I have just contacted Haliprats oop's i mean fax, they have only gone and charged me £58 for going over drawn by £2.68!!! They then have taken a previous charge of £30 so now i am over drawn by £32.68 and again they have advised me that they are now going to charge me a further £58 for the pleasure. :evil:

 

I have contacted them by phone, and in my frustration, as they said they could not do anything as i had a good will jester last month, i have requested for 6 years worth of statements as i am seeking legel advise (perhaps the wrong move).

 

They have agreed to send them and advised me it will cost £5 not the £10 as mentioned on your site?

 

Could you advise me if i have told them to much in my frustration???????

There is nothing wrong about being totally open with them about what you are doing. This is true transparency and they won't really know how to handle it.

You are claiming your money, not setting up an ambush.

 

However, do be prepared for retaliatory action. Get a parachute and be sure that you can deal with an account closur and an ovedraft recall at shortish notice.

Dear All,

 

Recieved 33 letters today, 6 days from requesting them,containing statements for the past 6 Years, best £5 i have spent in ages.

 

Currently going through statements and I have noticed that each month there is a note stating 'interest debited-notified last month'.(which I have never been notified of).

 

The figure varies from 96p to £2.50. I assume that this is the interest they are charging me for going overdrawn. If so, am I right in thinking that they are entitled to this?

 

I am currently totting up my charges and will keep you informed. In the meantime, if someone could let me know about the interest above.

at the end of my statements it usually has a page stating the amount of interest charged for using my overdraft facility (not being over my overdraft) and when this will be debited from my account. That is the only way i am notified of the interest i am paying, however that is with Natwest and i'm not sure if it's the same format for Halifax.

It is the same with the Halifax, if you look at the bottom of the previous months statement it will list the debited interest charge which will be appplied the following month - I was charged £1.78 last month and I intend to claim this back from them as well!

Dear all

 

I have now totted up all the charges and interest and I am astounded with how much they have taken from me over the past 6 years.

 

I am now on my way to the post box to send my letter requesting reimbursement for the grand sum of £1,048.22, which I intend to go all the way to claim what is rightfully mine.

 

Can I also claim for compensations as they have made my finances hell due to this?

Received 1st response to my LBA letter from my local branch today saying.

Dear Mr Clarke

 

Charge Policy

 

I write to acknowledge receipt of your letter of the 31st March 2006 regarding the Halifax Charging Policy. Your complaint will be dealt with by our Customer Relations Department who will contact you in due course.

 

You will find enclosed a copy of our leaflet which tells you how we handle your complaint.

 

Your concerns will be dealt with a quick as possible, but if you need to speak to me in the meantime, please telephone me.

Assistant Branch Manager.

The 14 days are up on the 14th April 06, and then I will issue court proceedings on the 15th April 06,

 

Could any one please advise me what I should do next, sit and wait, phone them, visit them or just write to them advising them of the time scale I have set?

I agree with Seminole's sentiment - very much indeed.

However, I would recommend that you go a little more carefully just in case. Allow an dextra 7 days and then issue.

I have read nearly every link and thread on this site, I think confusion occurred due to the forms being almost identical and the time I have spent on this site.

Just to give you an update, hared nothing from Halifax from my LBA letter so I have now given them a further 7 days to respond, if no joy court proceedings will commence on the 26th April 06

 

Just to advise you - go to the guidance pages and read up all about "bringing your case to court". I am filing my claim on Tuesday and have been reading up on it. I think I will need to familiarise myself with the notes - please do the same.

I have now read the notes and to be honest now I have read them and re looked at my statements I am quote looking forward to meeting them face to face in court and asking them how the can justify charging me £58 for going over my OD fee by £2.

As of today’s date I have still not heard a thing from Halifax?

 

No call, no mail and no offers?

 

Is this normal, after reading the site everybody has had contact with the bank? Have I done something wrong?

 

I would appreciate it if you could read my full thread and advise as I will be issuing court proceedings today?

Hello Clarkey

 

I have not had one reply to my letters to the Halifax and i have issued court proceedings today.I have been a bit worried that i have had no contact but as has been mentioned on this forum i am just sticking to my time table.If they cant be bothered to acknowlege then it does not look good for them.

 

Hopefully they will ignore the court papers and lose by default.Either way i can just sit back and relax.
