    • I had to call an ambulance for my wife, but one of the paramedics was not happy, about the condition of our house, as it's cluttered. And he  would only see to my wife, on the ambulance itself. After diagnosis they took my wife to hospital. My wife was ill for a few months, and received help from the district nurses. We then got a call from a social worker, who wanted to visit us, and discuss ways to make my wife more comfortable. When I asked for more details, she became vague, but could give us a phone number, if she visited. I politely declined her offer, as I was coping, along with my daughter in caring for my wife. Then a letter arrived from another social worker, saying similar things, to the first. I didn't bother to reply. Another letter has just turned up, from the social services legal department, which doesn't say anything specific, but refers to the other social workers trying to visit us. Coming from a legal department, has badly upset my wife, who's recovery was on going, and she now fears that someone will be coming to the house, to do whatever. Do we have to respond, or take notice of these people. Also we recently had a fire prevention officer come and fit, smoke and heat detectors. He didn't voice any concerns with the conditions at the property. Worried, Paul.
    • By not sticking to the deadline which you set you have lost credibility. Your letter of claim becomes one of hundreds of others which they receive and which they put in the bin because they think that you are just bluffing.  
    • 05.05.24 Ever so sorry if I have entered this in the wrong part of this website.   My grandfather is in his 70's and retired.  He asked me to help him find a work pension that he was paying into when he was working. From 1967 - 1982 he worked for a Fabric Dying Company, Celanese, Spondon Derby UK. I have already used the GOV.uk Trace Pension Scheme. It listed a few pension companies : Akzo Nobel (CPS) Pension Scheme formerly Courtaulds Pension Scheme.  I do not fully understand how this works but I think this scheme is administer by a company called Willis Tower Watson. We have called this company, got through to the pension department submitted all my grandfather's details (D.O.B. , N.I. no. etc.) but that agent tells that they have no record of my grandfather and ask what is the name of the pension scheme. Here is the problem, his home was burgalled in 2005 and a briefcase which contained his legal documents was stolen. So he does not know who was the Pension Scheme company. I have a this phone number 01332 681 210 for Celanese but it just rings and never gets answered. So I am asking for help if anyone can tell us where we can try next. I am also hoping for a massive long shot that one of them members on this website, worked for or knows someone who worked for British Celanese Spondon Derby and could tell us of any pension company. Thanks for any help.
    • Well I sent them the letter of claim, the only responses so far was a few emails reopening the claims on the parcels where they asked for information such as proof of value (which I get) but other things like photos of the parcels, which I haven't got as I never took photos of them. It's been well over the 14 days since I sent the letter now anyway, so what do you think I should do now?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello,

 

Im looking for a bit of advice regarding an oustanding court fine, ill fill you in on the story.

 

Back in may 2002 i passed my driving test age 17, my parents bought me a car and paid for my insurance, as all new young drivers i took to the streets most nights with friends and drove for hours, because i was a young lad in a new sporty car i often got pulled over by the police i say often what it really was was harrasment, in 1 week i received 21 producers from 4 police officers it seemed ike they made it there mission to pull me everytime they spotted me.

 

Anyway i took the producers to the local police station and produced, 4 months later i was dragged in front of the magistrates court for failing to produce my driving license and insurance certificate, it appears with the many tickets i received i had mis placed 1 and failed to produce, i was no longer driving my car at this point and did not have an insurance certificate as it was given back, i also had not sent my provisional back to the dvla to be converted into a full liscense but i did have my pass certificate, the courts allowed NO time for me to get a letter from insurance and proceeded to with the charges of No insurance and no liscense i received 6 points on my liscence and had to retake my test, i did not attend court due to health reasons but did submit a letter to the court, i wasnt made aware of the outcome for a further 9 weeks during the latter 4 weeks i started to drive again and was again pulled only this time arrested for being what effectively was a ban. I received a further 3 points and a £280 court fine, so that 9 points on my new fairly new liscense and court fee's totaling £700..

 

A few yrs passed and i continued to drive knowing i held no ledgitimite driving liscence i was very sour about what had happenedsince i had passed my test before cut a long story short i was stopped again and prosecuted for no liscence my own fault i now i was young and immature any way they placed my on Tag for 9 weeks and ordered me to pay a further £300 add that to the previous driving fines that had gone unpaid totals £1000 a yr later i thee was a no bail warrant for my arrest for failure to pay i was arrested and hauled before a judge quite rightly and they agreed i could make affordable monthly payments which i did for 2 mths then paid the balance off out right this was back in 2005.

 

3 weeks ago i received a court letter and a date that had already passed, i was rarther confused as to what this was all about since i have been legitimately driving since i passed my test again (when i grew up) in 2008 i contacted the courts and they inform me that there was an outstanding fine for no liscence and insurance dating back to 2002.

 

To my knowledge i had paid this fine off yrs ago but i have no proof any longer that it was paid they tell me i have to pay this fine or they will issue another no bail warrant and will be hauled before the judge again, now this at my age now does scare me i have left all the ignorance behind me and i am a law abiding citizen BUT i wount pay a fine i have already paid.

 

 

Can anyone give me any advice about what i should do now because i am losing sleep over this the courts said i could face going to prison if this isnt dealt with in 7days and there is also now a failure to pay warrant for my arrest :eek:

 

it is now 8yrs ago since the actual conviction even though i DID pay it how can they chase me for it 8yrs after? Can anyone give me any advice on what i shud do please.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
