      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Has anyone had any dealings with Zinc Group, I keep getting phone calls from these people up to 5 times a week leaving messages on my answerphone saying I need to call them back quoting reference number ........ saying its imperative I call them back.

 

I however do not have any intention of calling them back as I know they are cowboys. What I'd like to know is how they have got hold of my mobile number and also home number.

 

How do I get rid of these harassing calls?

although telephone calls five times a week when you don't want them can be a nuisance, I'm afraid that I don't think anybody is going to say that it amounts to harassment.

 

Harassment is when you are getting several telephone calls every day and most days of the week and often including evenings. If you read through the tales of telephone harassment that we have on this website, you will find some people even talking about 20 phone calls per day. Some people are suffering from silent phone calls even though these have been condemned and even though for instance, Barclays was recently fined for computer-driven, automated silent phone calls.

 

As for the problem of where they got your telephone numbers from, DCA's are pretty good at finding out all your private information. There really not very bothered about your privacy and about your rights when it comes to this kind of thing. You shouldn't be surprised.

 

What you should do if you really want to stop this to start off by writing them a formal letter telling them that you're not prepared to do anything on the telephone and that they must write to you. They may not take any notice, but at least you have evidence that you have written to them and if later on you have to make a complaint, it is important to build to show that you have communicated and you have told them that you don't want to be telephoned.

 

The other thing you should do is keep an exercise book by the telephone and make a log of every call is received – includingwho from, the time, the date, anything that was said by any party. Actually even better than this, you should install a call recorder – preferably a trueCall which although it is a bit expensive, we'll keep your log for you, will screen calls, will block calls, will answer calls and will record them for you if you want.

They seem to have been around for about 3 years.....and the guff on the website saying words like 'self styled', 'performance control' 'modular process to increase staff head count' and their 'unique' dialler system....'blended dialler front end distribution'....so basically they do very little else that others claim to do already, and it's staffed up by ex Apex, Buchanan Clarke & Wells, Intrum Justitia, AIC employees....

 

Have you received anything in writing from them ? or have they just got your telephone number ? Make sure you write down the dates and times they call you, and if they have contacted you by writing then send them the harrassment letter (a link to which you can find in my signature below)

Dear Consumer Action,

Zinc Group keep phoning my 17year old son.

They will not talk to me to let me know what it's about even though he is a minor.

 

I think it is for purchasing BeachBody in 3 payments where the 2nd 2 payments were late due to our puppy chewing up my son's bank card and it having to be replaced - he has now paid it in full. Beachbody did state in an email that they use Zinc but on my instructions, my son paid BeachBody directly. They have, however, not sent a receipt yet - we have just requested this by email.

 

Zinc tell me that they would be breaking the law if they speak to me - is this true given that he's under 18? Any ideas for how to deal with them.

You may tell them never to phone again as it is harassment and as you son is 17 he is too young to be held liable for the debt. I would put this in writing though and then if they phone again they can be reported. You may also like to put the phone down to one side when they call again as not putting it back on the cradle will prevent the disconnect and block their line.

Given that he's under 18 the whole agreement is unlawful so tell zinc to go away in short jerky movements.
