I emailed both Andrzej.Tuleja and James_Goldsmith at Whirlpool dot com. I got a phone call from their executive team a couple of days later, and a replacement part dropped on the mat a week after. She was quite apologetic, however, also reiterated the "90 day warranty" period on customer fitted parts, and did not comment when I mentioned that the CRA also applies as I was a consumer buying from them directly. So I now have a spare door switch if the machine decides to eat another in the future! Cheers all!   Note dx100 that the "Hotpoint CEO" you linked to is not related to the hotpoint appliances, but some kind of marketing app.

It seems that DVLA think that S.88 does apply for applications disclosing a new medical condition after all. Why might this be so, and what of “qualifying application" and "relevant disability"? S. 92(1) imposes on the driver a requirement to disclose a relevant disability. S.92(3) requires the Secretary of State to refuse such an application disclosing a relevant disability ….. EXCEPT S.92(4) requires the Secretary of State to grant such an application if the relevant disability is “adequately controlled”. Hence my belief S.88 can apply for medical conditions (if the driver meets the medical standard of fitness to drive) as the application remains a qualifying application IF the driver meets the medical standard of fitness to drive, until DVLA (on behalf of the Secretary of State) say it doesn’t, provided the driver believes they meet the (medical) standard. Additionally, at (or before) June 2013 (as noted in my previous post) the medical standard for fitness to drive for conditions involving excessive daytime sleepiness was changed from “completely controlled” to "adequately controlled".

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Good Afternoon, At the end of my tether now with worry, I only early around £1000 a month, and to pay off all my payday loans this month it would cost me £3500 approximately. I also have normal outgoings of around £800.00, leaving me with £200.00 a month to play with, with the payday loans. I am concidering getting a consolidation loan of around £13,000 to pay off all my debt, including all the payday loans, car finance and everything else, but I have a poor credit rating so I cannot go to the banks, although I heard in some cases, decisions of a loan with banks can be appealed. Are there any other solutions? I don't really want to enter a DMP as I feel a loan would be the best option and it would leave me without defaults (I have been working for over 5 years and I am safe in my job). Any advise is welcome, I have 9 payday loan debts, with Wonga, Payday Express, Lending Stream, MiniCredit, WageDayAdvance, 1 Month Loan, 247 Moneybox, Txt Loan and Mr. Lender. Thanks

Dont get into further debt, payday loans are not priority debts so just default this month and pay them what you can afford - say 10 pound each.

 

If you get a consolodation loan - you will be paying back for ages. just try and become debt free, then you income will be all yours. with poor credit, the only loans you will get are really high interest -Not worth it!

obviously your money, is not stretching hense the pay day loans. Do a realstic i&e, take some advice from a debt charity cab, national debt line etc.

They will claim money on your card, so cancel this and open a new basic bank account.

I would think very carefully about borrowing any more money.

As Cadbury said. Cancel your debit card, report it lost immediately so the payday loans ant take your wages. check that no DD have bee nset up on your account. Pay ONLY by standing order, otherwise they will help themselves.

I would strongly advise you to set up a new bank account - money can be taken off cancelled cards by compnaies that you owe money to. Halifaxt do an OK basic one that I was able to open with a very pooor credit rating.

I don't think that you should take out a debt consolidation loan - it will just get you deeper into the cycle of debt. Some debt consolidation compnaies are really dodgy so I'd give them a very wide bearth.

 

I would suggest talking to the Consumer Creit Counselling Service. They're a charity and can set up a Debt Mangement Plan or can give you some advice about the options that may be best for you. Or you could call the Citizen's Advice, as they'll be able to give you some support too.

 

If you wanted to try and sort it out on your own, then you need to do a realistic budget that you can send to each PDL company, along with a realistic repayment plan offer. Make sure that you send all correspondence recorded delivery and don't get into negotiations over the telpehone - unless you can record it.

hi am new to all this, find it all good advice,feel better that am not the only one in the boat, i have 8 payday loans, work full time on basic wage, just started another job cleaning in the mornings to help pay bills, rolled over my loans again this, apart from wonga was due in full over £900, emailed loads of email address what i got off this website, and luckly one got back to me, extending my loan to next month no intrest added, goin to contact everyone off them this month to offer payment plan

How did you manage to get a reply from Wonga and how long did it takt? I defaulted today and reported my card 'lost' last night. Today got an email saying my payment was rejected from the bank due to insuficiant funds....not because the card cancelled...so my guess is the lost card trick dosnt work. I have £200 going in tomorrow can they take this with card reported lost?

I have rung my student finance company and they are only going to put my money in my Basic account with no visa or direct debit facilitity...praying it will be safe there but will have to wait 3 weeks for money while they wait for the change of bank details in the post :(.

Now I have no funds going into the 2 card accounts they do have how do I get them to set up a payment plan?

No responce to emails so far and when I have rung after waiting 40 minutes in a queue I was cut off!!!!!!!1

work out a repayment plan..... email companies everyday, til they accept. if it takes them 3mths to accept, kepp the money aside each month, just incase they were to be brave and try the court route......

 

Thats means you go to court, show them all the emails you sent... offering £x amount, which you can then advise the judge, you have ready to pay them....

 

Never get that far, but every so often these numptys we chance their arm.

Lex, in order to set up a payment plan, you need to be control not them. Firstly either pay directly into their account using their bank details or by standing order. Failing that use a paying in slip at the bank Do not under any circumstances give them your debit card number. . One thing I have learnt is that the Payday loan companies will push and push for your debit card details. I suspect the insufficent funds bit really meant " your card is cancelled so we cannot take the money " I have found that Halifax will not authorise funds to be taken from a " lost " card, though I stand to be corrected if anyone else has had a problem.

 

Recluse, unfortunately you are in for a hard time with 9 payday loans, but be strong. I had about 13 ( lost count ) due to exceptional circumstances, and I have dealt with all the Companies out there and their DCAs. You need to be firm and request that all communications should be in writing. A little tip that worked for me.......If your loan Company has a log in page, change your work number, home number, that way a lot of the hassle element is removed. Not all Companies have this, so you might have to bite the bullet and speak too them, sometimes this is unavoidable. As mentioned, request everything in writing and get off the phone to them asap. Above all it is you in control not them, remember this, you have nothing to be ashamed off, so stand tall and only offer what you can afford.

Just for anyone else that comes across this post.....

Im all sorted thanks to my god send of a brother...he loaned me the money and I paid them :)

I have cancelled my accounts as I have another anyway which they don't have details for (just in case!), but after a weekend of stress I spoke to friend at university today and she told me she defaulted on her Wonga loan last month as she could not afford to keep paying.

She reported her card 'lost' to her bank which was Nationwide to give her time to get her money out of her bank and open a new one......she says they didnt get hold of a penny once it was reported lost.

She then emailed balanceoffer @wonga.com and asked for a repayment plan not stating what she was wanting pay but ujst could they sort a plan..... and got a reply 4 days later with a plan to pay the balance she owed over 12 months with NO MORE INTEREST.

If only I knew this sooner it could of saved me a weekend of no sleep but at least anyone who comes across this post can have a bit more of a peace of mind.
