    • Dx100uk according to the ICO office, who I spoke to at some length earlier today after getting the email from the court, Equita are the data controller if they have instructed the contracted EA. The ICO have noted the case, and stated very clearly that the court has the higher standing in terms of dealing with, and punishing either party if they fail to adhere to the district judges order and any action they take will not be criminal.    but they also stated very clearly that with what I’ve told them, and on the basis of accepting what I’ve told them as gospel (which it is with written confirmation from both the courts and the police) then there is some major red flags being raised on both sides with them blaming each other.    they’ve advised me to essentially keep my powder dry until there is a charging decision and an outcome from the seperate proceedings with the EAC2 complaint, and then come back to them with the case and they will be in a stronger position to act against Equita and the EA as there will be established facts and evidence that have already been laid before a court.     
    • urm.. i seem to recall another assault case whereby the approved bailiff company claimed the body camera was nor theirs but a pers one of the bailiff, i think they got in serious trouble for it. i believe that breaks certain gov't approval for a bailiff company/firm regulations/laws  if memory serves me right?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can anyone give me advice please with these two Payday loans, I have a loan with both of these till the end of the month .....

 

Problem is I am very stressed now as I have had serious personal problems which I do not want to go in to but I would like to pay by a repayment plan ....

 

How do I go about this ?

 

they have my debit card details ......(I will cancel this if this the best way )

 

also do I send one of the letters which are on this site with Expendeture sheet ?

 

I have found wonga payment details which will help to set up a payment from bank but do not have CFO ..........

 

I have read threads but need someone to confirm how the best way to go about this

First off - CANCEL YOUR CARD! While they have access to your card they will use it as a licence to dip into your account and drain it. Read around the forum and you'll see a lot of people have experienced this.

 

Either phone or email the companies - Wonga can be a bit intimidating over the phone so you are within your rights to demand everything in writing. I'm not sure how CFO work but with Wonga if you can pay it off in 12 months they will accept it and will hold interest. If you default the accrued interest will be added on though. Insist of confirmation of the payment plan in writing though and ONLY pay by bank transfer. Wonga will try and get your DC details but just email them every time you make a bank transfer. They will send you an automated email saying they couldn't take a payment from your card - send a stinky email to Errol Damelin, the head honcho, and they will acknowledge that you paid!

You can cancel your card at any time and request a new one. It doesn't matter how many times you do this.

 

Back it up in writing to the bank and then if anyone does take anything they are not entitled to you have proof you told the bank the card was cancelled and no further transactions should be processed on it.

 

If possible get the bank to give you a new account no... keep the old one just to pay this off.

To be honest, they phoned me at work a few times, however I work for quite a large company, I was quite sneeky and informed our IT department that they were a nuisance caller and got them blocked - bit of a tip if you could do the same!

In the end they emailed me about 10 times, I just stood my ground, I owed them £130.00, they are very stubbon and do go on about adding interest but I now pay £16.50 a month which will last for 8 months and then I offered an extra month on top to them as gratitude (making it 9 payments in total) the best contacts I have for them are

Send your emails requesting a repayment plan to Barry and copy Micheal in. I have kept to the repayment plan which is realistic and have been making payments now since March and like I said they have never bothered me since. Hope this Helps!

Sorry I forgot to mention that bit! I did cancel my card, they are renound for clearing peoples accounts, It didn't cost me anything though I just declared it lost, Also be careful not to take out any new Payday Loans they trade under a few different names and will send you various emails to try and get your new details.

No I didnt use a template, I used my own letter, my thoughts behind that were that It would be more personal. I specifically wanted to make them aware how long I had been rolling over the interest for and the fact that I thought I had been a good customer up until now and that circumstances beyond my control had put me in the position where I could not afford to keep up the payments. I did find my credit agreement and quoted all the specific dates and information for example: Date original loan was taken out, how many months interest I had rolled over etc also making sure they were aware that if they took this into consideration I had already paid more back in interest than the original loan I had taken out with them anyway! I then proposed an offer of £16.50 per month for the next 8 months to be paid by standing order on xdatex and then 1 further payment of £16.50, (but this bit is up to you!) I then finished it off with this -

 

If you are not willing to freeze the interest and charges on my account and accept my reasonable repayment offer and you threaten to take me to court over the above I want to make it perfectly clear that I will see it through all the way through, and claim costs from yourselves if you do not.

I request that any correspondence is to be sent in writing, I have attached a letter reminding you about the consequences of telephone harassment.

I did find the telephone harrasment letter from this site, just type it into one of the search engines you will find it or maybe another cagger could give you the link?

One other tip is to send your letter by recorded signed for delivery, It will give you peace of mind that they received it and they will be unable to deny the fact that they dont have it, the best address for them is

A Quick update I have asked for a Repayment plan from Captial Finance One and this is the answer I receive today !!!

 

 

We refer to your email and wish to advise you that if you wish to set up a payment plan, the cost including late fees and interest will be £680.

Please note that we are a short term payday loan company and therefore we will require the repayment over a shorter period than 9 months.

What shall I do now stick to my guns or look into paying more over less period!

I would send their reply to Trading Standards via Consumer Direct, it is grossly over inflating the original sum owed and they cannot be allowed to 'get away' with that type of letter when customers are in genuine difficulty.

I just e-mailed back to them and said I had asked that everything to be frozen intrested etc and this is the e-mail back !!

 

 

Please note that interest and late fees will be accruing on top of the original £520 to be repaid if the loan is not paid back 30/7/10.

This is as per the agreement signed.

Kindly note that the interest will be frozen at £680 for the term of the repayment,which we will need to be over a shorter period
