    • I am reading the thread now and think although its probably very similar to my predicament,  I have no way of obtaining the terms anymore due to MyParcelDelivery having being dissolved and their website not being active now. I have nothing to quote from and they didn't send me a copy at the time of order, the website that I believe they reinvented themselves as P4D has terms I am looking at now but however similar they may be I wont be able to quote from them in this case. Thanks

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

my missus got the tax underpayment letter for the year 2007/2008 for the sum of £320. what is going to happen now ? I know these are usually taken of your salary, but my missus doesnt work since last year. we had a baby in Sep 2009, she was on maternity leave but she hasnt come back to work, so she stays st home since then.

 

any help with this ?

In the past, I have been able to agree a repayment plan to pay back tax at the rate of £20 per month for a similar amount of money. Telephone up to make an appointment at the HMRC drop in center, and you should be able to solve that issue there.

 

Note, Do not trust HMRC staff to be honest. deal with them in person, not telephone, write minutes in the meeting, and insist that you both sign and date the minutes and that they keep a copy in their files. In reality the errors are usually due to poor record keeping on their part and lack of staff for workload issues, but I have proved that one staff member routinely lied to cover admin errors, and the HMRC will only correct their mistakes if you have absolute proof. NEVER LET THEM HAVE AN ORIGINAL DOCUMENT. THEY WILL LOOSE IT.

In short, they are different calculations, that usually have no bearing on other years and so can be considered in isolation. The reason for the underpayment letter now is that they have done a substantial data correction exercise on their part, and are going back over previous years to correct mistakes. In my case I had over paid by about £90, so I got a cheque this time. However in the past I have not been so lucky...

 

There are some grounds for not having to pay that tax. if the error was the fault of the inland revenue, and you had correctly given them the information is the main one, otherwise they will want paying. They will also charge interest (it used to be around 9% pa)

on the overdue amount.

 

However, they are not like the VAT man or benefits, and so are usually quite amenable to repaying slowly over a long period of time.

she received a letter today with the cheque to fill in and we're expected to pay the whole amount by the 16th of March now...we can't afford this as we're in the middle of moving houses now as we've been offered accomodation from the housing association.

 

i dont know what to do with this now...
