    • Well the difference is that in all our other cases It was Kev who was trying to entrap the motorist so sticking two fingers up to him and daring him to try court was from a position of strength. In your case, sorry, you made a mistake so you're not in the position of strength.  I've looked on Google Maps and the signs are few & far between as per Kev's MO, but there is an entrance sign saying "Pay & Display" (and you've admitted in writing that you knew you had to pay) and the signs by the payment machines do say "Sea View Car Park" (and you've admitted in writing you paid the wrong car park ... and maybe outed yourself as the driver). Something I missed in my previous post is that the LoC is only for one ticket, not two. Sorry, but it's impossible to definitively advise what to so. Personally I'd probably gamble on Kev being a serial bottler of court and reply with a snotty letter ridiculing the signage (given you mentioned the signage in your appeal) - but it is a gamble.  
    • No! What has happened is that your pix were up-to-date: 5 hours' maximum stay and £100 PCN. The lazy solicitors have sent ancient pictures: 4 hours' maximum stay and £60 PCN. Don't let on!  Let them be hoisted by their own lazy petard in the court hearing (if they don't bottle before).
    • Thanks for all the suggestions so far I will amend original WS and send again for review.  While looking at my post at very beginning when I submitted photos of signs around the car park I noticed that it says 5 hours maximum stay while the signage sent by solicitor shows 4 hours maximum stay but mine is related to electric bay abuse not sure if this can be of any use in WS.
    • Not sure what to make of that or what it means for me, I was just about to head to my kip and it's a bit too late for legalise. When is the "expenditure occured"?  When they start spending money to write to me?  Or is this a bad thing (as "harsh" would imply)? When all is said and done, I do not have two beans to rub together, we rent our home and EVERYTHING of value has been purchased by and is in my wife's name and we are not financially linked in any way.  So at least if I can't escape my fate I can at least know that they will get sweet FA from me anyway   edit:  ah..     • urm......exactly what you filed .....read it carefully... it puts them to strict proof to prove the debt is enforceable, so thus 'holds' their claim till they coughup or not and discontinue. you need to get readingthose threads i posted so you understand. then you'll know whats maybe next how to react or not and whats after that. 5-10 threads a day INHO. dont ever do anything without checking here 1st.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'm just about to get my DPA sorted out for sending in the morning but got a question that I just can't find. Is it better to send it to the Trinity Road address as that's where I'm likely going to send the letters? I've had a good read about and think I have it all in order right up to going to court with my N1 (I use Visa Electron and have read they don't accept online plus I'm on benefits)

I'm nervous but looking forward to this

Yes send it to the Trinity Road thats there head office.

 

as for the N1 claim if your on benefits you might not have to pay. but you won't be able to claim online, you will have to fill in the n1 forms and file them at the court.

Ok DPA sent today at 12pm now to a question I know you give them 2 days but with tomorrow being saturday and then obviously sunday do I take the 40 day count from Monday (counting Saturday as there is post) or Tuesday?

Just an update still not heard anything about the DPA but I know they recieved it on the 04/09/2006 as its showing on the tracker but now I find that they have cancelled one of my direct debits not that I'm too worried as the company that they cancelled called me about it and are ok with it as tomorrow I've got to hand in ID to another bank to get it up and running so everything will be changed over so Halifax can do what the heck they like

They have 40 days to comply some get them within a couple of weeks some take longer you just have to be patient im afriad as for your other questions in the mean time look around the site and read the FAqs and step by step instructions, get yourself prepared, altough others will help you you still have be prepared to go to court even so you do need to swat up

Yup I'm reading,reading and doing more reading I'm reading the same thing every day just to make sure I know what I'm doing the only thing I need to find out is as I'm in Northern Ireland my claim will be lodged if it gets that far (which I think it will) what the highest amount is that I can claim here to keep it in the small claims court as I can't find anything on the site about that but hubby is gonna go down to the court house in the next week or 2 to find out for me I'll post in here as soon as I find out so others from Northern Ireland know for future reference

Well just an update........

 

Just called Halifax to see what is happening with the DPA to see if they have made any moves on it yet to have a woman on the phone asking if I had heard anything at all to which I told them no not even a letter saying they have recieved it but I got in there with the recorded delivery part to which she then asked me to hold while she made a call to another dept to find out whats going on. Kept waiting for 10 mins. She then came back say that they have it (which I knew they did royal mail has it signed for) and my request will be dealt with in the next 2 days. Amazing what a phone call does for a chase up.

well come tomorrow they have 7 days to comply with the 40 days (thats giving them from when THEY recieved it NOT when I posted it) i was thinking of sending a reminder letter that they only have 7 days left to comply (I know they have held off till the 39th day in some cases) as I haven't even recieved a letter to say they are dealing with it and just to let them know I haven't forgotton and I'm counting but has anyone got any ideas on what to write I can't seem to find a template letter only ones for if they have exceeded the 40 day limit?

Well eventually got the standard letter thanking me for requesting specific information blah blah blah and the statements will be sent under seperate cover I mean they must be bogged down with requests it only taken them from when they recieved it on the 4th of Sept till the 7th oct to actually deal with it but if my calculations are correct they only have till next Saturday to get them in my hands oh am I glad i can wait it will be a nice christmas in my house this year

Well to my calculations their 40 days are up today I'll give them till Monday's post but that's only cos I haven't time to get to the post office before it closes then I'll send the letter before action to get by statements. Has anyone actually had to take it as far as court to get them?

Personally for what it is worth if you are sick of waiting, I owuld ring them up and quote the fact that you are now going to issue court proceedings for non compliance of the data protection act, you are going to formally make a complaint to the Information Commisioner and also get a court order which will make them liable for further costs to ensure you get the info you require, I bet it makes the sit up and take notice, it is unusual but not unheard of for them to go past their 40 days, looks like a cock up to me somewhere in Halifax!

Give them a call tommorow and see what happens, tell them you want them in 24 hours or you will not communicate any further and will carry out what you have informed them you will do!

Of course you DON'T have to call them, some ppl prefer not to but if you are any good on the phone and are sick of waiting it may be an option!

Thank you Sharon I think I'll give them the 7 days on the Non Compliance letter that will take them till Wednesday as I know it's been delivered on the 18th as it's on the royal mail site already then I'll phone them after I see if I have post I'll give them from there a 24 hour period to get them to me if they haven't I guess it will be off to court to make sure I get them :)

Phone call made as sick of waiting didn't speak to the person that sent the letter telling me duplicate statements would be sent under different cover. Well in my best professional voice but annoyed waiting voice I explained about me sending the S.A.R. and it saying in it 40 days to comply which they have failed to do so I then sent the L.B.A. which as I know for a fact they got it last Wednesday which in turn means that their 7 days is up on Wednesday and at the moment I have recieved nothing. Well he took my account details and told me he would call me back when he found out the info. Well I wasn't holding my breath as I was told this on Thursday. Well as I was writing this he called me back to go on to explain they are normally sent under different cover (well duh the letter said that) and that he has just ordered them to be printed out NOW and to have them ready for posting by 2pm as he is going to post them PERSONALLY at 2.15pm. Now if he follows through I should have them for tomorrow or Wednesday at the latest. And I got a "So sorry these weren't sent out sooner my appologies"

 

Not bad considering I only wanted to remind them they have 48 hours left to comply with no further contact

well would you credit it statements arrived on the 24th (Tuesday) as promised in phone call calculated up a nice tidy sum of £1455.87 before the interest gets added on well would you know that yet another load of statement arrived on Saturday which are the same ones that arrived on Tuesday will someone please tell them I only needed one set. and today they decided to add on yet another charge oh well I'll just have to add that on. ;)

Can anyone help me here? I recieved the above letter yesterday and today I recieve a letter telling me that if my account doesn't come up to a plus balance by a certain date they are threatening to close it. its because of THEM that I'm in the red in 3 days they took £106 in charges. Don't get me wrong it will be in a plus balance by Monday. But like yesterday no money for me and my family to live on.

01/09/2006 Data Protection Act sent

04/09/2006 Data Protection Act recieved by Halifax

28/09/2006 Called Halifax to see if they have done anything about Data Protection Act letter

17/10/2006 Non Compliance LBA sent

23/10/2006 Phone call made

24/10/2006 statements arrived

24/10/2006 prelim letter sent asking for return of £1455.87

08/11/2006 LBA sent ;) court next :p

Can anyone help with the above letter is it a standard letter? I'm getting ready to get my LBA letter ready tomorrow night any help would be appriciated :)
