Hi,

 

I have finally reciefed my microfiche reports of Abbey - some months after first subbmitting my request.

 

Should I try to claim six years charges from TODAY or from when I made the request.

Claim them from today, although as far as i'm aware you can right up until the MCOL stage (if it gets that far), where you can also add 8% interest and court fees back.

I would check which end of the 6 years gives you more charges and use that. surely is you contacted them months back you can claim from that point.

 

Also, you could raise a further LBA for anything from the most recent charges that are after the 6year window ends (if you know what I mean).

Sorry i think i posted in this one already must be going daft.

 

Claim from when you first contacted them about your charges, the S.A.R - (Subject Access Request) template mentions your intent to claim them back.

 

This is the effective date in my opinion if its not then the bank can reduce its liability ultimtately to nothing potentially by stringing the case out as long as it can.
