    • Today , after a lotof years i recieved a letter from this lot. Very friendly, "Were writing to remind you that we havent had any contact from you in a while".  The velvet fist, followed by  a veiled threat to get their preferred debt collectors involved. Yep dead right. In 1992/3 I took out a Student load under duress from DHSS. uP TO 2000 I hadsucessfully gotten deferment on low income. But rarther thansign on as unemployed,I decided to be self employed. I applied and they asked for all sorts of documents. I obliged and then correspondance ceased from them, circa 2001. To date  I have had no correspondance from Student Loans. I was made  redundant in 2009 and  reached 65 in 2012 , at which age the loan should have been cancelled. Now ,today, 12 years on retirement and 11 ( at least years after last contact) I get a letter with veiled threats. Do I , as I smell a scam a) ignore it and hope that Erudio will think that this phishing attempt has failed or b) respond with a statute barred letter or c) remind them of legal terms that loan should be cancelled 12 years ago or d) combination of b) +c)      
    • But I'm not mixing and matching. Sure, when researching I do check multiple avenues, but when speaking, I will open a single post. The Fb post was made in March, it is now June, time has passed, and when the suggestion was made, no further information was given on how I should progress beyond "send a letter", which has meant that I've needed to start another stream - this one, but only after taking the time to research first.
    • hes not turning you away he is simply saying that you should stick to one channel of advice. he is perfectly happy with that channel being this forum, and he will help you   all he is saying, and I agree, is that you should stick to one help channel, not mix and match 3/4
    • As long as we are clear . Do the reading and post your letter of claim in draft form as requested and we can go from there.    
    • Hold on @BankFodder, that was a bit harsh. I spoke with the EVRi complaints Facebook group to begin with, a user on that group told me to send a letter but didn't give any specifics. Here at CAG, I was looking more for specific help as I've never raised such a claim before, and wanted to be sure that my claim was correct, which is why I've researched information with the other groups too, to be sure; but you seem to have assumed that I've made some form of contact with the other groups, such that I find your comments and tone to be very unfair. And I do know a thing or two about forums, that forum users are unpaid volunteers, I happen to be a Tableau Ambassador, and so perform a very similar role helping others in an unpaid capacity

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

I have lost all my savings, well it was just about enough to have a sale price kitchen installed. There was 5,000 in about sept/oct 2010.I had to borrow money to cover my direct debits a few weeks ago. I cant believe i have no money and the bank are not really caring. They say that because it is chip and pin its me or someone I know. I have had the card replaced on about 6 occasions. I seem to have completely changed my M.O.

I have banked at the same branch and have been there over twenty years. I have never been in debt with them or even in the overdraft facility. I dont use credit cards and I am quite careful with my cash. Some cash was taken via ATM and its a lot so I rang. I have got nowhere. Its ok because there is nothing left for them to take. I have pleaded with them to see my behaviour pattern over twenty years then this last year or so. I feel betrayed and wonder why I was so loyal. I dont know what to do. Sick of ringing, tired of explaining. The kids are sick hearing about it. I am on the verge of losing my job because i cant mangage to finance some repair work so i can still be a carer.

I have found my documents in weird places. I found a set of two keys in a box, nobody knows who owns the keys, They both fit my front door. I found them nowhere near the door to my house. There is post with my name on it going to a house a few streets away. I have to say I have been frightened that somebody is in the house. I have cpp card and identity insurance, they have been quite unhelpful. Please can anyone help?

so what you are saying is that someone is committing identity fraud?

 

i take it that you have not asked for replacement cards and that someone else has done it?

 

if so its fraud and you need to contact the identity teft depy or the fraud dept of your bank

Wow thats nasty.

Over how long did the money disappear?

Did you notice the money going down or did it happen to quick to notice?

I had an ex commit cheque book fraud on my current account, order new books and hide my statements. The bank told me straight away to go to the police then the banks fraud department would work with the police.

I would also get your locks changed if I was you, then take those extra keys you found to the police, all the key cutting places will have records of when those keys were cut and police will be able to access those files.

 

I hope you find who has done this to you and get all your money back.

Thank you, I have called the police and the locks I had done because I couldn't shut an eye. The bank wont treat it as fraud, there are entries on my credit report that have been ignored. My home screen on the bank flashes with time and location then goes to trans.history. Bearing in mind I dont get the time which would help me prove it was not me, i need to phone them in to fraud one by one and they still dont do anything anyway.

\the worst is that it is so personal when I feel like somebody has been here. I have heard footsteps, well i felt the vibration of the odd step and i am sure that someone is creeping about. It is horrid. Maybe It is because i am on red alert and was being over sensitive. I have no ex who would do this as one is in another country and the other would not have the guts or risk his job. The cards have been replaced when i ring the bank to report strange activity.They stop the card and send a new one. I missed a pin which never came but I rang for a new one.

The TV liscence man came. I have a liscence and I pay DD have done for years. It is like gaslighting, i think that is the name of it. Then I failed my own security over the phone. It is not even cpp are a big let down as is the bank. That i am a customer for over twenty years paid my mortgage, single parent working hard, you think they would put in a wee bit effort. They should have been on the pjhone when my ATM got maxed as I have never done that. seven hundred pounds in two days. Yet they wont believe me.

Sorry its been going on since about 12 months ago. I contacted the bank then took the insurance out with cpp. Then in about aug.2010 I called police. I been to P.O. to check on mail. They cannot help, by law they have to deliver post to the address shown. It was a shame that because I could see that activity and if it corresponds with the ATM activity. I can only say I am really at my wits end. It would mean some one is creeping into my bag and into my purse and knows my pin too! well thats only myself. I am a bit deaf but not blind so i cannot see how its happening. My brain starts to frazzle when I think about it because there is no logic in it.

I have to say sorry about that vanishing act, it was purely virtual. I tried and tried to get in to update but ended up getting technical help from the site, so thank you so much!

 

I have been back to the police re the post but nothing can be done. It does seem odd that an imposter has more rights over your name than you do. I think that law is not good. If I go to the P.O. with I.D. I cant have it. So really this fake version of me is being given substance and authenticity by that action. This is not working out as right. I may be confused.

 

CPP, Thank you so much. They just tried to close my case! The entries on my credit report are gone, is that all. Sorry I can honestly say I never paid all that money for a clear report. They never even emailed to alert me to tell me about the linked address having another two entries for that same address.

They couldn't wait to get off the phone. Sitting here on the verge of tears. He said that he had my info there and said I have to go directly to my bank and deal with them. What is it for then all this insurance. I wish what that person a couple of slots up would have been there. Ok is complex, but can they not at least have some empathy. One day you have a few grand, then you find you need to borrow money just to cover direct debits. My head is really thumping. Going for a good cry! Then I will set about for my next round.

I could really do with that cash I paid up I spent on them (CPP) It would be so handy right now.

Hi

Yes that is right. I called the number and I spoke to a chap called *****. He asked what he could help me with and I said well I do Have a couple of things and I started to explain about the post. Then the Capital One entries appearing on my report from an address that had

 

previously been shown and proven to have had 500GBP in debt . The emails all said that everything was fine. Clearly there are problems. He said as long as the entries are removed from my credit report thats all they have to do? Gobsmacked. You can do that for three $. He tried to get off the phone with me. I Persisted in asking about my card transactions, he said you will have to go to your bank. As I said though they wont treat it as fraud and There I was Left with no answers or options.

 

I obviously never said i was from the site or that is my online ID gone too. I have my art and I think they have enough I may aswell have chucked the money in the bin and cut out the middle man. They are neither use nor ornament. It is a sad day when one is buying insurance to protect and assist should these things occur. For what? they have done zero. I did all the donkey work for thm with the linked address they found out nothing. I cant believe myself. I have got no insurance on an important thing now because i cant manage it. This is something i would never have done in the past but they let me go down to zero pounds then do nothing. So I got cleaned out and CPP and Clydesdale have left my kids and myself high and dry. Shame on them both!

Well yes, Its been like that in my house for twelve months. The annoying thing is They should be covering me for things like being had and not able to afford to do simple things like pay insurance. My job will go next I wont manage to keep afloat without the reimbursment .

 

I cant believe 20yrs loyalty never in the red ever and never defaulted on fully paid up mortgage. NICE. I dont know what to do but I dont want to say goodbye to my money. Between the two of the m (clyesdale and Cpp) it does not kill them to give me something back. Infact It is Clydesdale bank that don't keep an eye on good loyal customer.

 

The Clydesdale are pushing their preferred insurance and saying it would be the very best price 1,400 gbp annually. I went onto trhe insurers website and put in my details exactly as my policy but put jones as surname. Low and behold I could be insured by that same company for 250 pa. I want to know why this bank have sharks worked into the agenda. So the clydesdale send you out your bank card with a sticker for activation. You then get sucked into this insurance for ID and CPP

 

Well if I add the hundred fir the Id and card insurance along with say twenty quid in calls -to-the five grand missing from the bank and 1400 for home insurance.That is 6,520 that i have nothing to show for. I ean 5000 a year . That is stinking and smells of rats. I dont know what I am to do. plus the address is still receiving post...what next.

Ok I want to go over some things to be clearer,if you could answer as best you can ?

 

First some questions about the bank.

 

1.Can you say over what period these transactions that were not done by you were ?

Were they all ATM cash withdrawals ?

How many were there in total ?

 

When you first became aware of this how much had been taken ?

How did you inform the bank ?

What did they say ?

Were there any further transactions made AFTER you informed them ?

Are you aware of the locations the transactions were made ?

Have you had access to statements -have you got online banking ?

 

On the questions of mail.

 

Can you show some evidence that mail was sent to another address ?

What was the banks response when you informed them of this -and how did you inform them ?

How many times (to your knowledge) did this happen ?

Were CPP made aware of this ?

 

On the credit file issues.

 

What was the problems there that you talk of ?

How was it resolved ?

 

 

On the CPP agreement.

 

When did you take out this ?

Were you supplied with paperwork-terms conditions etc ?

Who did you deal with -CPP or the bank when this was set up ?

Were you clear as to the protection and cover the agreement provided ?

Was the agreement paid up to date when the problems with the transactions occurred ?

 

 

I think that there needs to be a course of action putting together here.

In all likelyhood I think it is going to require a subject access to both the bank and CPP.

Additionally,letters need drafting to both the bank and CPP,demanding a response.

I will help you with this.

We need to demonstrate clearly that the bank have failed in their duty and responsibility to properly deal with this,and also that the agreement and cover that you believed you were paying for to CPP as insurance/protection,turned out to be worthless to you.

Much will rely and depend on access to information that will assist to that end.

Once we have everything,together with a response from both the Bank and CPP as to what they are proposing to do,we will be better able to plan the course.

There have been cases like this where the FOS have found in favour of the customers.

There have been some high profile cases where the banks have refunded monies to customers who had it taken via unauthorised withdrawals.

Of course they are not known to do so without a fight.

What a suprise.

There seems to be lots of invitations but no action CPP.

The clock is ticking and this woman is no further forward-be in no doubt that unless we see some positive steps to deal with this,then you will have to face the consequences.

Hi

Thank you for all the support.I am caught in a moral dilemna, When I rang them after the message on here, I was tretreated the same as always. If I message through here , they are going to be different. What about all the people worse off than me, oh dear I really need the help. It seems that I have not got much choice but I will say this in advance. I will message them tomorrow morning but I will not be witholding information from the forum. They need to know that. It would have been better to have the problem solved in the beginning instead of deteriorating into this shambles. I have nothing to lose you see. My job is at risk as i need to do essential repairs. I have had deadlines for the work to do be completed. So I am happy to communicate but cpp must be aware that i am receiving support here, so i will use the info if I think it will assist others.
