have had to breach a court order before they could even try, you are a long long way off that.

 

http://www.tradingstandards.gov.uk who are already aware of this odious lot.

 

COMPLAIN TODAY BEFORE YOU START POSTING AGAIN - whilst they cannot deal with individual complaints personally your complaint could tip the balance against them and have them investigated.

hi

on saturday 15/10/2011 mini credit took £50.00 from my bank account without authorization i have now cancelled card is there any thing else i can do who should i report them to have to ring bank on monday to try and get money back, these people are despicable

What you MUST do is contact the police and ask for a crime number for this incident. According to a Halifax branch manager I spoke to last week this is a CRIME. You have an agreement with the company to take x amount on x date, they have taken an amount out they were not entitled to therefore it is THEFT.

 

Get onto the OFT and remind them they have told this lot off before, and also to Trading Standards.

 

Your bank will probably say there is nothing they can do, but once you have that crime number (insist on getting one as without it the bank won't cooperate) then you should get your money returned at some point.

 

As has been stated simply loosing your card is not enough, you MUST get another bank account with a different bank, the Post Office or the Co-Op have good basic accounts, another account with the same bank could still be raided via a 'reciprical' agreement.

Hello

can anyone tell me has anyone ever been taken to court by these people i received a letter today saying they were taking me to court what do you advise me to do, i cant afford to repay the £800 that they claim i owe as they wont accept repayment plans and would any court really make me repay this crazy amount for a £100 loan considering they have take £50 from my account without my authoratisation

They will fail once you put in a defence, it will cost them £80 to file their Allocation Questionnaire (very good move on the courts part IMHO) and they won't like being questioned by a judge about the extortionate charges.

 

You need to get a new bank account with another bank to protect your income from raids Halifax Easycash, Post Office or Co-op all have good basic accounts with debit cards and direct debit facilities.

 

If they send court papers come back on here and I will do a defence for you - their particulars of claim are ususally very poor and the fact they have taken £50 from you can be written into the defence and used against them.

 

If you don't defend you will have to pay the £800+ , if you defend the judge will have to investigate THEM rather rhan YOU and at most you would have to pay the original loan and interest, but as they have taken money unauthorised it should be about £100-150. A lot of difference.

I will be very suprised if they take you to court.They threatened me constantly with that old chestnut. I took a £100 loan with them and only received £80. When I fell in to financial difficulty they added nearly £500 in charges in the space of 4 weeks. After refusing any repayment plan I paid them over £200 and told them I wouldnt pay another penny. They have now sent the account to a DCA Fredericksons/Bryan Carters who have refused any repayment plan also even though I dont think i should pay another penny. I have now told them to take me to court because letters are just going backwards and forwards and I am sticking to my guns.

Yes, they are one of the comanies that like court. There have been mixed results (as with other PDL companies). What is your current situation?

 

Hi, I missed the original payment due date by 4 days as changed bank account borrowed 150 owed 183 now I owe 340!!!!!!

I've paid £200 online yesterday. I feel that is more than fair whenthe arrangement was for £183 6 days previous.I had to call them and find out as my email had spammed their warnings. They've never contacted me about it though. they've not responded to my email stating the £200 was full and final. Are there any court stories about these???

There aren't any that will help. You have paid the loan and interest and they have to fight for their charges, this can be show as vexatious and litigatious in court if necessary, but I doubt it will get that far.

 

Make sure you get another bank account for your income to avoid any future raids.

Don't forget to complain to the OFT and Trading Standards about those charges.... outrageous

 

http://www.consumerdirect.gov.uk for the OFT, http://www.tradingstandards.gov.uk for Trading Standards, both are investigating Payday loans. You might be asked for a witness statement but that is normal.

 

I hope you paid them from your OLD bank account and not the new one... the whole point of getting another account is to stop raids on your income.

RESULT......

 

I have received an email, asking if i offer to pay £150.00, then the original debt of over £900.00 will be wrote off, my advice keep at them, they will back down in the end. My debt was passed to freds, then to opus. Be firm with OPOS, they say they will only communicate by phone, email them and tell them what you will pay, and keep all communication in email. Good Luck peeps. xx

There we go - another PDL company showing that it is just a 'threat mechanism'... don't forget to continue through with a complaint to the OFT and Trading Standards, shows how they hope ignorance gets them their money.

 

Freds actually pulled out of collecting money for PDL companies due to the interest from OFT and Trading Standards and the 'disturbing level of complaints'. So at least they showed some integrity.

 

Forgot to mention that using multiple agencies also is against the OFT Guidelines on Debt Collecting so you can mention it got passed around..

I can see you have offered someone help in case she is taken to court. I myself in a similar situation to her. Been borrowing from minicredit for few months, always paid back until this time when I did not have the funds. Today I received second letter that doorstep collector will visit me, what are the chances they will? I am dealing with a debt management company but minicredit are refusing to deal with them which I think is illegal for a start as they have to accept any payments (I might be wrong). If I am taken to court can you help me with adviciing how to defend myself?

If the doorstep collector comes, tell them to get lost. Don't open the door, just tell them and ignore them.

 

If minicredit are not accepting the dmp ask them why. Should you be taken to court which is unlikely, a judge will want to know why they didn't accept the dmp or your circumstances. Minicredit are one of the worst pdls around to deal with for a variety of reasons.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..
