First job - off to Botswana for a week to see the elephants.   Of course the paid volunteers going to Botswana are meaningless - Rwanda have REPEATEDLY said they wont take any forcibly trafficked people in breach of international law eh? Have the poops actually got any civil servants to agree to go yet - probably end up as more massive payments to VIPal contractors to go and sit there doing nowt shortly eh?    
    • Hi Wondered if I could get a little advise please. I entered into a commercial lease (3 years) and within a few months I had to leave as the business I was trading with collapsed. I returned the keys to the landlord and explained the situation and no money, also likely to go on benefits but the landlord stuck to their guns. They have now instructed solicitors to send letter before action claiming just over £4000. The lease was mine and so the debt. I know this. I have emailed the solicitors twice to explain I am out of work and that with help from family I could offer a full and final settlement figure of £1500 or £10pw. This was countered by them with an offer to reduce the debt by £400, or pay off the amount over 12 months. I went back with an improved full and final offer of £2500 or £20pw. This has been rejected with the comment 'papers ready to go to court'. I have no hope of paying the £4000 and so it will have to go to court. Pity as I have no debts otherwise but not working is a killer. I wondered if they take me to court, could I ask for mediation? I also think that taking me to court will result in a pretty much nothing per week payment from my benefits. Are companies just pushing ahead with action even if a better offer is on the table?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have posted this on another thread as it relates to issues I am having with Incasso, but not sure that wil get as much of a response. Sorry I am new at all of this.

 

I found my original (in a man draw) Customer Credit Agreement which I have asked Incasso for.

 

Can someone have a look at it and see if its enforceable.

 

It is not dated but I took out loan in 2003 time.

 

How do I find out if I actually asked for PPI cover??

 

If any details missing that you need, please ask I can supply.

Today I have returned home to find my CCA request returned with Postal order on basis I didnt sign the request - sounds like rubbish to me? How do I respond? Does this return buy them time or does that 12 days + 2 still apply - I am approx half way through that period now but worried IncaSSO MAY CCJ me at end of month!! PLEASE SOMEONE reply soon!

After a delay from Incasso/Tesco (wanted me to sign CCA request letter) I finally received photocopies from Incasso (who were passed my debt from Tesco) of my signed CCA form, with a rough copy of my PPI leaflet and what seems to be a current statement.

 

Attached to this is my copy of the CCA that I had in my draw and was able to scan this on as its clearer then what they sent me. They state in their quite snotty letter that Tescos should be sending me originals directly and wait to hear from me. Previously they had threatened a CCJ if I didnt increase my payments from £110 to £170odd a month - I just cant afford that.

 

Where do I go from here? Is this debt now enforceable? As extra to this I did also put a complaint in for miss sold PPI cover which Tesco have acknowledged. I have paid over 58% of my total debt to Tesco if I win the miss sold PPI then that would wipe quite a bit more off, but i am worried I will be CCJ'd before that happens.

 

Help - what next?

I don't think they can CCJ against you because you have a dispute with them regarding mis-sold PPI. If they try to CCJ you, you need to defend that. Reason: mis-sold PPI. Have you got all your statements so you can work out the PPI? If not you can send them a SAR request with £10. Send it recorded. All templates and spreadsheets can be found on this site. They have to respond within 40 days. Don't leave it to them to work out the PPI. You can charge them interest on the PPI. It might wipe out all the debt.

With regards to the CCA, I've had a quick glance, every thing looks o.k., no signatures, was it done online?

I'm thinking along the lines that, the PPI plus contractual interest should cover the debt, concentrate on that rather then the CCA. Recent cases have made it more

difficult to prove unenforceability.

thanks for the advice - the CCA I have on here is my copy that I had since 2003, the copy they sent me was a photocopy of their version with my signature and theirs - I just posted my good version as theirs being photocopied was hard to read once scanned. Do they still need to send me the original document?? Note your comments re PPI I will pursue that I have done calcs form via on line search -linked backed to a guy on here and potentally could wipe £6k off my £10k o/s but not sure I have done it right so could be much more!

HELP!! Returned home today to see Incasso on behalf of Tesco have issued me with a CCJ form!

 

After feeling sick for about 20 mins - what had I done to deserve them being so harsh on me, I got real and really want to sort this out properly.

 

Advice PLEASE URGENTLY.

 

As it stands I currently have a complaint into Tesco with regards to PPI miselling I cant believe they issued papers against me with this o/s. I am thinking of using this as my defence on basis that I cant agree to the debt they state!

 

I am also going to complain to the FOS about Tesco/Triton/Incasso due to their unreasonable attitude to this matter. I have never stopped paying the debt just reduced it due to my poor financial state. The complaint might not come to anything but may make someone sit up and take notice - I work in the Insurance industry and we always jump whenever a FOS complaint is received.

 

What else can I do - I have about 9 days to reply as it was issued 24/9 and only received yesterday!!

I'll have a look around and see if I can find out something on multiple agreements.

 

As far as I can recall, mutiple agreements require two signatures (one for the loan, the other for the PPI) but I can't say absolutely.
