hi, i was wondering if anyone could help me, i recently had to cancel a direct debit to speedloan finance cancelled with bank on 14th july, my parents recieved a letter of speedloan finance, i have wrote what was said in letter - (To the family of Mr ............, i have recentley been informed of the death of Mr ........ and would like to offer my sincere apologies. I understand this is a hard timefor you all, in respect to the speedloan Mr ........ had taken out we require a copy of the death certificate in order to write off the loan in full and avoid us having to make any unneccessary contact with you. Kind Regards) I contacted speed loan and was told it was my bank who had informed them but i have spoke to bank whom have proof that they hadnt informed speedloan of this, do i have a case with speedloan or should i just leave it, this has had a affect on my parents recieving a letter like this.

Hi nobby,

 

I think you have a case for the anxiety and hurt that the letter has caused to your parents. It might be worth contacting one of those

no win - no fee lawyers. I think some sort of compensation is due,

but I couldn't put a figure on it. The lawyer might disagree.

Cancelling your Direct Debit is one thing - but to receive such a reply is another - the bank could be seen to be the culprits of the distress caused to your parents - but proving the distress caused may be difficult.

 

Distress and suffering for a genuine administrative mistake? Is it really worth it (yes...if were in the USA... not really.... as we are in the UK)

 

If your parents understand the situation and you can easily clear up the misunderstanding then I can't see that there is any real merit in you taking the matter any further.

 

Just my logical thoughts of course.
