Wish you luck with Barclays. Im a victim of fraud Oct 09 and still no joy today. Letter received from fraud dept 25 Jan 10 holding me responsible for all transactions. On 6th Feb 10 letter received credit card now cancelled. 13th Feb 10 debit card declined, tried ATM card taken. Went local Barclays letter in post informing me accounts all closed.

 

I have tried endlessly to get advice as i do not knowwhat else to do, I feel so depressed £16,000 taken from account, Barclays are unable to produce voucher for monies taken over the counter, £9/800 in store and £300 x3 ATM.

Barclays are not willing to refund the monies taken from my current account. Apparently the senior investigator of Barclays says it was the original card was used to make the withdrawals, which I found hard to understand considering the card was on my person.

 

21st December 09 telephone called received from Barclays I have to wait for final decision when officer returns from sick leave. Four weeks later 21st January 2010 I called Barclays for an update and was spoken to in a matter that left me speechless, which I complained about. 25th January 10 letter received credit card cancelled, which has never being abused. 13th February 2010 debit card declined instore, tried ATM card taken, went to local Barclays, was told stop put on account 11thFeb.2010 letter sent 12th Feb,2010. No letter received to date. I am next of kin on my parents account, Barclays has put all accounts under my current account sort code, advised them several times this is incorrect, now letter received mums accounts will be close 2nd March 2010 is this correct considering the fact the accounts are in my mums name and her details will be registered and they will not do any more business with her. Is this correct?

 

I went to the police today and was told officer still off sick may not come back to work, case will be assigned to new officer, I will have to wait. Again no joy. The officer also informed me the reasons why I have not heard from the police is that Barclays is the victim in this case and I will have to wait near the end of the investigations.

 

Everywhere I go for advise I am knocking my head against the brickwall, Can some please help me

Hi Jamming,

 

You need to keep communication in writing, not phone calls. Any calls which you've had, you should make brief notes including the time and date of the call.

Was this from Barclays in writing or by phone. If you had your card throughout, I assume the card has been cloned.

 

Have you received details of each withdrawal or purchase so you can work out where you were on any given occasion. You only have to be able to show you were NOT at the point of sale or withdrawal on ONE occasion to cast doubt on their assertion that YOU are responsible.

 

Were the transactions carried out locally to you. And were they all carried out in the same general area, whether this was near to you or not.

 

If you want the police to assist with your case, you may have to push for their help.

 

Barclays are not the victim as said by the police - it is YOUR money that has vanished. :mad:

 

And all the banks are keen to keep quiet about how much cloning and other a/c fraud goes on.

Barclays has stated in their final decision after their investigations the original card was used.

 

I have not received anything from the Fraud Team as to my whereabouts whilst the transactions were taking place. I had to go to my local branch requesting a printout of all the transactions to take to the police.

 

Transactions were not done locally to me, and not done in the same area.

 

Police did not seem to bothered to rush anything as I was told yesterday Barclays is the victim.

 

Considering Barclays cancelled my credit card 6th Feb 10, I contacted the Ombudsman 8th Feb 10 who wrote of complaint on my behalf. I received a letter from Barclay card 16th Feb 10 informing me my card has been cancelled as I no longer meet the new requirements of having a card and they are not prepared to discuss the cancellation. The letter also stated this is their final response and I can contact the Ombudsman if I wish to. A copy of the letter sent to Ombudsman to investigate. Barclays seems to be having a joke, what about innocent until proven guilty?

Barclays and the police will take little notice until you show that you are not prepared to accept their disinterested attitude.

 

You are the victim of a £16K fraud and you need to build a case for yourself, which you can show to the police, or to the courts if you decide to sue the bank.

 

You need to demonstrate that the spending was not in line with your usual patterns regarding amounts, location, types of purchase.

 

If you can identify individual transactions with date and time, you can then contact the banks, stores, etc to see if they hold CCTV footage.

 

If you don't have fully detailed info about the transactions, write to the fraud dep't and confirm:-

 

1. You do not accept their finding that the original card was used, as you had it in your possession at all times. You therefore require whatever evidence they have about this, so you can pass it on to the police.

 

2. You are actively involving the police to properly investigate the circumstances in which you have been defrauded of £16,000.

 

3. You require precise detail of each transaction including date, time, item purchased, shop or bank address, whether customer was present, etc.

 

If they refuse to provide you with the info you need to prove you are the innocent victim of fraud, complain to the FOS accordingly.

 

The FOS may also be disinterested, which is why I say you must be prepared to investigate this yourself. You must make the best case you can to show you're the victim here.

Thanks...called FSA yesterday after reading FSA Money made clear, was a bit shocked with the response, basically Ombudsman seems to be the best at present as that was the direction FSA gave me.

 

Apparently I have to wait 8 weeks for Barclays to respond to my complaint from the Ombudsman, but I am making notes based on your response above. Do you have any more input?

 

I have written a letter on behalf of my mother to Barclays requesting why the closure of her account. To date I have not received any notification about my accounts even though credit card closed and debit card taken by ATM. Any suggestions? Shall I close the account or be difficult and wait for the notcie?

The sad thing about the whole situation is I do not have a name or contact number of somebody I can speak/write to who could make any sense of the whole situation. The attitude of the staff within Barclays makes me wonder how did the get their job. Nobody can give me the name, number or e-mail address of the head of services for the fraud department. Only number I have for the Fraud Team is the number of the officer who decided I am responsible. Were talking about a large company world wide!

Re your mother's a/c, are you a named user on that a/c.

 

If so, would it be an option for you to be removed from the a/c so that her banking facilities can remain.

 

Re your comments about the Fraud Dep't staff, it is probably in their interests to be unhelpful and divulge as little info as they can get away with.

 

That's exactly why you have to show determination - so they realise they cannot just shrug you off. And you'll have to show the same attitude with the police if you want their involvement.

Opened an account with HSBC today, had to fax id and proof of address will know outcome Monday. Went to Barclays there for over 2 hours. The person I saw was very helpful as he had raised a complaint 1st Feb to get an overal understanding of my account to date he has not received a response. He also queried the closures of my accounts which he said was not normal and considering I have been banking with Barclays over 22 yrs. He was told I did not meet the new criteria!. Also there is a large investigation going on with my account at BARCLAYS as FOS now involved.

 

Will be going back Tuesday to withdraw all monies.

Still no joy today, had a lot of probs when taking my onies fron Barclays I have written a letter to Chief Executive a week ago Response received advising me there is an ongoing investigaion.

Hi

 

Good response for Jay. Unfortunately HSBC declined my application in the end. Account is with Halifax.

 

Latest update Omnbudsman called me Tuesday of this week, an officer has now taken up my cases and all relevant paperwork I have from Barclays has to be sent to the officer no later than 23rd March.

 

All accounts now closed with Barclays closing statements received today. All the fraudulent transactions are not showing on statement. the option for me to give my whereabouts whilst the transactions were being carried out was not given to me.

:|:evil: Hi No joy, Barclays sent final response letter still hold ing me responsible for the transactions on account. No mention of cctv footage, no mention of missing transaction slip on Barclays side. Its also mentioned all security questions were answered correctly after full in vestigation system show correct card was used in all transactions. No other monies were taken after I reported the incident.

 

Jay sent a link for a solicitor which he mentioned helped with his Barclays cased I called last week but no one could assist or no one worked at the office by the name Jay gave me.

 

Guess I will have to start all over again, bit upset having to deal with all of this just after burying my mother.

When I went to the police in March I was informed I am not the victim and they will liaise with Barclays as they are the victim, also the officer dealing with the case was still on sick leave.

 

Dont think I will inform the ombudsman of the outcome, not very happy with their response when Barclays closed all my accounts after 22 years.

 

Next week I will try to find a solicitor who deals with this kind of case.

 

I feel as if I am going crazy, I cant handle any more stress losing my mum suddenly is enough to deal with right now,

I understand what you're saying and hope you can find a solicitor to help, if that's what you need to do.

 

I did say early on that the police would need prompting to be involved and helpful to your cause. They will only take this further if you insist that you have a right to have them investigate because YOU are the victim and not the bank.

sorry for taking so long to respond. Finally found a solicitor who will take up my case at a fee of £240.00 per hour and I have to put £500.00 plus vat into his account as they only work for private clients. Will be going to the police station tomorrow.

Hi All

 

Had a few issues to deal with my mum passed away in April, just getting back to normal whch is a bit hard. I have post all paper work to Ombudsman as solicitor suggested the costs would be too costly and should use Ombudsman first. Just awaiting a response.

hi jamming,

only just read your thread.

first of all take my love to you and to comfort you in your sad loss, i know exactly how you are feeling.

it is enough to deal with losing your dear mum, god bless you.

 

the events and situation you have had and the way you have been treated are a disgrace.

 

best advice as i see it, and what i would do, get as much paperwork, evidence, on what you can and have got, the facts, and evidence you may already have.

ring a private investigator who deals with fraud, have a word with them first, see what they can and cannot do for you, and see what they would charge, this is a specialist area, that is where i would start and explain to them the steps already taken with the bank, etc, etc, and what has or has not happened, and where you are up to now with everything, unfortunately it costs to go to people whichever way you go, but their may be some that charge less than others, exolain about just losing your mum, and you need some help with all this what has happened with the bank, you cannot simply be fobbed off by anyone with something as serious as this, and you will have to be strong and stick to your guns, try and get as much evidence as you can, everything in writing, do not ring

the bank, get it in writing, and send recorded delivery everything to them.

also libraries are also a great source of information for all sorts of things, and some have offices for consumer problems too.

or you could even have a word with your local councillor, some are extremely helpful with all sorts of problems.
