    • I disagree with the charge and also the statements sent. Firstly I have not received any correspondence from DVLA especially a statutory notice dated 2/5/2024 or a notice 16/5/2024 voiding my licence if I had I would have responded within this timeframe. The only letter received was the single justice procedure notice dated the 29.5.2024 this was received on 4.6.2024. I also disagree with the statement that tax was dishonoured through invalid indemnity claim. I disagree that the licence be voided I purchased the vehicle in Jan 2024 from RDA car sales Pontefract with agreement to collect the car on the 28.1.2024. The garage taxed the vehicle on the 25.1.24 for eleven payments on direct debit  using my debit card on my behalf. £62.18 was the initial payment on 8.2.24  and £31 per month thereafter the second payment was 1.3.24.This would run from Jan 24 to Dec 24 and a total of £372.75, therefore the car was clearly taxed before  I took the car away After checking one of my vehicle apps  I could see the vehicle was showing as untaxed it later transpired that DVLA had cancelled my tax , without reason and I did not receive any correspondence from DVLA to state why it was cancelled or when. The original payment of £62.18 had gone through and verified by my bank Lloyds so this payment was not declined. I then set up the direct debit again straight away at my local post office branch on 15.2.2024 the first payment was £31 on 1.3.2024 and subsequent payments up to Feb 2025 with a total of £372.75 which was the same total as the original DD that was set up in Jan, Therefore I claimed the £62.18 back from my bank as an indemnity claim as this payment was from the original cancelled tax from DVLA and had been cancelled . I have checked my bank account at Lloyds and every payment since Jan 24  up to date has been taken with none rejected as follows: 8.2.24 - £62.15 1.3.24 - £31.09 2.4.24 - £31.06 1.5.24 - £31.06 3.6.23-£31.06 I have paper copies of the original DD set up conformation plus a breakdown of payments per month , and a paper copy of the second DD setup with breakdown of payments plus a receipt from the post office.I can also provide bank statements showing each payment to DVLA I also ask that my licence be reinstated due to the above

    • I've completed a draft copy to defend and will post up here for review.  Looking over the dates and payments this all stemmed from DVLA cancelling in Feb , whereby I set up a new DD in Feb hence the overlap, why they cancelled when I paid originally in Jan I have no idea. Anyway now stuck with pending court action and a suspended licence . I am also firing off a letter to DVLa recorded disputing the licence revoke

I know all my DVLA details are good. I recently (last year) renewed my license, and my car's V5 is current with the correct details; the same is valid for my partner. I'll continue to ignore the love letters 😂 and won't let it bother either me or my partner.  I'll revisit this post if/when I get a letter of claim.  F**k ém.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have spoken to Barclays 2day and the lady I was speakin to claim Barclays have found 2 potential suppliers and are making a choice on which one from the 2 to have, and the students will be notified by letter !! ARGHH!!! want my money back instead ! but this new provider can be disputed over with valid reason to why you dont want to accept it e.g. the location of the workshops are to far

Hi Ally, No I keep checking but nothing I think that form went to USA, but Fuzzbutt phoned them yesterday and they'll look into the contracts and get back to him it'll be interesting see what they say.

You're right we can't give up without at least trying to enforce our s75 rights

I've just about had enough of the stress and it might have more clout if there's a lot of us with the same aim on this.

I was reading the Debt forum here and my hat's off to some of the inspiring people who have empowered themselves against Banks and DCA's, because thanks to Advent and BPF I have nothing but a massive debt.

I was set up and feel conned ( MCSE needing to be employed in IT for 18month before attempting it.) to fleece the pockets of the already disgustingly rich. It's criminal, Legally of course.

I have just returned from my meeting with a solicitor, he thinks I have a strong case against Barclays Partner Finance, he has got to look through all the documents that I have provided but the next step is for a strong letter to Barclays asking them to stop stalling and start reimbursing the money.

He is confident that the letter will, kick Barclays into gear and I will get a proper response rather than a template letter. When we get a response depends on how we can act next, basically Barclays will consult there legal advisers and proceed accordingly.

I did mention that there are a lot of other students in the same boat as me and would he look at representing us all if we wanted to take this further, he thinks that the more people who contact him the more clout we will have if we unite we can also split costs.

So if anyone would like to join me in this is what you need to do.

Make copies of all the following documents and send/e-mail to him [email protected]

· Advent Enrolment form

· Barclays Letters and agreement

· Your letters sent to Barclays

· You MUST put in your letter or e-mail that this is to do with advent computer training, Reference the meeting with Aaron Vowles on 24th March, “I have a similar case and would like to be included”.

Hi a4ron, excellent new, thanks. Can I ask if you qualify for legal aid. I don't so I don't know if that will affect me being able to include myself in this. Also, my course was with Access rather than Advent, but they're essentially the same company so hopefully won't cause a problem

Hi Matthew,

Unfortunately I don’t qualify for legal aid, however whilst in the meeting the solicitor did enquire if I was eligible for legal aid, so it must be something they deal with as well.

I would get something sent to them and ask the question, at the moment there is no charges because you haven’t asked them to do anything anyway , they will notify you of costs etc before doing any work, so its worth just sending copies of your documents to see what can be done.

Did the solicitor mention the frustrated contract issue out of interest, or just the S75 CCA as a basis to fight for a refund on breach of contract?

 

I have heard back today from Hausfeld (who may consider representing us as a group for free on a no win no fee basis - yet to hear details though.)

As I say, I don't know exactly what the Hausfeld deal will be so need to hear back on details first before making a decision either way, but A4ron's solicitor sounds a good option too if he's happy to take us all on.

I am very interested into what does come about as i too fell for the sales speech, took out the credit agreement with BPF and so owe them 10k including the interest.

 

Willing to help as best as i can, though it seems you guys are doing an admirable job so far. Will keep checking this regularly!

I'm on the case BIGTIME!

 

It's sickening that a bank can basically quietly bully and mislead customers for it's own ends. And let's face it, that's what is going on here..hoping you won't speak up and push it!

 

Mass mailout soothing letters from Barclays tell us don't worry we are in the process of arranging an alternative provider ..umm...soon, but we're not sure exactly when...

 

HA HA ...Well you've had your time now Barclays and (I'm sure they are monitoring this forum!) we are gonna kick your ass! Wake up and take note!!

I do have another point - with XP support shortly being dropped by Microsoft where does that leave our study plans?

 

With Windows 7 now being the jewel in the MS crown we need to be studying towards relevant qualifications.

 

Its no use studying to be a steam train mechanic if all the modern trains run on diesel.

 

Surely we can use this as well?

That is an very relevant point. Rumours abound connecting Advent students to a possible provider who only does Server 2003 qualifications.

 

 

 

We have been offering Server 2008 for some time, and we now include the new Windows 7 qualifications as well. This is one of the reasons we issued the press release - as we are not part of the negotiating process we didn't want to be associated with no choice other than older qualifications, as well as possibly poor support.

Hi, first post on here. Just received an arrears notice letter from barclays partner finance, despite the fact that the account is frozen and no payments have been missed.

 

Wasn't happy, so rang them up to complain. Before I could complain the customer service rep informed me that the new provided had been finalised. No big surprise. It is Computeach.

 

They will be sending letters out to students over the next few days. There is also a contact number available for us to contact Computeach if want to speak to them. Sorry i didn't write the number down.

 

Also told to ignore the arrears notice.

Like most of you guys I would like to be out of this mess and have nothing more to do with BPF. But it looks like we'll just have to bend over and take it. I feel the only hope we had of getting our money back was the length of time it was taking to source the new provider.

 

With Computeach being finalised today, that looks like we're not going to get what we want. I'll just have to re-focus on the fact that I got into this in the first place to gain IT qualifications. It'll just be with another provider now.

Even so, under ALL agrements "consumer rights" if we are not hapy with the product or service WE can take action against them.

 

Personally, I have lost 8 weeks that I cannot gain back in study time and my employer won't extend any allowances they have made for me over the duration that the course would take.

 

When I handed my money over at least I knew what i was buying, in the sence that the location of advent was good, I had seen the facilities, (or so i thought at the time!!).

If i wanted to go with computeach i would of signed up with them....

 

Would you accept this if you were buying a BMW and then you were offered a Hyundi, it's still a car I guess "they" can argue?

 

I have had enough, i'm going to continue with getting my money back, solicitor it is

Thanks for posting that'll be why BPF has gained confidence to send out demands for payment.(Me too )They can't deny the time. They've took too long and Computeach:eek
