    • If you're set on pursuing the receiver then a complaint to his governing body (if any) might be a sensible low risk first step. You need to confirm what qualifications he actually has. I don't believe an LPA Receiver necessarily needs to be a licensed insolvency practioner, although he may be. Or he may a chartered surveyor. I note you say "LPA" and "fixed charge" receiver, but aren't those two different appointments with different remits? What relevant powers are given in the mortgage terms and security? Or if that's unclear then how was the appointment described to you? Ducking back to the comment I made earlier, you consulted a solicitor who advised a claim against the receiver. How did he advise that you do so?   Some background reading (accepting it's from 2013 and you may be working off more recent preceded overturning this) .. LPA receivers owe very limited duty to borrowers; a reminder WWW.WRIGHTHASSALL.CO.UK As lenders rely more and more on their powers to appoint an LPA Receiver, a recent case has clarified the Receiver’s obligations, both to the lender and its borrower.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My daughter and family have been posted to Celle in Germany...

She has asked me as a Sky subscrider to have sky multiroom instead of my usual basic package and when its all sorted send the second box and card to her...They already have a dish on their quarters roof..

She said its the easiest way to do it and she will pay the subscription....

Will this work ? Is it even legal, apparently its common practise for the families on camp... any advise greatly appreciated .

thats is not from Sky's website

lottiesnan:

That would be using a uk viewing card illegally and the sky account holder can be help reposnible for this

if you were to go ahead you not be able to get the multiroom discount as both boxes would need to be connected to your home phone line at all times and if not then you are charged the full price for each box.

© Only you may use the Viewing Card which SSSL sends you. You can only use the Viewing Card at your Address with the Box for which it is first authorised by SSSL to receive encrypted digital satellite services. You must only use it for private viewing purposes. You must not use it for any commercial or business purpose or in any premises other than your Address.

(d) The Viewing Card must not be used outside the country (either UK or Republic of Ireland) it was supplied for use in.

Sorry Ida, I don't know how I made that error. I googled Sky and then didn't read close enough when it came up. Can you edit it for me please.

The company is a US one and looks a bit dodgy to me, would any genuine company use an hotmail address, I don't think so. Tuvalu is a dot in the Pacific Ocean.

  • 3 weeks later...

I have to say, Sky subscriptions are rife outside the UK. Most are subscriptions operated by friends and relatives on behalf of holiday homes or ex-pats elsewhere in Europe. Of enforcement action being taken, I have only seen this in Pubps and Clubs where the public has access, and even this year I lost cound of the number of SKY HERE! posters promoting footie matches on the Costa Del Sol. On that point, there is nothing really to losr sleep over.

What is, however, is Multiroom is a nono. She'll have to pay the full subscription price and take her own reciever that does not require a call-back for On Demand or other subscription fulfillment reasons.
