    • In my experience (not with car payments) but with many other things, my partner has been ill and signed off in the past and we have been unable to meet various commitments.  Naturally if you ring the call centre they are going to fob you off and tell you you must pay, that's why that never ever works. I would obtain a note from her GP listing all her health issues plus medications plus side effects, then write to the finance company with a copy of it, explaining the situation, as you have here, asking for a payment holiday. Perhaps mention that the car is very much needed for hospital appointments etc. It's likely the finance company would rather you pay till term end than, chase you for money they will never see, and sell the car at auction for a loss,  You can search some of my threads going back years, advising people to do this for Council Tax, Tax Credits, HMRC, Even a solicitors company and it always works, because contrary to popular belief people are reasonable.
    • Sorry, I haven't ever seen one of these agreements. Read it all and look out for anything that says when she can withdraw and when she is committed to go ahead. If it isn't clear she may need to call the housing provider and simply say what you posted here, she doesn't want to go ahead and how does she withdraw her swap application?

Your head is like a power bank of knowledge.  Her health issues are short term, due to a relationship breakdown she took it pretty hard and has been signed off work on medication for 3 months. She only started her job in February 24 so does not qualify for any occupational sick benefits, which is where the ssp only comes in. (You will see me posting a few things over the coming days, whilst I try and sort some things for her)  I sat with her last night relaying all this back and she does want to work out a plan, she was ready to propose £100 for the next 3 months and then an additional £70 per month onto of her contractual to "catch up" but Money247 rejecting the payment holiday and demanding £200 thew her, which is why I came on here.   
    • I've looked at your case specifically more.   Term 8bii reads " when, in accordance with instructions from the Customer or the Consignee, the Consignment is left in a safe place" Their terms choose to not define safe, so they are put to proof that the location is safe. If your property opens onto a street its a simple thing of putting a google earth image and pointing out that its not a safe place

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok firstly i have to hold my hands up to this and say that I have dealt with this really badly but i need some advise.

 

Last year I took out a loan with Cash Genie for £250.00. I fell into hardship and defaulted a few times on the loan. I finally made contact and came to arrangement plan with them. I emailed them a few times as the payments didnt go through and after the last email iu heard nothing back from them.

 

Last tuesday they took out £618.00 out of my bank account. I was totally confused as how they got my bank details but they said that they had got them through paydayeveryday which they are allowed to do as it is in their terms and conditions of business. Also i had committed fraud by trying to obtain money through deception so if i was thinking about calling the police dont forget to mention that to them.

 

I asked them if the loan was now closed and they said that i still owe them £552.40.

 

My bank have told me i have to send them a letter from cash genie telling them how much i owe otherwise they cannot give me the money back but obviously with the charges i now owe much more than the origional 250.00 which i ppaid 60.00 off.

 

Im at my wits end and i dont know what to do. I can pay my bills this month and from what they say the bank and cash genie i dont have a leg to stand on.

 

I feel sick from all of this and know its my own stupid fault.

 

Can anyone adivise me what to do?

Get onto the Police, they are toads. Tell the police you need a crime number to claim off your insurance - that should get you some redress (even if you haven't got insurance it works). Once you have a crime number get onto the bank and explain that you did not give permission for them to take the money and all you did owe was £250.

 

Get onto Trading Standards http://www.tradingstandards.gov.uk and explain to them the issues

Get onto the OFT and tell the OFT that they have already sanctioned payday loan companies from taking money out of peoples accounts without permission http://www.consumerdirect.gov.uk

 

Get onto the local CAB and ask to be put in contact with the local money laundering team, this is the department which deals with payday loan companies doing this sort of thing.

 

It is disgraceful what they have done - you DO NOT OWE THEM ANOTHER PENNY.

 

You could also go for an N1 court case and claim the money back that way, clearly stating the facts.

You HAVE NOT committed fraud, THEY have. They love to bandy this word about as it scares people. You have proved to them you are in hardship, you are in even more hardship now as they have taken your funds through dubious means.

 

Even though it may be buried in their terms and conditions (which I very much doubt) they are behaving in a very underhand manner.

 

GO TO THE POLICE - they are in the wrong, not you.

Thank you so much. I am in tears here. All of my bills are due on friday and the bank wont give me my money back. I dont know what to do im going to get into so much trouble with everyone.

But what about the money that they say are owed in charges? Plus another 500 odd i opwe them? The way the bank spoke to me was crappy at best and they were basically saying that these payday loan companies put on 1000% interest blah blah blah and they need to know the exact amount owed so will the exact amount not be the balance outstanding ??? Im so confused and freaked out and finding it hard to think straight. Im normally quite strong about this sort of thing but them taking all this money has sent me into a spin and im panicking.

Sorry to ramble and i know im in the wrong here but how sneaky to set up another company with a different name and lift your card details from there. I cant belive that.

Do you think that will work? My bank were treating me like a criminal on the phone. Also what do i do regarding the other £500 i supposidly owe them in intrest?

Print out the original agreement and take it to a bank branch, the phone people are not equipped to deal with this.

 

Take the original agreement to the police and ask to see their money laundering people, this is what Cashgenie are guilty of here, they have taken far more than they agreed to.

 

You do not owe them another penny - stop worrying, that is exactly where Cashgenie want you to be. They are in the wrong, not you.

So do i basically print off the agreement and tell them to give me the balance back as it is a civil matter? Then do i need to put the account into dispute and ask for a CCA and all paperwork and phone calls relating to the account?

I think i ;posted at the same time as you so sorry. I have to take the agreement into the police station as well? or can i report it and get a crime refernce number over the phone?

STOP - you cannot get a CCA from them as the original agreement is already in your possession. You do not need to put the account into dispute as they already have done that by virtue of taking the funds from your bank.

 

It is a different route with the payday loan companies, not the same as a bank overdraft situation.

 

You only ever need to CCA if you have NOT got the original agreement.

 

You can try reporting it on the phone and ask about the economic crime people or whatever they might call them.

 

Have you got any children to look after as you can use that with the bank.

No but they took all of my avaliable funds out of my account. I dont even have any money for food

. My sister has been trying to help me but shes so stressed out as well i said i would try and deal with this myself. Thank you for helping me.

 

Are the guest Cash Genie? I heard they look on here. God who are these people?

 

Correction, my son is home from uni so thats both of us not eating tonight. I just managed to borrow £20.00 of a neighbour.

This all happened because i had an abusive boyfriend. He made me take out the loan in the first place. I reposrted all of that to the polce and my sister told Cash Genie. He also made me take out other loans as well but the other payday loan people wrote the loans off as I was in hospital after he had beaten me up. Im under the psychatrist as it is at the moment and im finding all of this extreamly overwhelming.

Not yet I have only just found out today who it was that took the money from my account. It has taken 4 days to show. My bank assured me they would give me the money back now they are saying no. I basically said to the bank that how can a company just go into my bank account and literally clear it out???

 

Im due to see my doctor on friday so i will get a letter from him then and refer the police to the previous case.

Cash genie could have just taken the amount owed to them not cleared out my account.

Am in bank with original loan documentation and they are saying they can't do anything !!!!!! So this company can just keep going into my account any time they want, help!!!! Shall I just shut my account???
