      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok I will shed some light on it.

Green boxes reflect positive feedback and are accumulated when other members give positive feedback.

To be the recipient of a red box means that the member has been given negative feedback.

Negative feedback is only given if there has already been warnings given about negative postings,and they are repeated.

If a member had 3 or 4 green boxes and negative feedback was given,then it would remove one of those green boxes.

But if a member has only 1 green box and attracts negative feedback,then by default it will turn to red.

The easiest way to avoid red boxes,is to take notice of warnings from the site team and comply with site rules.

In this instance it seems that those warnings were not heeded.

I got negative feedback but wasn't warned in advance. I was trying to be helpful to a newbie, but got it wrong as I seem to have misunderstood the system. Where do I stand please?

Is there any page on here that tells people how the reputation system works?

 

Not that the number of pips is the be all and end all, I am sure we all try to help as best we can anyway. But I had a look at my number of points and was given some rep by CitizenB which rocketed my points total. Presumably because she is site team or has a bucket load of pips herself. On the other hand, when new people want to say thanks, the points seem to be less than 1 per thank you.

 

And, of course, how many points make an extra pip?

 

Or are we best off not knowing !

I am not actually certain just how many points are needed to increase the green blocks.

I will try and find out and report back.

I found some info,but this was posted before the site upgrade-actually I think theres been a couple since then.

By default everyone starts with 1 green.

Further ones are accumulated as points levels increase,and hovering over yours will display a message.

 

User Novitiate 0-99 points

User Informative 100 points

User Highly informative 250 points

User Authoritative 600 points

User Highly authoritative 1000 points.

 

Originally there were a max of 5 achievable-but as you will have seen this has now been increased.

Members who have the maximum green squares and give reputation -is worth 30 points.

 

Yes it is correct that negative reputation is not something given often.

As previously said,it is given after repeated warnings have been made following a members posting content being viewed as inappropriate,bad advice,flaming or disruptive.

It can also be used for other reasons including spamming pms,links or abuse.

 

It can be used where moderation may not be appropriate.

Me too [thanks and rep points to you] Martin, thank you.

 

I don't know if this is viable, but I've seen my rep points total on my posts and never understood what they were and how they worked or accumulated. I searched high and low on the forum, because I can find most information I need, but I never managed to find rep points. I found out thanks to a kind member of the site team.

 

Is there any chance of a sticky that tells us about them, do you think? If you can send me a document, I'll even write it :). Or maybe the document itself would work?

HB good idea.Maybe you could write something using the info posted up in here over last days.

 

You should be able to see your last 10 feedbacks received by looking in your user control panel (CP) Scroll down to the bottom of subscribed threads.

At the bottom on the right should list last reputation received showing thread,date and person who gave.

Clicking on the thread takes you to the post.

There is also at the top of this list a grey bar which gives total points.

See if you can access that ok.

There is also the option to rec notifications for private messages.

Usually in that area notification is also given for new reputation rec and also friend requests.

Your current rep level points is

1101-so you are already 101 over the highest rating achievable.
