    • If that was the reason then that is good news. The whole reason that being able to charge £100 for breaching private car park rules is because the law Lords decided in a celebrated case that the rogues had a legitimate interest in keeping their car park spaces available for all motorists . {parking Eye v Beavis]. However when the business is closed then there is no legitimate interest in keeping spaces free so to charge £100 is a penalty. As such any Court would automatically throw out the case when the penalty charge is accepted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

Took my car in for a main service and some other faults, they claim to have done the Oil Service and said that the other bits and pieces were fixed when they clearly were not.

 

Told BMW and they said to come back on Monday and they will have another look at it, they have put the £720 bill on hold for the mean time.

 

What are my rights? - Need some general advice please :(

So why do you say 'claim' to have done an oil service, are you saying they haven't done one?

 

What were the other bits and what was clear that makes you say there weren't done?

Well the windows were supposed to be adjusted and BMW called me to say the car was ready to collect, so I assumed everything was sorted and ready to go. Upon further inspection, the windows were not resolved at all and all confidence has been lost, how do I know they've changed the oil and brake fluid?

 

The technician would of had to carry a test before saying the car is ready for collection, upon collection, this was clearly not case.

 

I have to wait futher 2-3 days now which is causing a big inconveince to me.

Was the oil service lights showing on your dashboard service indicator ?

 

You should be able to see the oil filter by visually looking-a new one is very different to an old one.

You should also be able to see if the oil has been changed by checking from the dipstick-new oil is very easy to determine by its colour.

Also look on the top of the rocker cover where the oil filler cap is.

There are likely to be tell tale signs there if its just been done.

You can check if the oil filter is new by looking at it and the same with the oil. If it's a petrol car the oil will be transparent and if it's a diesel, it will be black but you will be able to see through it if you spread it onto something.

Same with the brake fluid, it will be very clear and if you want to stick your head underneath, there will be some wet on the inside of the brake back plates.

 

Have you got a copy of the bill that is on hold and if so, is the work you requested itemised on that bill?

If so, if all is well after their second attempt, then confront them with the bill and ask why you were presented with it when the work had not been carried out.

 

Don't be fobbed off with an excuse, all work should be checked before it is released to the customer and not taken as being done on the word of a mechanic or a tick in some box.

 

I'm assuming this was at the BMW main dealer, is that correct?

Again,there is a simple test that can be done to see if the brake fluid has been renewed.

Can you say if this is a BMW main dealer or a BMW specialist ?

The bill which is yet to be paid is fully itemised, the oil service and brake fluid have been carried out apparently, all the dashboard indicators and service books have been stamped accordingly.

 

My issue is regarding the window alignment, why was I called to collect the vehicle after three days and it is not ready as the fault still exists, I have to wait for a further two days now until Monday when the service department resumes. I've lost all confidence in the dealer and it is a BMW main dealer therefore you would expect the best especially as the bill presented to was £690

Why is the bill amount different from your original post £690/£720.

 

Are these the side opening windows and were they not sealing correctly when fully shut?

Did you detail enough the fault and what you wanted done?

Yes, I fully explained and showed the service advisor the problems on the car and he said yes, there is a fault and we can just readjust them, when collecting, showed another service advisor and he also said it's not right and said bring it back Monday.

 

Both of my friends have the same car and they don't have this window problem.

 

Basically it's an 2006 BMW M3 Convertible and when the door is opened, you can just literally rattle the windows by shaking them, they are not firm, there shouldn't be any give or movement at all

i would suggest you wait to confirm they have been fixed to your satisfaction and then ask for some recompence for your inconvenience and their failure to complete a job they then billed you for.

 

Have it in goodies, you get more for your money that way, like your next MoT free or fuel.

Anything that you are offered get it in writing.

What was the original complaint. You will get a significant amount of movement/rattle on this system dependant on where the window position is in relation to the door. Adjustment in the X, Y and Z plains is minimal.

 

System is designed to drop on opening of doors. Suggest that it might be your friends that have the faulty windows and not yours.

 

Lets get some sense to the thread to sort out.

You taking a bit of a heavy hand here and being a bit insulting.

 

The service advisor has agreed that there is a problem and has asked for the car to be returned for corrective action.

 

Which is why I suggested that it is sorted on Monday after a further inspection.

The windows werent done which may well have brought about the questioning if other things were done.

With 25 posts we are not talking of a seasoned CAGGER but I would not say a troll either.

Expression can come much more easy for some.

I have the possibility to look at the bigger picture,which I have done.

From that I can say that I dont see reasons for alarm.

Thats not the point Conniff, as I freqently point out to be able to comment fully one needs to be able to see nearly all posts. I cannot see your second quote "quote" or any relation to it.

 

Further I cannot see anywhere any post in relation to the first part of the quote.

 

So this leaves the whole question open to misinterpretation.

 

Again I smell a rat on this one but it's impossible to pass objective comment because it's not possible to see the full tale.

 

Then this leads to Pub mechanic suggesting this and that, which the forums allow and I whole heartedly support as no one knows all but it does lead to mis interpreation.
