I have a very strange scenario. I had a phone call from someone who said they were from jbw & i owed £618 on a road offence which apparently they wrote to me about. I dont know of this offence as i have moved from my old house 2 years ago. However this is where it gets strange. This offence was supposed to have happened last May 2009. Yet in october 2009 my car was clamped at work for so called outstanding parking fines up to that date. I had to pay over £900 to get it released and this was supposed to clear the fines. Now i have this alledged fine that has no PCN but apparently is a total of £618 for an offence last may. I got the call at work so i offered to speak to the council in question to find out more about this fine as JW had little info accept ot disagree that it may have been for something 2 years ago not last year. Anyway during conversation they told me that this fine does not relate to my accident in hackney. but surprisingly they said they could see i made " a category B claim on my insurance " on April 17th 2007. This is where it gets very strange (apart from not knowing what a category b claim is) I didnt own the car at that time.

I left it at that,readying to contact hackney later on, but befor i got home i recieved a text telling me my car had been impounded and taken away. I called to ask why i was not given any time as i already explained i knew nothing of these charges. But i was told, as i had refused to pay my car was taken away.

I explained that i had to check it out first and that i did not have a spare £618 in my account anyway so i could not have paid even if i wanted to.

It gets worse. I left the car with them as i do not have the funds to pay and when i got a loan from 3 friends i called to retrieve my car. I was not answered and so i text to say if i can have my car back, still no response. So now not only do i have no car to do school runs or get to work but even after begging for loans i still cant get it back. I had asked them where the car was so that i could retrieve my belongings from it until i had the funds to take it, but i was told "due to some confidentiality law" he was unable to let me know, where the car was.

I am in limbo.

Can someone tell me what is my next move. Tecnically they have stolen my car as they will not give it back or tell me its whereabouts. I genuinely have not received any letters as i had moved by may 2009. But the strangest part is that i have already paid £900 for the same thing. What is going on.

This is extremely COMMON.

 

For this PCN and the PREVIOUS ONE you need to file an Out of Time late Statutory Declaration. All enforcement will have to CEASE. The bailiff cannot charge any further fees and neither can he sell the vehicle.

 

An Out of Time can be completed even if you have paid a bailiff or had a car sold by bailiffs years ago !!!

 

You need to telephone the Traffic Enforcement Centre on 08457 045 007 and they will e-mail the forms to you.

 

You need to do this IMMEDIATELY.
