    • Does anyone know if I would be allowed to record conversations with health professionals for my own use on my phone without them knowing. I know that we are allowed to record phone calls. I do record some of my phone calls for my own use due to my disability and if anything is said then I am covered. I would only record audio in private area's of myself and the professional dealing with me. I know I could not get and other persons audio in it and I don't intend to. my only other option is to buy a body cam but I am not sure the rules regarding this.I never thought i would have to but things are getting worse Thanks for any guidance

    • Ok thanks for that, well spotted and all duly noted. Yes they did eventually submit those docs to me after a second letter advising them I was contacting the ICO to make a formal complaint for failing to comply with an earlier SAR that they brushed off as an "administrative error" or something. When I sent the letter telling them I was in contact with the information commissioner to lodge the complaint, the original PCN etc quickly followed along with their excuse!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello. I have moved this from lloyds to PPI section. Wondering if you can help. My mother has 2 Lloyds credit cards (Llyods and master card) that she has been paying for last 15 years. Now she can only afford the minimum payments and stuggling as she is on pension credit. I was hoping to reclaim ppi for her but after looking at her credit card statements there is no mention of PPI it just says interestlink3.gif. My mother cannot remember if she took out PPI or not. Is there a way to find out or should it say PPI on the credit card statement.

Thanks Dx. I will send off the CCA requests today as she has had a few late payment charges too over the years.

 

If there is no PPI to claim back i want to at least try get her credit card payments down as she is only on state pension credit and dosent even use her credit card that much. She is in a minimum payment trap and paying £200 per month for years without her balance coming down. I have only just seen this and was shocked at what shes been trying to pay each month out of her pension.

Not sent off CCA yet. i have been reading the posts over last few days regarding CCA requests am still at early stages of convincing her to have a look at the posts on the forum regarding this before sending them off. She has always had good credit and not so easy to convert her to the dark side lol

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi Dx. I think its about 11,000 total over the 2 cards. It's just under £200 pcm paying around £90 for each card, with about £20 of this being offset against the balance. She's being paying the minimum payment fee but she said sometimes paying just under the minimum fee. I can get the exact figures tomorrow.

Banks are out for themselves. My dad didnt speak to me for a week when I started disputing a card :eek:, hes been with companies since 1955 and wont move despite the massive savings.

 

However shes probably paid the balance a few times over. I was at 1 point paying £300 a month and it was dropping about £10 a month, balance had been paid 3 times over so I had no issues with disputing. Wasnt wont pay but cant pay and something had to give.

 

If she has a good credit history and is able to and doesnt want to play any sort of game + has to be serious about paying it off, she could apply for a 0% card and try and make inroads just cut it up and never spend on it. Then reclaim any charges from the others and put them towards the new card. Only problem is she does have a lot of existing debt.

 

Are both card Lloyds?, just seems wierd having 2 cards from the same bank. :-)

Hi Craigbadger. I think one is master card and other is visa. I think she knows very well now that she will NEVER be able to pay off the credit card. The card just acts as a comfort to her to use in emergency. I will definatly get the CCA sent off once i get her permission as it would also be a comfort to her if it's not enforcable agreement and also look into switching to 0% card option.
