Just over a week ago my son went to DFS to look at sofas. He was moving from a furnished flat into an unfurnished house so needed sofas. He was told that it would take 14 weeks for delivery. When he advised them that he could not wait that long as he needed the sofas immediately, he was told that they would loan him sofas until his ordered sofas were delivered and took a £50 deposit as security against the loaned sofas. Also, when he placed the order he advised them that he was not sure of the size of the living room so ordered two 2-seater sofas as he was not sure if a 3-seater and a 2-seater would fit until he had the keys and could measure the room. He was told that he could change his order if he wanted to change one of the sofa's to a 3-seater. He moved into his house on Saturday and having measured up, now wants to change one of the sofa's to a 3-seater. He has rang DFS today and has been told that he cannot change his order and that furthermore they cannot guarantee providing him with a loan sofa. Where does he stand - can he change his order as he was told he could and furthermore, if they cannot provide a loan sofa, is he within his rights to cancel the order as the order was placed on that basis that a loan sofa was provided (and a £50 deposit was placed for it). (Had the loan sofa not been offerred, he would not have placed the order as he cannot wait 14 weeks without anything to sit on!)

As for changing the order: I doubt he will be able to do anything about it, it's on all the paperwork that the order can not be changed, reason being, they are made to order and shipped from China (hence the 14 weeks!), they all do it, Land of Leather as was, DFS etc... So it will be his word that that's he was told against what he signed for, check the docs, I think you'll find it there. :-(

 

Re: sofa loan, if it was made an express condition of the purchase, then he can probably argue that they are not completing their side of the bargain and that therefore gives him the rght to cancel, but he'd better be ready for a battle, as again it's going to be their word against his.
