I will be back when I have the settlement letter then, should be sometime in January 07. Did you have to provide proof of your recorded delivery? I may aswell get that back too !! I have my receipts.

I have a letter dated 19/12/06:

 

Before District Judge Singleton sitting at Gloucester County Court.

 

Upon both parties filing their allocation questionnaires

 

IT IS ORDERED THAT

 

The action be stayed until 12th Feb 2007 or until further order on the basis that there is a possibility of a test case before a Higher Court within the next few months the result of which is likely to reduce the need and/or amount of litigation in these type of cases: the stay will afford the parties an opportunity to try and settle the matter without a court hearing.

 

Liberty to apply to remove the stay

 

File to be referred back to the District Judge on 13th Feb 2007

 

This order was made on the District Judge's own initiative pursuant to CPR part 23.8. If you object to the terms of the order you must make an application to the court to have it set aside, varied or stayed within 7 days of receiving it pursuant to CPR part 23.10

 

What the hell is that about guys? any ideas????

GREAT NEWS !! I HAVE TODAY RECEIVED A LETTER OFFERING ME ALL OF MY MONEY AND INTEREST ON TOP !!!

 

I cant believe it !! its hard to imagine that if i didnt bother claiming it they would still have it !! Many thanks to all that have been here to answer all of my questions you are all great people.

 

I will of course make a small contribution to the site so that others can have the chance to get what they deserve.

I have just read the terms of them paying , they are ok, however it does say that I should make contact with my local branch to discuss my accountm so i have just done that and am due in saturday, im only doing it as then its recorded that i popped in to discuss it !!

 

Also they owe me a further £150 since i started my claim, shall i be cheeky and ask for it there and then? or do i have to go through this route again. Also if i state in a new letter that they have already paid me before will this maybe speed up the 4 month process?

They won't give you it there and then, no. Not a chance.

 

You'll have to start again - BUT - make sure you don't sign a "no future claims" term.

 

No, its doubtful that this claim will have any influance over the outcome or timeline of the new one. You'll get put through the process again regardless of whether you claimed before or not. I've just started a second £100 claim - thew prelim went last week so I should get a responce fairly soon. No, I told them where to stick their conditions (politely, of course!)

 

Others have though, and from what I can gather its just a five minute informal chat with a manager who has'nt really got any idea why your even there, or what he's supposed to do about it!

well i did make an appointment with my local branch but i was so hungover i was too ill to go in !! it was xmas time after all !! Do you think i should make another appointment?
