I am behind on my payments to Egg and I have written to them, informing them of reasons and the solution I am seeking. They have made quite literally more than 100 calls to me in the space of about 8 weeks.

 

They sent me a letter recently saying they still wanted to 'help' and I should call them, or they would pass my account to a 'specialist agency'. On the same day, I received a letter from Capital Credit Agency, who are shown on the letter as being a trading style of Egg. This is clearly the 'specialist agency' they threatened. Their letter is dated the day before the Egg letter mentioned.

 

Would this be a matter for one of the Ombudsman departments?

 

I intend to clear the account within the next couple of weeks, would this be the kind of thing to use as a lever to a lower settlement figure?

 

Any thoughts or experiences welcome.

I would explore a CCA request for your agreement to see if its enforceable. Basically the older it is the less likely it is to be enforceable. If its not enforceable then THAT is a lever to get them to settle at a lower fig, though I understand (ie it appears from other posts here) that Egg are quite difficult to deal with.

Yes Egg have traditionally been difficult to deal with,but the card portfolio is now in the hands of Barclays.

Capital is an in house collection arm of Barclays,and although communication will show the Derby PO Box number,for communication,on Barclays Consumer Credit licence (which Capital appears on) the address is;
